Measures of Jilin Province for the Administration of Police Auxiliary Personnel of Public Security Organs

Chapter I General Provisions Article 1 In order to standardize the management of police auxiliary personnel in public security organs, give full play to the role of police auxiliary personnel in assisting public security organs to maintain social order, crack down on illegal crimes, implement administrative management and serve the people, and safeguard the legitimate rights and interests of police auxiliary personnel, these measures are formulated in accordance with relevant laws, regulations and state regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the administration of police auxiliary personnel of public security organs within the administrative area of this province. Article 3 The auxiliary police officers mentioned in these Measures (hereinafter referred to as auxiliary police officers) refer to those who are recruited for the society and provide auxiliary support for the daily operation and police activities of public security organs.

Auxiliary police are divided into civilian auxiliary police and service auxiliary police according to the division of responsibilities.

Auxiliary police implement a hierarchical management system. Article 4 Auxiliary police shall carry out auxiliary police work under the command and supervision of public security organs and their people's police.

The auxiliary police's assistance to the people's police in performing their duties according to law is protected by law, and the consequences of performing their duties shall be borne by their public security organs. Fifth people's governments at all levels should incorporate the construction of auxiliary police into the local economic and social development plan.

People's governments at all levels shall include the auxiliary police's salary and welfare, social insurance, clothing and equipment, education and training, daily management and other funds in the fiscal budget at the corresponding level. Article 6 The public security organs of the people's governments at or above the county level shall be responsible for the recruitment, use and management of auxiliary police.

The departments of finance, human resources and social security, civil affairs and institutional establishment of the people's governments at or above the county level shall be responsible for the management of auxiliary police according to their respective responsibilities. Chapter II Responsibilities Article 7 Civilian auxiliary police may engage in the following auxiliary work related to non-law enforcement posts of public security organs:

(a) to assist the clerical assistant, file management, wiring inquiry, window service, certificate processing, information collection and entry and other administrative work;

(two) to assist in psychological counseling, medical treatment, translation, computer network maintenance, data analysis, software research and development, security monitoring, communication guarantee, fund analysis, non-confidential financial management, laboratory analysis, on-site investigation, inspection and identification and other technical support work;

(three) to assist in the custody and maintenance of police equipment, logistics services and other police security work;

(four) other tasks that can be performed by the civilian auxiliary police. Eighth auxiliary police officers in active service may engage in the following auxiliary work related to law enforcement posts of public security organs:

(a) To help prevent and stop illegal and criminal activities;

(two) to assist in public security patrol, public security inspection and safety inspection of personnel gathering places;

(three) to assist in the investigation, blocking, monitoring and detention of criminal suspects;

(four) to help maintain the order of cases (events), protect cases (events), and rescue the injured;

(five) to help ease traffic, discourage and correct traffic safety violations, and collect traffic violation information;

(six) to assist in the daily management of drug addicts, to inspect the enterprises of precursor chemicals, and to make public the drug investigation;

(seven) to assist in the management and supervision of public security;

(eight) to assist in the development of entry-exit management services and border inspection;

(nine) to participate in fire fighting and rescue, and to assist in fire supervision and management;

(ten) to assist in public security, traffic safety, drug control and other publicity and education;

(eleven) other tasks that can be assisted by the auxiliary police. Ninth auxiliary police shall not engage in the following work:

(1) domestic security, technical reconnaissance, anti-cult and anti-terrorism work;

(2) Handling matters involving state secrets;

(three) the case investigation and evidence collection, issue an appraisal report, and identify the responsibility for traffic accidents;

(four) the implementation of criminal compulsory measures;

(5) Making administrative decisions;

(6) Examining cases;

(7) Keeping weapons and police equipment;

(eight) law enforcement alone;

(nine) other jobs that the auxiliary police are not allowed to engage in according to laws and regulations. Chapter III Recruitment Article 10 The people's governments at or above the county level or the public security organs of the people's governments at or above the county level shall recruit and use auxiliary police by purchasing services from social forces, signing labor contracts or employment contracts according to law.

The conclusion, performance, alteration, dissolution or termination of the auxiliary police labor contract or employment contract shall be implemented in accordance with relevant laws and regulations. Article 11 The public security organs of the provincial people's government put forward opinions on the employment quota of auxiliary police in the whole province, which were audited by the finance, human resources and social security departments of the provincial people's government and implemented after being approved by the provincial people's government. Article 12 The public security organ of the people's government at or above the county level shall, according to the social security situation and the level of economic development, put forward an employment plan within the quota of auxiliary police personnel, and report it to the people's government at the same level for approval after being audited by the finance, human resources and social security departments at the same level. Thirteenth auxiliary police recruitment by the public security organs of the people's governments at or above the county level in conjunction with the human resources and social security departments at the same level unified organization and implementation, can also be independently implemented by the public security organs of the people's governments at or above the county level according to the approved employment plan.

The recruitment and use of auxiliary police by the public security organs of the people's governments at or above the county level shall be reported to the public security organs of the people's governments at the next higher level for the record.
