Provisions of Suzhou Municipal Government on Information Disclosure

Chapter I General Provisions Article 1 In order to establish a fair and transparent administrative management system, safeguard citizens, legal persons and other organizations' right to know, safeguard their legitimate rights and interests, supervise government agencies to perform their duties according to law, and promote administration according to law, these Provisions are formulated in accordance with the relevant provisions of laws and regulations and combined with the actual situation of this Municipality. Article 2 The term "government information" as mentioned in these Provisions refers to the contents produced, obtained or mastered by government organs in the process of performing administrative duties or providing public services, which should be released publicly in accordance with these Provisions, reflecting their functions of economic regulation, market supervision, social management and public services.

The term "government organs" as mentioned in these Provisions refers to the people's governments at all levels in this Municipality and their departments, agencies and other organizations exercising administrative functions and powers according to law. Article 3 These Provisions shall apply to government information disclosure activities within the administrative area of this Municipality. Article 4 Government agencies are obligors of information disclosure, and shall fulfill their obligations of disclosing and providing government information in accordance with these Provisions.

Citizens, legal persons and other organizations are the right holders of information disclosure and enjoy the right to obtain government information in accordance with these provisions. Article 5 The principle of government information is publicity, with the exception of non-publicity.

Government information disclosure should follow the principles of comprehensiveness, truthfulness, timeliness and convenience.

In addition to the government information listed in Article 16 of these Provisions that is exempted from disclosure according to law, all government information related to economic regulation, market supervision, social management and public services shall be disclosed or provided upon application. Sixth people's governments at all levels are responsible for the organization and implementation of government information disclosure.

The leading group offices of government affairs disclosure at all levels are responsible for the daily work of government information disclosure. Seventh government agencies at all levels shall designate specialized agencies and personnel to handle the affairs of government information disclosure and be responsible for the daily work of government information disclosure. Specific responsibilities include:

(1) To be responsible for the voluntary disclosure of government information by this organ;

(two) to accept and handle the application for government information disclosure submitted to this organ;

(three) to keep, maintain and update or urge the relevant institutions of this organ to keep, maintain and update the government information of this organ;

(four) to organize the preparation of the government information disclosure guide, the government information disclosure catalogue and the annual plan, summary and report of the government information disclosure work of this organ;

(five) other duties as prescribed by laws, regulations and rules. Article 8 The supervisory departments of the people's governments at all levels and the office of the leading group for government affairs disclosure shall, according to their respective duties, be responsible for organizing the supervision, inspection and evaluation of the implementation of government information disclosure.

Government agencies should consciously accept the supervision of the people's congresses at the same level and their standing committees on the disclosure of government information. Article 9 When exercising the right to obtain government information, the right holder of information disclosure shall not infringe upon state secrets, commercial secrets, privacy of others or other public interests.

No citizen, legal person or organization may illegally obstruct or restrict the activities of information disclosure obligors to disclose government information in accordance with these Provisions and the rights of information disclosure obligees to obtain government information. Tenth government agencies should include government information disclosure funds in the annual budget to ensure the normal conduct of government information disclosure activities. Chapter II Scope of Government Information Disclosure Article 11 An information disclosure obligor shall voluntarily disclose the following government information:

Management norms and development plans

1. government regulations, normative documents formulated by government organs at all levels and other documents related to economic regulation, market supervision, social management and public services;

2 planning, planning, progress and implementation of economic and social development;

3. Overall urban planning, other urban planning, overall land use planning, town planning and scenic spot planning, etc. ;

4. Basis, conditions, procedures, standards, processing time limit, processing results and monitoring complaint channels of administrative licensing items and charging items;

5 administrative law enforcement basis, subject, personnel, procedures, results, complaint channels, etc.

(two) major issues closely related to the public.

1. Prediction, occurrence and disposal of epidemic situation, disaster situation or unexpected events that affect public personal and property safety;

2 standards, conditions and implementation of poverty alleviation, special care, education, social security and employment;

3 approval documents, compensation standards and resettlement plans for land acquisition and demolition.

1. Public bidding, bid winning and project progress of major infrastructure projects;

2 government procurement catalog, procurement quota standards, open tender amount standards, procurement results and their supervision;

3 approved by the people's Congress of the government's annual budget and final accounts report and its implementation.

2. Resumes, division of labor and adjustment of leaders of governments at all levels and their departments;

3 conditions, procedures and results of the recruitment, employment and open selection of cadres of civil servants.

Where there are other provisions in laws and regulations on the public authority of the matters mentioned in the preceding paragraph, such provisions shall prevail.
