The term "government information" as mentioned in these Provisions refers to the information produced or obtained by administrative organs in the course of performing their duties, and recorded and preserved in a certain form. Article 3 The disclosure of government information shall adhere to the following principles:
Publicity is the norm, non-disclosure is the exception;
(two) legal and effective, fair and just, timely and accurate, convenient and beneficial to the people;
(three) responsible for the classification, who makes, who is open, first review, after the public, who is open, who is responsible for the first instance. Article 4 People's governments at all levels shall strengthen the organization and leadership of government information disclosure at the corresponding level, strengthen the construction of government information disclosure platform on the Internet, promote the integration of government information disclosure platform and government service platform, and realize the standardization, standardization and information management of government information resources.
The general offices (offices) of the people's governments at all levels are the competent departments of the information disclosure work of the people's governments at the corresponding levels, and are responsible for the promotion, guidance, coordination and supervision of the government information disclosure work within their respective administrative areas.
Under the unified guidance and coordination of the superior competent department and the local people's government at the same level, the administrative organ that implements vertical leadership carries out the work of government information disclosure. The administrative organ with dual leadership shall carry out the government information disclosure work under the leadership of the local people's government at the same level and accept the guidance of the superior business department.
The main person in charge of the administrative organ is the first person in charge of the government information disclosure work of this organ. Article 5 An administrative organ shall establish and improve the working system of government information disclosure, and designate a special working institution (hereinafter referred to as the working institution of government information disclosure) to be responsible for the daily work of government information disclosure of this organ.
Government information disclosure institutions shall perform the following duties:
(a) to undertake the government information disclosure work of this organ;
(two) to organize the preparation of the government information disclosure guide and catalogue of the organ and the annual report on the work of government information disclosure;
(3) Collecting, sorting out, preserving, maintaining and updating the government information voluntarily disclosed by this organ;
(four) to accept and handle the application for government information disclosure submitted to this organ;
(five) to conduct a confidential review of the government information to be disclosed, and put forward opinions on whether to disclose and the scope of disclosure;
(six) other matters related to the government information disclosure work of this organ. Sixth big data, government administrative service management agencies and other competent departments shall, in accordance with their respective responsibilities, do a good job in government information disclosure. Seventh citizens, legal persons and other organizations have the right to obtain and use government information in accordance with laws, regulations, rules and relevant provisions.
Citizens, legal persons and other organizations shall not illegally obtain or use government information involving state secrets, and shall not infringe upon the privacy, commercial secrets and other social interests of others.
Administrative organs shall not illegally obstruct or restrict citizens, legal persons and other organizations from obtaining and using government information according to law in any form. Eighth people's governments at all levels shall include the funds needed for government information disclosure in the fiscal budget at the same level. Chapter II Scope of Publicity Article 9 An administrative organ shall voluntarily disclose the following government information of its own administrative organ:
(a) function, organization, office address, office hours, contact information, name of the person in charge, procedures, etc.;
(2) Involving the vital interests of citizens, legal persons or other organizations;
(3) It needs to be widely known or participated by the public;
(four) matters promised to the society and their completion;
(five) other government information that should be voluntarily disclosed by laws, regulations, rules and national, provincial and municipal documents. Article 10 The people's governments at or above the county level and their departments shall, in accordance with the provisions of Article 9 of these Provisions, determine the specific contents of government information voluntarily disclosed within the scope of their respective duties, focusing on the disclosure of the following government information:
(1) Rules and normative documents;
(two) national economic and social development planning, special planning, regional planning and related policies;
(3) Statistical information on national economic and social development;
(4) Reports and statements on the budget, budget adjustment, final accounts and budget implementation approved by the people's congress at the corresponding level or its standing committee, departmental budgets and final accounts approved by the financial department of the government at the corresponding level, and the arrangement and use of the operating funds of the organs;
(five) the completion of key government work and major livelihood projects;
(six) the approval of major construction projects and their implementation;
(seven) the bidding, bidding and construction of government-invested construction projects, and the catalogue, standards and implementation of centralized government procurement projects;
(eight) the items, basis and standards of administrative fees;
(nine) administrative licensing and other administrative authority matters and their setting basis, implementation subject, operation process, application conditions, application materials, processing time limit, charging basis and standards, processing progress and results, supervision methods, matters needing attention, etc. , as well as the administrative punishment decision that this organ thinks has certain social impact;
(ten) policies, measures and their implementation in poverty alleviation, education, health care, social security, employment promotion and other public services;
(eleven) and environmental protection, public health, production safety, food and drug, product quality related policies, examination and approval, supervision and management, typical cases, law enforcement inspection, special rectification, complaints from the masses to report key issues, illegal units to deal with rectification, relevant warnings and other information;
(twelve) investment projects, agreements, funds in place and their implementation;
(thirteen) the annual performance appraisal results of the main objectives;
(fourteen) major issues of urban and rural construction and management;
(fifteen) municipal construction, public security management, public services, social assistance, public welfare and other aspects;
(sixteen) the payment and use of land expropriation or requisition, housing expropriation and compensation, and subsidy fees;
(seventeen) information on the allocation of public resources such as urban affordable housing projects and land supply;
(eighteen) emergency rescue and disaster relief, special care, relief, social donations and other aspects of the policy, fund management, use, distribution and so on;
(19) Information on the restructuring of state-owned enterprises, contracting, leasing, auction of collective enterprises or other economic entities, major financial indicators, overall operation, performance appraisal results, preservation and appreciation of assets, reform and reorganization, post change of responsible persons, recruitment of state-owned enterprises, etc.;
(twenty) the relevant information of social organizations and intermediaries;
(twenty-one) information on the positions, conditions, procedures and results of civil servants, civil servant managers and institutions in personnel recruitment, employment or open selection of cadres;
(twenty-two) emergency plan, early warning and response to public emergencies.
