The judicial administrative department shall strengthen the guidance on the work of the people's mediation committee for medical disputes according to law.
Insurance supervision and management institutions shall strengthen the supervision and management of medical liability insurance according to law.
Public security organs should strengthen the public security management of medical institutions, maintain normal medical order, and deal with acts that disturb medical order according to law. Article 6 The news media shall abide by the provisions of relevant laws and regulations, abide by professional ethics, report medical disputes objectively and fairly, and correctly guide public opinion. Article 7 This Municipality establishes a medical liability insurance system and encourages medical institutions to participate in medical liability insurance. Article 8 A people's mediation committee for medical disputes shall be established in cities and counties (hereinafter referred to as the Medical Mediation Committee) to be responsible for the people's mediation of medical disputes in urban areas and counties (cities) respectively, and accept the professional guidance of the local judicial administrative department. The medical adjustment Committee does not charge any fees for mediating medical disputes, and the working funds are guaranteed by the finance at the same level.
The rules for mediation of medical disputes shall be formulated by the Medical Commission according to the relevant provisions of "People's Republic of China (PRC) * * * and people's mediation" and these Measures, and reported to the judicial administrative department at the same level for the record. Chapter II Prevention Article 9 The administrative department of health shall standardize the practice access of medical institutions, strengthen the supervision and management of the practice behavior of medical institutions, and improve the medical service quality of medical institutions and medical personnel. Tenth medical institutions shall, in accordance with the provisions of relevant laws, regulations and rules, establish and improve the medical safety responsibility, medical quality monitoring and evaluation, doctor-patient communication, medical accident accountability and other systems and medical dispute handling plans.
Medical institutions should arrange reception places, equipped with specialized personnel to receive patients' consultation and complaints. Eleventh medical personnel shall abide by the following provisions:
(a) comply with health laws, regulations, rules and technical specifications;
(two) abide by professional ethics, care, love and respect patients, and protect patients' privacy;
(three) study hard, update knowledge, improve the professional and technical level;
(four) in the diagnosis and treatment activities, the patient's condition and medical measures should be explained. If surgery, special examination and special treatment are needed, the medical risks and alternative medical schemes shall be explained to the patients in time, and written consent shall be obtained; If it is not appropriate to explain it to the patient, it shall explain it to the patient's close relatives and obtain their written consent;
(5) If the opinions of patients or their close relatives cannot be obtained due to emergency situations such as rescuing dying patients, corresponding medical measures can be implemented immediately with the approval of the person in charge of the medical institution or the authorized person in charge;
(six) in accordance with the provisions of writing medical records, shall not conceal, forge or destroy medical documents and related items and materials. Twelfth patients and their close relatives shall abide by the following provisions:
(1) Abide by the rules and regulations of medical institutions;
(two) truthfully state the illness to the medical staff, cooperate with the medical staff in diagnosis, treatment and nursing, and sign the relevant informed consent written materials as required;
(3) Paying medical expenses according to regulations;
(four) after the occurrence of medical disputes, express opinions and demands according to law. Thirteenth public medical institutions should participate in medical liability insurance, and non-public medical institutions can voluntarily participate in medical liability insurance.
The municipal public health administrative department may determine the insurance institutions that underwrite medical liability insurance through bidding.
Insurance costs are paid from the business funds of medical institutions and included in the cost of medical institutions according to regulations; Medical institutions shall not increase the existing charging standards or increase the burden on patients in disguise because of participating in medical liability insurance. Fourteenth public security organs shall, in accordance with relevant laws and regulations, guide and urge medical institutions to implement public security prevention systems, measures and public security work norms, and timely discover and rectify hidden dangers of public security. Chapter III Reporting and Disposal Article 15 After a medical dispute occurs, a medical institution shall promptly report to the local health administrative department, start a medical dispute disposal plan, and handle it according to the following procedures:
(a) timely organization of hospital expert consultation, consultation opinions to inform patients or patients' close relatives;
(two) in the presence of both doctors and patients, according to the "Regulations on the Handling of Medical Accidents" sealed or unsealed physical objects and related medical records;
(3) If a patient dies in a medical institution, the body shall be moved to the mortuary or funeral parlour in accordance with regulations. If both doctors and patients are unable to determine the cause of death or have objections to the cause of death, an autopsy shall be conducted in accordance with the Regulations on Handling Medical Accidents;
(4) Informing patients or their close relatives of the methods and procedures for handling medical disputes, and answering their inquiries and questions;
(five) patients or patients' close relatives and other personnel seriously disturb the order of medical work and do not listen to dissuasion, and report to the local public security organ in time;
(six) medical institutions that have participated in medical liability insurance shall truthfully provide medical disputes to medical liability insurance underwriting institutions;
(seven) after the disposal, submit a report on the disposal of medical disputes to the administrative department of health, and truthfully reflect the occurrence, investigation and handling of medical disputes.
