Among them, the defendant Pan Mouqun and the defendant Yin Mou are husband and wife. Before the incident, Yin was the second-class sheriff of the Seventh Brigade of the Economic Investigation Detachment of Wuhan Public Security Bureau.
The public prosecutor accused Pan Mouqun of soliciting customers to find people, find cars and investigate extramarital affairs through websites, WeChat and QQ in the name of a business consulting company. After accepting the entrustment of the client, Yin obtained the required personal information of the citizen through the information inquiry system of the public security organ according to the request of her husband Pan Mouqun, and provided it to Pan Mouqun.
Two men of Pan Mouqun used the information provided by Pan Mouqun to find the target object, and then used GPS positioning equipment, squatting, tracking, taking photos and other means to obtain real-time personal information of others and provide it to customers. The two agreed with Pan Mouqun that the monthly basic salary is 4,000 yuan, and the commission for each business is 10%.
Pan Mouqun not only carried out business alone, but also cooperated with Xu Moujin, another defendant in this case, with equal remuneration. In addition to obtaining citizens' personal information through Yin, Pan Mouqun, Xu Mojin and others also obtained citizens' personal information through other means such as purchase and tracking, which was used to complete the entrusted business to obtain benefits.
According to the prosecution's allegations, during the period from 20 17 to 20 19, defendants such as Pan Mouqun, Yin Mou and Xu Mojin committed 27 crimes individually or jointly. Among them, Pan Mouqun participated in the implementation of 2 1 and cooperated with others to obtain illegal income of 3 1.57 million yuan. Yin participated in the execution of the 19 case, and conspired with others to obtain illegal income of 290,700 yuan. Xu Mojin participated in the execution of the 12 case, and illegally obtained 435,000 yuan together with others.
During the trial, both the prosecution and the defense expressed their opinions on the contents of the accusation.
The court found through trial that Pan Mouqun and Xu Mojin were accused by the prosecution of 2 1 and 12 respectively, and the amount of illegal income was correct, but Yin participated in the crime of 16 instead of the crime of 19 accused by the prosecution, and the illegal income was 23 10000 yuan.
After combing, it was found that the court found that most of the crimes that Yin participated in were informed to Pan Mouqun after she inquired about the trajectory of the target vehicle. Pan Mouqun and Xu Moujin arranged for others to obtain the real-time position of the vehicle by installing GPS and tracking cameras, and provided it to the client for paid use.

In the first instance, the court ruled that Pan Mouqun was guilty of infringing citizens' personal information, sentenced to five years in prison and fined RMB 120,000. Yin was convicted of infringing citizens' personal information, sentenced to four years in prison and fined 60 thousand yuan; Xu was convicted of infringing citizens' personal information, sentenced to four years and ten months in prison and fined RMB 100,000.
A mole? Not just Yin.
Pan Mouwen, another defendant in this case, was born in 1995. Before the incident, he was the auxiliary police of Shuita Street Police Station of Jianghan District Branch of Wuhan Public Security Bureau.
After discussing with his alumnus Liu, Pan Mouwen used the convenience of contacting the public security intranet to inquire about other people's household registration information, accommodation information, vehicle file information and the trajectory information of flying and trains and sold it to Liu, making a profit of 8,755 yuan. Later, Liu Moutao sold the information purchased from Pan Mouwen through the Internet, making a profit of 7355 yuan. In the end, Pan Mouwen was also sentenced to one year in prison, suspended for two years, and fined RMB 10,000. Liu was convicted of infringing citizens' personal information, sentenced to one year and three months in prison and fined RMB 20,000.
