Regulations of the Standing Committee of Jiangsu Provincial People's Congress on the Filing and Examination of Normative Documents (revised in 2020)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the provisions of the Legislative Law of People's Republic of China (PRC) and the Supervision Law of the Standing Committees of People's Congresses at Various Levels in People's Republic of China (PRC), and in light of the actual situation of this province, in order to standardize and strengthen the work of filing and examination and safeguard the unity of the socialist legal system. Article 2 These Regulations shall apply to the filing and examination of normative documents of the Standing Committees of people's congresses at all levels in this province. Article 3 The term "normative documents" as mentioned in these Regulations refers to the documents formulated by the relevant state organs of this province in accordance with the statutory authority and procedures, which involve the rights and obligations of citizens, legal persons and other organizations, have universal binding force, and are applied repeatedly in a certain period of time. Article 4 The Standing Committees of people's congresses at all levels shall, in accordance with the principles of being prepared, must be tried, and mistakes must be corrected, and conduct record review in accordance with legal authority and procedures. Article 5 The Standing Committees of people's congresses at various levels shall strengthen their leadership over the record-keeping and examination work, carry out the record-keeping and examination work according to law, ensure the prohibition by the Party Central Committee, guarantee the implementation of constitutional laws and regulations, protect the legitimate rights and interests of citizens, legal persons and other organizations, and promote the formulation organs to improve the level of normative documents. Article 6 The Legislative Affairs Committee of the Standing Committee of the Municipal People's Congress of a province or a district, the institution that the Standing Committee of the People's Congress of a county (city, district) undertakes the archival filing and examination work (hereinafter referred to as the archival filing and examination institution), and the special committees of the people's congresses at all levels and the working committees of the Standing Committee (hereinafter referred to as the relevant committees) are responsible for the archival filing and examination related work according to the prescribed duties. Article 7 The Standing Committees of people's congresses at all levels shall co-ordinate the record-keeping and examination work, strengthen the record-keeping and examination system and capacity building, establish and improve the record-keeping and examination institutions, and equip them with specialized personnel to improve the record-keeping and examination work ability and level. Article 8 The Standing Committees of people's congresses at various levels may establish an expert consultation system for filing and examination, and employ experts, scholars and practitioners as consulting experts to participate in filing and examination.

The filing and examination institution may entrust consulting experts and deputies to the National People's Congress to review the normative documents and put forward opinions and suggestions. Article 9 The Standing Committee of the Provincial People's Congress shall strengthen the informatization construction of filing and examination, establish and improve the operation mechanism of the filing and examination information platform, and improve the informatization level of filing and examination.

The standing committees of the people's congresses of cities and counties (cities, districts) divided into districts shall strengthen the use and management of the information platform for filing and examination, and cooperate with the platform operation and other related work. Chapter II Filing Article 10 The following normative documents shall be reported to the Standing Committee of the people's congress at the corresponding level for filing:

(1) Rules formulated by the people's governments of provinces and cities divided into districts;

(2) Decisions, orders and other normative documents issued by the people's governments at or above the county level;

(3) Normative documents formulated by supervisory committees at all levels to guide and standardize supervisory work;

(4) Normative documents formulated by people's courts and people's procuratorates at all levels to guide and standardize the trial and procuratorial work;

(five) explanations of the people's courts, people's procuratorates and competent departments of the people's governments of provinces and cities divided into districts on the specific application of local regulations;

(six) other normative documents that should be submitted for the record.

The rules formulated by the municipal people's government with districts shall be reported to the Standing Committee of the people's congress at the corresponding level for the record, and submitted to the Standing Committee of the provincial people's congress for the record. Eleventh the following normative documents shall be reported to the Standing Committee of the people's Congress at the next higher level for the record:

(1) Resolutions, decisions and other normative documents made by the people's congresses of cities and counties (cities, districts) and their standing committees;

(two) the interpretation of the local regulations of this Municipality by the Standing Committee of the Municipal People's Congress with districts;

(three) resolutions and decisions made by the Township People's Congress. Twelfth normative documents shall be submitted for the record within thirty days from the date of promulgation.

Paper materials such as filing reports, texts, explanations and rules shall be submitted for filing, and electronic materials shall be submitted through the filing and review information platform. Paper materials shall be bound into volumes in quintuplicate; Electronic materials shall conform to the format standards and requirements of the record review information platform.

The organ making normative documents shall determine the unit responsible for filing, and be responsible for filing normative documents. Thirteenth filing and examination institutions shall, within ten working days from the date of receiving the filing documents, conduct formal examination, and accept and register those that meet the statutory scope, complete filing materials and meet the format standards and requirements; Those who do not meet the statutory scope, the filing materials are incomplete or do not meet the format standards and requirements shall be returned in the form of electronic instructions of the filing and review information platform and explain the reasons.

If the filing materials are incomplete or do not meet the format standards and requirements, the filing responsibility unit shall, within ten working days from the date of receiving the electronic instruction, re-submit the filing as required. Article 14 Before June 365438+1October 3 1 every year, the unit responsible for filing normative documents shall submit the catalogue of normative documents formulated, revised and abolished by the formulation organ in the previous year to the filing and examination institution for verification.
