(two) public concern is high, and members of the Standing Committee, deputies to the National People's Congress and other citizens, legal persons and other organizations put forward more opinions;
(three) in the process of implementing the regulations, it is found that general problems need to be evaluated;
(four) other necessary quality evaluation.
The Legal Affairs Committee and the Legal Affairs Committee shall submit the annual plan for quality assessment of local laws and regulations to the meeting of directors of the Standing Committee for examination and approval, and include it in the annual work points of the Standing Committee. Article 4 To evaluate the quality of local laws and regulations, a comprehensive evaluation can be conducted or part of the contents can be evaluated according to the specific conditions of the laws and regulations.
The evaluation work should focus on the selection of local laws and regulations related to the key issues of economic and social development and the vital interests of the masses as the evaluation project, and carry out evaluation around the legality, rationality, coordination, effectiveness and standardization of local laws and regulations. Article 5 Evaluation is divided into evaluation preparation stage, evaluation implementation stage and evaluation result report formation stage. Article 6 The main work in the preparation stage of assessment:
(1) Establish an evaluation working group. Members are mainly composed of relevant personnel of the Legal Affairs Committee and the Legal Affairs Committee. Members of the Standing Committee, relevant special committees, relevant working bodies of the Standing Committee, relevant departments of the provincial people's government, personnel of the provincial higher people's court and the provincial people's procuratorate, relevant social organizations, deputies to the provincial people's congress and relevant experts may be invited to participate. The leader is the person in charge of the Legal Affairs Committee or the Legal Affairs Committee. The evaluation working group can be divided into several groups according to the needs of the work.
(two) to develop the evaluation work plan. The evaluation work plan mainly includes evaluation items, evaluation purposes, organization and implementation, working principles, evaluation contents and standards, methods and steps, and time arrangement. The evaluation work plan shall be submitted to the meeting of directors of the Standing Committee for approval before implementation.
(3) other work. Seventh evaluation of the main work in the implementation stage:
(1) investigation and study. We can take the methods of literature research, questionnaire survey, on-the-spot investigation, listening to reports, holding symposiums, demonstration meetings, special interviews, targeted surveys, sampling surveys, typical case analysis, expert consultation, etc. to understand and master the quality of legislation and the implementation effect of regulations.
(2) Analysis and evaluation. According to the evaluation contents and standards, collect, process and analyze the collected information and data, and put forward preliminary evaluation opinions. If the evaluation work is divided into several groups, each group should first put forward its own preliminary evaluation opinions, and then comprehensively put forward the overall preliminary evaluation opinions. Article 8 The main work in the formation stage of the evaluation result report:
(a) to draft the evaluation results report. The evaluation working group shall conduct further research and demonstration on the preliminary evaluation opinions in a timely manner, and designate a special person to draft the evaluation result report. The evaluation report shall include the following contents:
1. evaluation: the purpose and requirements of evaluation, the main steps and basic methods of evaluation.
2. Evaluation project analysis and evaluation: the legislative quality, implementation effect, existing problems and reasons of the evaluated laws and regulations.
3. Relevant suggestions: suggestions on abolishing or amending local laws and regulations, and the specific contents of the proposed amendments; Suggestions on improving the implementation effect of local regulations, etc.
(two) report on the evaluation results. The evaluation working group shall hold a meeting of the whole group to discuss and revise the evaluation result report, and submit it to the meeting of the Legal Committee for deliberation after being studied by the Legal Committee. When necessary, experts can be organized to demonstrate the evaluation result report. Article 9 When evaluating the quality of local laws and regulations, the Legal Affairs Committee and the Legal Affairs Committee may, according to the actual situation of the evaluation project, appropriately simplify the evaluation steps, do not set up a special evaluation working group, collect information by holding symposiums, online questionnaires, soliciting opinions in writing, etc., organize experts to analyze or hold demonstration meetings, and form an evaluation result report. Article 10 The Legal Affairs Committee and the Legal Affairs Committee may, according to the actual situation, entrust institutions of higher learning, scientific research institutions and other qualified units to carry out the quality evaluation of local regulations.
When the entrusted party carries out the evaluation work, the Legal Committee shall guide and urge it to carry out the evaluation work in accordance with the agreement, and submit relevant reports and original data materials. Article 11 When evaluating the quality of local laws and regulations, the Legislative Affairs Committee and the Legislative Affairs Committee shall strengthen communication with the relevant special committees of the provincial people's congress, the working organs of the Standing Committee, the relevant departments of the provincial people's government, the provincial higher people's court, the provincial people's procuratorate and relevant social organizations, and listen to opinions on issues related to the evaluation work.
