What procedures and materials are needed for marriage registration?
Application, examination and registration are three links in the process of marriage registration.
(1) application
Couples who meet the conditions for marriage registration can apply for marriage registration at the marriage registration office where one party is located with relevant documents, certification materials and registration photos. Both parties fill in the application documents for marriage registration on the spot.
The preparation materials for marriage registration application depend on the specific circumstances. For example, when applying for marriage in China, a citizen of China must hold his/her valid pre-marital examination certificate, ID card, household registration book, single certificate of no spouse, and a signed statement that he/she is not related to the other party. Divorced persons who apply for remarriage must also carry a divorce certificate.
Foreigners living in China, foreign Chinese and other foreigners applying for marriage registration in China need to hold their valid passports, foreigners' residence permits or temporary entry and residence certificates, and a certificate of marital status issued by a notary office in China certified by the Ministry of Foreign Affairs (or an organ authorized by the Ministry of Foreign Affairs) and Chinese embassies and consulates in that country.
(2) Review
The marriage registration authority shall verify and examine the parties who apply for marriage registration, and find out whether the marriage application submitted by them is within the conditions. If the application materials submitted by the parties are unknown, the marriage registration authority will ask the parties and may require them to provide relevant materials when necessary.
(3) Registration and licensing
For those who meet the conditions for marriage, the marriage registration authority shall register them and issue marriage certificates to the parties; For those who have experienced divorce, the marriage registration office will cancel their divorce certificates; When necessary, the marriage registration office will also issue a notice of disapproval of marriage registration, explaining the reasons why it cannot be registered.
What procedures and documents do you need for divorce?
The process of divorce registration is roughly as follows:
(1) application
If a husband and wife voluntarily divorce in the Mainland, they shall conclude a written divorce agreement, apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:
1, my marriage certificate;
2. Relevant valid identity documents that meet the requirements, such as household registration book, identity card, pass or passport;
3. An application for divorce registration filled in at the marriage registration office.
(2) Accept
The staff of the marriage registration office will conduct a preliminary examination of the application materials submitted by both husband and wife as required. After the divorce application is verified by the first instance, send the "Receipt of Acceptance of Divorce Registration Application" to the parties. Those who do not meet the requirements for divorce registration will not be accepted. If the parties request to issue a notice of not accepting the application for divorce registration, they shall issue it.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, any party who does not want to divorce can bring his valid identity certificate and the Receipt for Accepting the Application for Divorce Registration (if the receipt is lost, no written explanation is required), and withdraw the application for divorce registration from the marriage registration office that accepts the application for divorce registration, and fill out the application for withdrawing the divorce registration in accordance with the relevant provisions on withdrawing the application for divorce registration. After verification, the marriage registration authority shall issue a Confirmation Letter for Withdrawing the Application for Divorce Registration. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply for a divorce certificate at the marriage registration office, the application for divorce registration shall be deemed to have been withdrawn.
(4) Review
Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday will be the expiration date of the cooling-off period), both parties shall go to the marriage registration office together with the divorce agreement, marriage certificate, photos, valid certificates to prove their identity and other relevant documents and materials signed by both parties, and handle the divorce certificate according to the regulations. The marriage registration authority shall conduct an examination in accordance with the provisions of the Code for Marriage Registration. Those who do not meet the conditions for divorce registration shall not be handled. If a party requests to issue a notice not to register for divorce, it shall issue it.
(5) Registration and certification
The marriage registration authority shall register and issue divorce certificates in accordance with the provisions of the marriage registration work norms.
