Article 1 In order to strengthen the prevention and control of termites in urban houses, control the harm of termites, and ensure the safety of living and using urban houses, these measures are formulated in accordance with the relevant provisions of the state and combined with the actual situation of this province.
These Measures shall apply to the termite control activities of urban houses and their supervision and management within the administrative area of this province.
The term "termite control" as mentioned in these Measures refers to the prevention and treatment of termites in newly built, rebuilt, expanded and decorated urban houses and the termite control of built urban houses.
Article 3 The prevention and control of termites in urban houses shall follow the principles of giving priority to prevention, combining prevention with control and comprehensive management.
Article 4 People's governments at or above the county level shall encourage and support scientific and technological research on termite control in urban houses, popularize and apply new technologies, new drugs, new processes and new equipment for termite control, reduce the use of chemical drugs and protect the ecological environment.
Fifth provincial people's government housing and urban and rural construction administrative departments responsible for the supervision and management of termite control in urban housing within the administrative area of this province.
The real estate administrative department of the people's government of the city or county shall be responsible for the supervision and management of termite control in urban houses within their respective administrative areas.
Sixth urban housing termite control units (hereinafter referred to as termite control units) shall meet the conditions stipulated by the administrative department of housing and urban and rural construction in the State Council.
Termite control units shall strengthen the self-discipline management of the industry according to law.
Seventh new construction, renovation, expansion and decoration of urban housing, the construction unit shall sign a termite prevention contract with the termite control unit before the construction project starts. Termite control contracts shall specify the scope of control, control costs, quality standards, acceptance methods, control period, liability for breach of contract, etc.
Article 8 When termites occur in urban built houses, the owners, users or management units of the houses shall entrust termite control units to carry out termite control.
Housing owners, users and management units shall cooperate with termite control units to carry out termite inspection and prevention.
Where a termite control unit is entrusted to engage in termite control, a termite control contract shall be signed with the entrusting party. The termite control contract shall specify the control scope, control cost, quality standard, acceptance method, control period and liability for breach of contract.
Article 9 The period of termite prevention and treatment shall not be less than 15, and the period of termite control shall not be less than 2 years. The treatment period is calculated from the date when the termite control project is put into use. In case of termite damage during the treatment period, the termite control unit shall conduct free treatment in time.
Tenth termite control units shall establish and improve the quality assurance system for termite control, and carry out prevention and control in strict accordance with the national and provincial construction technical specifications and operating procedures for termite control in urban houses.
Eleventh termite control units shall establish and improve the management system of termite control construction files, and the construction files shall be standardized and complete. The termite control project during the treatment period, the termite control unit shall regularly pay a return visit to review, and make records and file them for future reference.
Twelfth termite control units shall use termite control agents approved by the relevant departments of the State Council, establish and improve the management system for the use of agents, and implement the storage of agents in special warehouses and special personnel management.
Termite prevention and control units shall abide by the provisions on pesticide anti-virus, do a good job in safety protection and waste disposal, and prevent drug poisoning accidents and environmental pollution.
Thirteenth termite control units shall collect fees for termite control in accordance with the charging objects and charging standards stipulated by the administrative department of price and finance of the provincial people's government. Termite control fees shall be turned over to the state treasury at the same level in full, which shall be included in the financial budget management, and the expenditure on termite control funds shall be arranged through the departmental budget.
Fourteenth construction units should be the implementation of termite prevention and treatment documents, pictures and other information, as the construction project completion and acceptance of the record data unified management.
The construction unit shall, when handling the formalities of housing property registration, issue a certificate to the housing registration management department that the project has implemented termite prevention and control.
When a real estate development enterprise sells a new commercial residential construction project, it shall issue a termite prevention contract or other documents that have been implemented for termite prevention and treatment to the purchaser, and the residential quality guarantee provided shall include the contents of termite prevention quality assurance.
Fifteenth in violation of the provisions of these measures, one of the following acts shall be punished by the administrative department of real estate of the people's government of the city or county in accordance with the relevant provisions of the administrative department of housing and urban and rural construction in the State Council:
(a) do not meet the conditions prescribed by the administrative department of housing and urban and rural construction in the State Council, engaged in termite control business;
(two) the termite control unit fails to carry out prevention and control in accordance with the national and provincial technical specifications and operating procedures for termite control in urban houses or uses unqualified chemicals in termite control construction;
(three) the real estate development enterprise has not issued a project termite prevention contract or other documents to prove that the termite prevention treatment has been implemented to the purchaser, and the residential quality guarantee provided does not include the termite prevention quality guarantee;
(four) the construction unit fails to carry out termite prevention in accordance with the provisions;
(five) the owner, user or management unit of the house fails to entrust the termite control unit to carry out termite control or refuses to cooperate with the inspection and prevention work of the termite control unit.
Sixteenth units engaged in termite control in violation of these measures, causing losses to the parties, bear the corresponding liability for compensation; Causing major quality accidents or other serious consequences, which constitutes a crime, shall be investigated for criminal responsibility according to law.
Article 17 State functionaries who abuse their powers, engage in malpractices for selfish ends or neglect their duties in the prevention and control of termites in urban houses shall be given administrative sanctions in accordance with the provisions of the Regulations of the State Council Municipality on the Punishment of Civil Servants of Municipal Administrative Organs; If a crime is constituted, criminal responsibility shall be investigated according to law.
Eighteenth termite control in rural houses and urban gardens within the administrative area of this province shall be implemented with reference to these measures.
Article 19 These Measures shall come into force as of 20 12 10.
