Regulations of Anshan Municipality on the Protection of Industrial Heritage

Chapter I General Provisions Article 1 In order to strengthen the protection and utilization of industrial heritage, inherit and promote Anshan industrial culture and Anshan industrial civilization, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics, the Law of People's Republic of China (PRC) on Intangible Cultural Heritage, the Implementation Regulations of People's Republic of China (PRC) Cultural Relics Protection Law and other laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the investigation, appraisal, protection, utilization, supervision and management of industrial heritage within the administrative area of this Municipality.

The industrial heritage that has been identified as a cultural relic shall be implemented in accordance with the laws and regulations on the protection of cultural relics. Article 3 The term "industrial heritage" as mentioned in these Regulations refers to industrial remains that can reflect the course of industrial development, have distinctive characteristics of the times and have high historical, scientific, technological, cultural and social values.

Industrial heritage includes material industrial heritage and intangible industrial heritage. Material industrial heritage includes workshops, factories, mines, warehouses, offices, entertainment places, living, education and leisure facilities, as well as related production tools, machinery and equipment, industrial products, office and daily necessities, archives and documents, audio-visual videos and other industrial heritage. Intangible industrial heritage includes production technology knowledge, management system and corporate culture. Article 4 The protection of industrial heritage shall follow the principles of giving priority to protection, rational utilization, government guidance and social participation. Fifth city, county (city) District People's government is responsible for the protection of industrial heritage within their respective administrative areas.

City, county (city) District Department of industry and information technology is the competent department of industrial heritage protection, and undertakes the supervision and management responsibilities of industrial heritage protection within their respective administrative areas.

Cultural tourism, radio and television, development and reform, ecological environment, housing and urban construction, transportation, market supervision, state-owned assets, science and technology, public security, finance, natural resources, auditing, statistics, civil air defense, archives management and other relevant departments are responsible for the protection of industrial heritage according to their respective responsibilities. Article 6 The people's governments of cities and counties (cities) shall include the funds for the protection of industrial heritage into the fiscal budget at the corresponding level to ensure the daily management and special protection.

The institutional income of state-owned industrial heritage protection units shall be earmarked for the protection of industrial heritage, and no unit or individual may occupy or misappropriate it.

Encourage private and social capital to participate in the protection and utilization of industrial heritage. Seventh city, county (city) District People's government and its relevant departments should strengthen the publicity and guidance of industrial heritage protection, improve public awareness of the value of industrial heritage, and enhance the awareness of industrial heritage protection in the whole society.

Encourage units and individuals to discourage, report or accuse acts that destroy or endanger industrial heritage according to law.

Units or individuals that have made outstanding contributions to the protection of industrial heritage shall be commended by the people's governments of cities and counties (cities). Eighth city, county (city) industrial and information technology departments shall, jointly with the competent departments of natural resources, organize the preparation of special plans for the protection of industrial heritage, and report them to the people's government at the same level for approval before implementation. County (city) industrial heritage protection special planning shall be reported to the municipal competent department of industry and information technology for the record.

The special plan for the protection of industrial heritage should be incorporated into the national economic and social development plan at the corresponding level and the overall planning of land and space. Chapter II Investigation and Identification Article 9 The Municipal People's Government shall set up an expert committee for the protection of industrial heritage, which shall be composed of professionals in the fields of cultural relics, industry, history, culture, science and technology, planning, architecture, tourism, law, etc., to provide advice on the investigation, identification, recommendation and declaration of industrial heritage. Tenth city, county (city) District Department of industry and information technology in conjunction with relevant departments to organize the implementation of industrial heritage investigation, identification, recommendation and declaration. Article 11 The investigation of industrial heritage shall be conducted according to law, and the investigation institution and its staff shall register and file the on-site situation, core projects and technological processes of industrial heritage in the form of words, pictures and images, and properly keep the investigation data. Conditional, timely establishment of industrial heritage database; Those who meet the conditions for cultural relics identification shall be identified and announced as cultural relics by the administrative department of cultural relics according to procedures; In line with the conditions for the identification of industrial heritage, the competent department of industry and information technology of the city and county (city) district shall identify and recommend the declaration. State secrets, business secrets or personal privacy involved in the investigation shall be kept confidential.

No unit or individual may falsely report, delay reporting, conceal, refuse to report, forge or tamper with survey data. Twelfth industrial heritage owners, or units and individuals authorized by the owners, can apply for or recommend industrial heritage to the local competent department of industry and information technology. If a heritage project involves multiple owners, they shall jointly apply after consultation. Thirteenth meet the following conditions of industrial heritage, by the municipal department of industry and information technology according to the application identified as municipal industrial heritage:

(a) is of symbolic significance in the history of this Municipality or the history of the industry, has witnessed the development of this Municipality's industry, has an important influence on the history of this Municipality, and is closely related to the social changes or important historical events and figures of this Municipality;

(two) the major changes in industrial production technology are representative, reflecting the technological innovation and breakthrough of a certain industry, region or a certain historical period, and have an important impact on the subsequent development of science and technology;

(3) It has rich industrial and cultural connotations, has a strong influence on the social, economic and cultural development at that time, reflects the social features in a specific historical period, and is widely recognized by the public;

(four) its planning, design and engineering represent the characteristics of a specific historical period or region and have an important influence on industrial aesthetics;

(5) Having a good foundation for protection and utilization.

In line with the standards for the identification of industrial heritage at or above the municipal level (excluding the municipal level), the local competent department of industry and information technology shall recommend the declaration according to the application.

The city's industrial heritage list is dynamically adjusted and published once a year.
