The term "wetland" as mentioned in these Measures refers to natural or artificial areas with perennial or seasonal static or flowing water bodies, including coastal wetlands, lake wetlands, river wetlands, swamp wetlands and other natural wetlands, as well as artificial wetlands such as national and provincial key protected wildlife habitats or wild plant habitats.
The term "wetland resources" as mentioned in these Measures refers to wildlife resources and mangrove, moraine and other plant resources that inhabit, multiply and live in wetlands and their affiliated wetlands. Article 3 The people's governments of cities and counties (cities, districts) shall incorporate wetland protection into the national economic and social development plan, establish a comprehensive assessment and accountability system for wetland protection, increase investment in wetland protection and management, and incorporate the funds needed for wetland protection and management into the fiscal budget at the same level. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen their leadership in wetland protection, establish a comprehensive coordination mechanism, and coordinate and solve major problems in wetland protection. The forestry administrative department at the same level is responsible for its daily work. Fifth forestry administrative departments are the administrative departments in charge of wetland protection and management, and are responsible for organizing, guiding and supervising the wetland protection and management within their respective administrative areas.
The administrative departments of marine and fishery, water conservancy, urban and rural planning, land and resources, environmental protection, agriculture, science and technology shall do a good job in wetland protection according to the following division of responsibilities:
(a) the administrative department of marine and fishery is responsible for the supervision and management of marine nature reserves, marine special reserves, aquatic wildlife nature reserves and aquatic germplasm conservation zone, protecting the marine ecological environment and maintaining the biodiversity of wetlands;
(two) the water administrative department is responsible for water and soil conservation, water resources protection and management of regional wetlands such as rivers, lakes and reservoirs;
(three) the administrative department of urban and rural planning is responsible for the connection between urban and rural planning and wetland protection planning;
(four) the administrative department of land and resources shall be responsible for the registration of wetlands according to law, and shall, in conjunction with relevant departments, guide the development and utilization of wetlands;
(five) the competent administrative department of environmental protection is responsible for the water quality monitoring and quality evaluation of the water environment functional areas that flow into the wetland water body, regularly publish the monitoring information and evaluation results of the water environment quality, and put forward suggestions on the management of the wetland environment;
(six) the administrative department of agriculture is responsible for the management of agricultural production in the wetland area to reduce the pollution of agricultural production to the wetland ecological environment;
(seven) the administrative department of science and technology to support the development of wetland protection, utilization and other aspects of scientific and technological research and application;
(eight) other administrative departments in accordance with the division of responsibilities to do a good job in wetland protection.
The township (town) people's government and sub-district offices where the wetland is located shall do a good job in wetland protection. Article 6 The municipal forestry administrative department shall organize the establishment of an expert committee on wetland protection, and solicit the opinions of the expert committee on wetland protection when carrying out activities such as compiling wetland protection planning, compiling wetland directory, delineating wetland protection scope, formulating wetland protection scheme, monitoring and evaluating wetland resources, and carrying out construction and utilization. Chapter II Wetland Planning and Directory Management Article 7 The forestry administrative departments of cities and counties (cities, districts) shall organize and carry out a general survey of wetland resources in accordance with regulations, and report the results of the survey to the people's government at the same level and the forestry administrative departments at the next higher level for the record. The census results are the main basis for compiling wetland protection planning. Article 8 The municipal forestry administrative department shall, jointly with the relevant administrative departments, formulate the municipal wetland protection plan according to the wetland distribution, protection scope, types, ecological functions, water resources, wildlife resources and land utilization.
Wetland protection planning shall specify the overall layout, protection objectives, protection priorities, safeguard measures and utilization methods of wetlands, which shall be comprehensively balanced by the municipal administrative department of urban and rural planning, and promulgated and implemented after being reported to the Municipal People's Government for approval.
The preparation of special planning involving wetland protection shall solicit the opinions of the forestry administrative department at the same level. Ninth city and county (city, district) people's governments and relevant departments shall strictly implement the wetland protection plan, and shall not approve construction projects or carry out other development and construction activities in violation of the plan.
If it is really necessary to adjust or modify the wetland protection plan, it shall be handled in accordance with the prescribed procedures. Tenth is not included in the list of important wetlands at or above the provincial level, and it shall be included in the list of important wetlands in this Municipality if it meets one of the following conditions:
(1) A typical and representative natural wetland ecosystem with remarkable ecosystem service functions;
(2) A single wetland covers an area of more than 2,000 hectares, or a wetland system with multiple wetlands and important functions of maintaining ecological balance or hydrological regulation, or a reservoir with a storage capacity of more than 30 million cubic meters;
(3) Wetlands where more wild waterfowl concentrate on breeding, wintering and resting, or wetlands where rare and endangered animals and plants and plants endemic to China are distributed;
(4) Wetland with special protection value.
