Regulations of Jiangsu Province on the Development of Green Buildings

Chapter I General Provisions Article 1 In order to promote the development of green buildings, standardize green building activities, save resources, improve the quality of living environment, and promote the construction of new urbanization, these Regulations are formulated in accordance with the Building Law of People's Republic of China (PRC) and the relevant national regulations on green buildings, and in combination with the actual situation of this province. Article 2 These Regulations shall apply to green building activities and their supervision and management within the administrative area of this province.

The term "green building" as mentioned in these Regulations refers to a civil building that saves resources, protects the environment and reduces pollution to the maximum extent, provides people with healthy, applicable and efficient use space, and is in harmony with nature. Green buildings are divided into three grades: one star, two stars and three stars.

"Green building activities" as mentioned in these Regulations refers to the planning, design, construction, operation, transformation, demolition, evaluation and other activities related to green buildings. Article 3 Local people's governments at or above the county level shall establish and improve mechanisms to comprehensively promote the development of green buildings.

Encourage and support the research, development, demonstration and popularization of green building science and technology, and promote the innovation and progress of green building technology. Fourth local people's governments at or above the county level shall incorporate green building work into the national economic and social development plan. The competent construction departments of local people's governments at or above the county level shall be responsible for organizing the preparation of green building development plans, which shall be implemented after being approved by the people's governments at the corresponding levels. Fifth local people's governments at or above the county level shall be responsible for the guidance, supervision and management of green building activities within their respective administrative areas.

The relevant departments of local people's governments at or above the county level, such as development and reform, economy and informatization, planning, housing management, gardening, land and resources, water conservancy, science and technology, finance, environmental protection, ocean and statistics, shall, according to their respective functions and duties, do a good job in the development of green buildings. Sixth the implementation of green building development target responsibility assessment system. Specific assessment methods shall be formulated by the provincial people's government. Article 7 The local people's governments at or above the county level shall reward the construction units whose green buildings have reached two stars or above. Units and individuals that have made remarkable achievements in green building work shall be commended and rewarded by local people's governments at or above the county level. Chapter II Planning, Design and Construction Article 8 The overall urban planning shall follow the principle of green ecological development and implement the requirements of ecological environment protection, comprehensive utilization of energy, comprehensive utilization of water resources, economical and intensive utilization of land, comprehensive utilization of solid waste and green transportation. Article 9 The relevant departments of local people's governments at or above the county level shall organize the preparation of special plans for green buildings, comprehensive utilization of energy, comprehensive utilization of water resources, comprehensive utilization of solid waste and green transportation within their respective administrative areas, and implement them after being submitted for approval in accordance with regulations.

The competent department of urban and rural planning of the local people's government at or above the county level and the town people's government shall incorporate the relevant requirements of the special planning mentioned in the preceding paragraph into the regulatory detailed planning. Tenth the planning, design and construction of new civil buildings in this province should adopt the green building standards of more than one star.

Large-scale public buildings invested by state-owned funds or financed by the state shall be planned, designed and constructed in accordance with the green building standards of two or more stars.

Encourage other buildings to carry out planning, design and construction in accordance with the green building standards of two or more stars.

Provincial Construction Department is responsible for formulating and issuing green building standards. Eleventh construction project feasibility study report or project application report should include the requirements of green building, clear the green building technology and investment, energy saving and emission reduction benefits of project selection.

The development and reform department of the local people's government at or above the county level shall implement the requirements of green building when the project is approved, and incorporate the requirements of green building into the scope of energy-saving evaluation and review of fixed assets investment projects. Article 12 The competent department of urban and rural planning of the local people's government at or above the county level shall, according to the requirements of regulatory detailed planning, specify the green building grade and other indicators in the planning conditions of construction land. Article 13 When transferring, leasing or allocating land, the competent department of land and resources of the local people's government at or above the county level shall incorporate the indicators such as green building grade determined by the planning conditions of construction land into the contract for paid use of state-owned land or the decision on allocation of state-owned land. Article 14 The competent department of urban and rural planning of the local people's government at or above the county level shall solicit the opinions of the competent department of construction at the same level on whether the design scheme meets the grade standard of green building of the project; The competent department of construction shall put forward opinions within ten working days. If the project does not meet the grade standard of green building, the construction project planning permit shall not be issued. Fifteenth construction drawing design documents review institutions shall review whether the construction drawing design documents meet the green building standards, and shall not issue a construction drawing review certificate if they fail to meet the engineering green building grade standards. Sixteenth construction units in the project consultation, design bidding or commissioned design, should be clear about the green building grade and other indicators of construction projects.

The construction unit shall ensure that wall materials, insulation materials, doors and windows, heating and refrigeration systems, lighting equipment, non-traditional water facilities, water-saving appliances and other building materials, building components and equipment meet the requirements of construction drawing design documents.

The construction unit shall undertake the responsibility of quality assurance according to the grade of green building.
