Legal effect of reminder letter

Legal analysis: A dunning letter is a dunning tool and a notice used by the payer or individual when the payment is overdue. Other documents commonly used by enterprises in accounts receivable collection have both commercial nature and legal connotation. Generally, it refers to the letter sent by the payee asking the other party to pay when the other party owes money. A reminder letter can play the role of interrupting the limitation of action, and the civil action in China is generally stipulated to be three years.

Legal basis: Article 195 of the Civil Law is in any of the following circumstances, the limitation of action is interrupted, and the limitation of action is recalculated from the date of interruption and the end of relevant procedures:

(1) The creditor makes a performance request to the debtor;

(2) The debtor agrees to perform its obligations;

(3) The obligee brings a lawsuit or applies for arbitration;

(four) other circumstances with the same effect as bringing a lawsuit or applying for arbitration.
