(1) Interim Provisions on Intellectual Property Protection of China (Guangzhou) International Automobile Exhibition

In order to protect inventions and patents, encourage design innovation, standardize market order and establish a good image of the exhibition in terms of intellectual property rights, the exhibition makes the following provisions on the protection of design patents related to exhibits during the exhibition:

1. The intellectual property consultation point (hereinafter referred to as the consultation point) on the exhibition site is composed of the exhibition organizer and the local intellectual property management department, and it is the only institution that accepts complaints about patents, trademarks and copyrights on the exhibition site.

2. The information desk only accepts complaints about alleged infringement of intellectual property rights during the current exhibition.

3. Exhibitors must consciously abide by China's laws and regulations on patent protection and the relevant provisions of the General Assembly on exhibits (including products posted and placed on the booth, publicity pictures and materials, unpacked items) and patent management, and prepare effective certification documents for the intellectual property rights of exhibits.

4. The exhibition requires exhibitors to strictly examine the intellectual property status of products, and exhibitors must provide legal and effective proof of intellectual property ownership, and it is forbidden to bring infringing products to the exhibition site. Without the permission of the patentee, the exhibitor shall not display, quote or trade with other people's patented products.

5. When the complainant accepted by the on-site consultation point complains about patent infringement, the complainant must submit the following information:

(1) patent certificate, patent legal status certificate and patent authorization announcement text;

(2) the identity card of the patentee;

(3) If an agent is entrusted, the power of attorney and the identity certificate of the agent shall also be provided;

(4) The complained exhibitors and their booth numbers.

6. The organizer of the exhibition will strengthen on-site supervision, strictly examine the exhibits, exhibition boards and related publicity materials during the preparation and display, and report the infringement to the relevant administrative departments in a timely manner.

7. The complainant must provide guarantee to the exhibition organizer. If a malicious complaint causes losses to the exhibition organizer or the respondent, the complainant must bear corresponding legal responsibilities.

8. Once the patent infringement complaint is accepted by the relevant patent administration department, the organizer of the exhibition will assist the patent administration department or relevant notary agencies and patent infringement complainants to collect evidence (including taking photos, taking photos and sampling), check and identify at the booth site. Once the patent administration department determines that it constitutes suspected infringement, after receiving the Notice of Handling Suspected Patent Infringement, the exhibitors must give evidence and reply within half a working day (subject to the schedule of the exhibition venue), or immediately remove the suspected infringing products from the exhibition shelves.

9. The complained exhibitors and their exhibitors must actively cooperate with the patent administration department or the consultation point to check the patent right of the exhibits, so as to ensure the smooth progress of the exhibition. The patent administration department and the General Association have the right to request the public security and exhibition hall security personnel to cooperate and assist in performing relevant duties.

10. If the complainant refuses to accept the complaint at the on-site consultation point and negotiates with the suspected infringer, which causes disputes at the exhibition site and affects the trading order, the General Assembly has the right to prohibit him from entering the exhibition hall.

(2) Measures to deal with suspected infringement of intellectual property rights

1. Exhibitors who hold valid certificates to participate in this exhibition may complain to the on-site intellectual property information desk if they find that the exhibits, publicity materials and display pieces displayed in the booth are suspected of infringement in the exhibition hall.

3. After the above-mentioned relevant documents are verified by the staff, the complainant shall fill in the complaint form as required.

4. After receiving the complaint letter, the service desk will arrange the staff to accept the complaint. The respondent shall assist the enquiry point in handling the formal complaints made by the exhibitors' representatives at the meeting.

5. The principle of inversion of burden of proof shall be applied to the consultation point in handling suspected patent infringement cases. Upon learning that the exhibits exhibited by the Respondent are suspected of infringement, the Respondent shall immediately produce a certificate of rights or other evidence to prove that it has the right to exhibit or operate the exhibits, provide proof of non-infringement, and assist the information desk staff to inspect the suspected exhibits.

6. If the respondent can't provide valid evidence that the alleged infringing exhibits are "non-infringing" on the spot, the information desk staff has the right to temporarily detain the alleged infringing exhibits. The respondent shall immediately sign a letter of commitment and promise not to operate or display the exhibits suspected of infringement during this exhibition. "Commitment" in duplicate, held by the respondent and the enquiry point respectively.

7. If the respondent disagrees with the handling result of the complaint station, he can provide supplementary proof of non-infringement at the consultation point within half a working day. If the evidence is valid, the complaint station will immediately return the detained exhibits and allow them to continue to be exhibited; If the evidence is invalid, overdue or supplementary evidence is not provided, the General Assembly has the right to confiscate the detained products.

8. In order to maintain the order of the meeting, the complainant shall not take further legal action against the respondent at the exhibition site after handling it at the consultation point, and the respondent shall accept this handling until the end of this exhibition.
