In recent years, more and more China people have gone abroad for employment, especially in Viet Nam. Belt and Road? The first stop is the first choice of many people in China. However, going abroad for employment is different from domestic employment. If you plan to go abroad (take Vietnam as an example), you should not only understand the local employment situation and demand, but also have a certain understanding of the local employment laws and regulations, so as to be aware of it. I will elaborate on the legal provisions on employment conditions in Vietnam as follows:

First, enter Vietnam with legal and valid documents (passports, etc.). ) and handle relevant licenses and visas in accordance with relevant Vietnamese laws and regulations. According to Vietnam's labor law, foreigners who have legally entered Vietnam for employment for more than 3 months (inclusive) must apply for a work permit (commonly known as? Work permit? Work permit, Vietnamese: gi? y ph? P old? Ng) and work visa (visa type: l? Work in Vietnam, labor? Old? ng? Abbreviation).

Conditions for applying for a work permit:

1/ has full capacity for civil conduct as stipulated by law; (Note: Vietnam's Labor Law 20 12 stipulates that men 15-60 years old and women 15-55 years old, of which those under 18 years old are regarded as underage workers, and the working hours of their weekly and daily working days and the employment of employers have been specifically stipulated. )

2/ Physical health conditions that meet the work requirements; (Certificate of entry medical examination of domestic hospitals above Grade 3A (notarized and certified by both foreign affairs and consuls) or certificate of entry medical examination in accordance with local regulations in Vietnam (please refer to the list of hospitals provided by the employer with the qualification of entry medical examination for foreigners).

3/ As a business owner, executive director/CEO, expert or skilled worker; (Ordinary people should have a college diploma or corresponding work skills and work experience)

4/ Criminals or persons subject to criminal responsibility that are not stipulated in Vietnamese laws and foreign laws; (No criminal record certificate, domestic translation notarization and foreign consular double certification; If you have lived in Vietnam for six months continuously, you must have a judicial resume issued by the local judicial department? l? l? ch t? ph? p? )

The competent authority approves the use of foreign workers. (handled by the employer in advance)

It is the responsibility and obligation of employers to apply for work permits and work visas, and all foreign workers should apply for them (those who are exempted from applying for work permits according to Vietnamese laws should also apply to the central municipality/province Labor Invalides and the Ministry of Social Affairs (hereinafter referred to as? Department of Labor? ) proof of handling work permit exemption). If the employer illegally uses foreign workers, the following fines and administrative penalties will be imposed:

1. Illegally employed personnel (without work permit or work permit exemption confirmation or work permit expired) will be deported.

Two. For employers who illegally use foreign workers:

1/ failing to inform the relevant authorities about the use of foreign workers or reports, but failing to ensure the work content and time limit stipulated by law, a fine of1-2 million VND will be imposed.

2/ Employers who use foreign workers without work permits or work permit exemption certificates or expired public work permits will be fined according to the following circumstances:

A) Illegal use of 1- 10 foreign workers and a fine of 30-45 million Vietnamese dong;

B/ Illegal use of 65,438+00-20 foreign workers and a fine of 45-60 million VND;

C illegal use of more than 265,438+0 foreign workers, with a fine of 60-75 million VND.

In case of violation of the provisions in the third paragraph of this article, additional punishment shall be imposed: order to stop business activities 1-3 months.

Secondly, it is necessary to sign a labor contract (which is also one of the documents for applying for a work permit) and ensure that the signed labor conforms to the Vietnamese labor law and relevant laws and regulations (for example, the current labor law in Vietnam stipulates that the longest probation period is 2 months, and the same employee of the same employer can only set a probation period once). Pay medical insurance, social insurance (Vietnam's social security is roughly equivalent to domestic endowment insurance) and personal income tax (Vietnam's current tax threshold is VND 9 million) according to law.

Thirdly, we should respect local customs, and don't talk about or argue about sensitive or offensive topics (such as controversial political and historical issues).
