Regulations of Tianjin Municipality on Social Credit

Chapter I General Provisions Article 1 In order to strengthen the construction of social credit, cultivate and practice socialist core values, improve the level of social credit, create a good business environment and protect the legitimate rights and interests of credit subjects, these Regulations are formulated in accordance with relevant laws and administrative regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the collection, collection, application and management of social credit information within the administrative area of this Municipality, the encouragement and punishment of trustworthiness, the protection of the rights and interests of credit subjects, the development of credit service industry, the construction of social credit environment and other activities. Where laws and administrative regulations provide otherwise, such provisions shall prevail.

The term "social credit" as mentioned in these Regulations refers to the behavior and state of natural persons, legal persons and unincorporated organizations with full capacity for civil conduct (hereinafter referred to as credit subjects) in fulfilling their legal obligations or agreed obligations in social and economic activities.

The social credit information mentioned in these Regulations refers to the objective data and materials that can be used to identify, analyze and judge the performance of credit subjects. Article 3 This Municipality promotes the construction of social credit systems such as government integrity, business integrity, social integrity and judicial public trust, advocates and praises honesty and trustworthiness, and punishes dishonesty according to law. Article 4 The collection, collection, application and related management activities of social credit information shall follow the principles of legality, fairness, necessity, objectivity and safety, and shall not infringe upon state secrets, business secrets, personal privacy and other personal information. Article 5 The municipal and district people's governments shall incorporate the construction of social credit system into the national economic and social development plan, and organize and promote the construction of social credit system in their respective administrative regions.

This Municipality shall establish and improve the coordination mechanism for the construction of social credit system, coordinate major issues in the construction of social credit system, and strengthen the guidance and supervision of the construction of social credit system. Article 6 The municipal and district development and reform departments are the competent departments of social credit work within their respective administrative areas, responsible for the comprehensive coordination, supervision and management of the construction of social credit system within their respective administrative areas, organizing the formulation of relevant policies and measures and coordinating their implementation.

The relevant departments of the municipal and district people's governments shall, in accordance with their respective responsibilities, do a good job in the construction of the social credit system. The municipal and district development and reform departments shall strengthen the supervision and management of public credit management institutions. Article 8 This Municipality shall cooperate with relevant state departments to do a good job in credit information interconnection and information sharing; Establish a regional credit cooperation mechanism, promote credit information sharing and mutual recognition of credit evaluation results with Beijing, Hebei and other provinces, autonomous regions and municipalities directly under the Central Government, and strengthen cross-regional joint rewards and punishments in key areas. Chapter II Social Credit Information Article 9 Social credit information includes public credit information and market credit information.

Public credit information refers to the credit information generated or obtained by state organs, organizations authorized by laws and regulations to manage public affairs, mass organizations, public service enterprises and institutions and other public credit information providers in the process of performing their duties and providing services according to law.

Market credit information refers to the credit information generated and obtained by credit service institutions, trade associations, chambers of commerce, other enterprises and institutions and other market credit information providers in production and operation, service provision or industry self-discipline management activities. The municipal development and reform department shall, jointly with the relevant departments, compile the catalogue of public credit information in this Municipality in accordance with the provisions of the state, solicit opinions from the public in the process of compilation, and publish it in a timely manner after being examined and approved by the municipal social credit system construction coordination institution.

The public credit information catalogue shall specify the public nature, scope, right to use and other matters of credit information. Eleventh public credit information providers shall, in accordance with the public credit information directory, establish social credit records for service objects and management objects to form social credit information.

Public credit information providers shall timely, accurately and completely collect public credit information of their own industries, fields and administrative regions, and submit them to the credit information sharing platform at the same level.

The district credit information sharing platform shall push the public credit information to the municipal credit information sharing platform in a timely, accurate and complete manner, and the municipal credit information sharing platform shall handle it in a timely manner in accordance with the provisions to realize the utilization of the city's public credit information.

When the public credit information provider collects and uses the credit information of natural persons according to the public credit information catalogue, it shall clearly indicate the purpose, method and scope of collecting and using the information, and obtain my consent. Where laws and regulations provide otherwise, such provisions shall prevail. Article 12 The following information of credit subjects shall be included in the public credit information catalogue as untrustworthy information:

(1) Obtaining information such as administrative license, administrative confirmation, administrative payment and administrative reward by cheating, bribery or other improper means;

(two) the information of administrative punishment made by applying the general procedure, except that the illegal act is minor or actively eliminates or mitigates the harmful consequences of the illegal act;

(three) information that refuses to perform the administrative decision and is enforced by the administrative organ according to law;

(4) Refusing to perform effective judgments, orders and other legal documents;

(five) other information related to the credit status clearly defined by laws, regulations and relevant provisions of the state.

The record of dishonesty information should be based on legally binding documents.
