Commodity prices refer to the prices of various tangible products and intangible assets.
Service price refers to various paid service charges, including operating charges and administrative charge. Article 3 The basic forms of price formation and management include operator pricing, government pricing and government guidance pricing.
Operator's pricing refers to the price formed by legal persons, other organizations and individuals (hereinafter referred to as operators) engaged in commodity production, management or providing paid services in the market competition.
Government pricing refers to the price set by the competent price departments and relevant departments of the people's governments at or above the provincial level and the people's governments of cities (prefectures) and counties (cities, districts) authorized by the provincial people's government in accordance with the pricing authority and scope.
Government-guided price refers to the price set by the competent price departments and relevant departments of the people's governments at or above the provincial level and the people's governments of cities (prefectures) and counties (cities, districts) authorized by the provincial people's government. According to the pricing authority and scope, the benchmark price and its floating range are specified to guide operators to set prices. Article 4 The people's governments at or above the county level shall establish and gradually improve the price formation mechanism under macro-control, with market-regulated prices as the mainstay, and the prices of a few commodities and services shall be guided or fixed by the government. Implement a price management system of unified leadership and hierarchical management, establish and improve a price control system, and promote open, fair, legal and just price competition. Article 5 The competent price departments of the people's governments at or above the county level shall be responsible for the price work within their respective administrative areas, and the market supervision and management departments shall exercise the power of price supervision and inspection according to law. Other relevant departments of the people's governments at or above the county level shall be responsible for the relevant price work within the scope of their respective duties. Chapter II Pricing by Operators Article 6 In addition to government pricing and government-guided prices, the prices of goods and services shall be independently set by operators according to law. Article 7 The pricing of business operators shall follow the principles of fairness, legality, honesty and credibility, and set prices reasonably according to the normal production and operation costs and market supply and demand within the scope permitted by national laws and regulations. Article 8 Operators shall enjoy the following rights in price activities:
Independently set and adjust prices regulated by the market;
(two) to set the price within the scope stipulated by the government guidance price;
(three) to set the trial sale price of new products within the scope of government-guided prices and government-priced products, except for specific products;
(four) to make suggestions on the adjustment of government pricing and government guidance prices;
(five) to report and accuse violations of their independent pricing rights according to law;
(6) Other price rights granted by laws and regulations. Article 9 An operator shall perform the following obligations in price activities:
(a) abide by laws and regulations, the implementation of government guidance, government pricing, legal price intervention measures and emergency measures formulated according to law;
(2) When selling or buying goods or providing services, the price shall be clearly marked, indicating the name, specification, grade, pricing unit, price, place of origin or service items, charging standards and other relevant information of the goods. Do not sell goods at a price higher than the marked price, and do not charge any unmarked fees;
(3) Accept price supervision and inspection, and truthfully provide relevant accounting vouchers, account books, bills, statements, audio-visual materials, electronic data, documents and other relevant materials;
(four) establish and improve the internal price management system, accurately record and verify the production and operation costs of goods and services, and shall not resort to deceit;
(5) Other obligations stipulated by laws and regulations. Article 10 An operator shall not commit any of the following unfair price behaviors:
(1) colluding with each other to manipulate market prices and harming the legitimate rights and interests of other business operators or consumers;
(2) In order to crowd out competitors or monopolize the market, dumping at a price lower than the cost, disrupting the normal production and operation order, and harming the interests of the state or the legitimate rights and interests of other operators, in addition to handling fresh goods, seasonal goods and overstocked goods at reduced prices according to law;
(3) fabricating and disseminating information about price increases, driving up prices, and driving up commodity prices too high;
(four) using false or misleading price means to trick consumers or other operators into trading with them;
(5) Providing the same goods or services and discriminating against other business operators on the same trading terms;
(6) buying or selling goods or providing services by raising or lowering the grade, etc., and raising or lowering the price in disguise;
(seven) profiteering in violation of laws and regulations;
(8) Other unfair price behaviors prohibited by laws and administrative regulations. Chapter III Government Pricing and Government-guided Pricing Article 11 The government may, when necessary, impose government pricing or government-guided pricing on the following commodities and services:
(a) the prices of a few commodities that have a significant impact on the development of the national economy and people's lives;
(2) The prices of commodities with scarce resources;
(three) the price of commodities operated by natural monopoly;
(4) Important public utility prices;
(5) Prices of important public services.
