Chapter I General Provisions Article 1 In order to encourage and standardize voluntary service activities, promote the healthy development of voluntary service, promote socialist morality and promote social harmony, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to volunteers, voluntary service organizations and their activities within the administrative area of this Municipality. Article 3 The term "volunteer" as mentioned in these Regulations refers to a registered person who voluntarily uses his time, skills and other resources for free to carry out social services and public welfare activities. The term "voluntary service organizations" as mentioned in these Regulations refers to non-profit social organizations as legal persons registered in accordance with the law and specializing in voluntary service activities, as well as group volunteers such as organs, non-profit organizations and social organizations engaged in voluntary service activities. Article 4 Voluntary service activities shall follow the principles of voluntariness, legality, honesty, thrift and non-profit. Article 5 The scope of voluntary service includes supporting the elderly and caring for the young, helping the poor, teaching and educating people, environmental protection, community service and other social welfare activities. Article 6 The Shenzhen Volunteers' Federation (hereinafter referred to as the Municipal Volunteers' Federation) is responsible for organizing and coordinating the volunteer service activities of the whole city, and the volunteer federations of all districts (hereinafter referred to as the District Volunteers' Federation) are responsible for organizing and coordinating the volunteer service activities within their respective administrative areas. Volunteer service activities should accept the guidance and supervision of the Communist Youth League and other relevant departments. Article 7 The municipal and district people's governments shall bring voluntary service into the category of harmonious social development and provide necessary funds and support for voluntary service. Public security, urban management, civil affairs and other relevant departments shall give support to voluntary service within the scope of their duties. Article 8 State organs, social organizations, enterprises and institutions, schools and other organizations shall encourage voluntary service activities, publicize the spirit of volunteerism and safeguard the legitimate rights and interests of volunteers and voluntary service organizations. Chapter II Volunteer Work Article 9 Volunteers shall meet the following conditions: (1) Volunteer service; (2) Having corresponding capacity for civil conduct; (3) Physical conditions that meet the requirements of voluntary service activities; (4) Having corresponding service capabilities. The conditions for group volunteers are stipulated in the articles of association of the Municipal Federation of Volunteers. Tenth voluntary service organizations to establish a volunteer registration system. Personnel engaged in volunteer service shall apply for registration to volunteer service organizations, and organizations engaged in volunteer service shall apply for registration to the municipal or district volunteer federation. Volunteer service organizations can recruit temporary volunteers according to the needs of volunteer service activities, and put them on record in the municipal or district volunteer federation. Article 11 Volunteers shall enjoy the following rights: (1) voluntarily joining or quitting voluntary service organizations; (two) to participate in the service activities carried out by voluntary service organizations; (3) Necessary conditions and necessary guarantees for obtaining voluntary service; (four) to ask the voluntary service organizations to help solve the practical difficulties encountered in the process of voluntary service; (five) suggestions, criticisms and supervision of voluntary service organizations; (6) Give priority to voluntary service when there are difficulties. Article 12 Volunteers shall perform the following obligations: (1) Abide by the articles of association of voluntary service organizations; (two) shall not collect remuneration from the service object or borrow money or things, and seek other benefits; (3) Not accepting donations from customers during the service period; (4) Keeping the privacy of customers; (five) shall not organize or participate in activities that violate the principle of voluntary service in the name of volunteers or voluntary service organizations. Thirteenth volunteers should carry out voluntary service and complete the service work under the arrangement of voluntary service organizations. Without the consent of voluntary service organizations, no unit or individual may carry out activities in the name of voluntary service organizations. Fourteenth voluntary service organizations should protect the legitimate rights and interests of volunteers during their service. Voluntary service organizations may, according to the needs of voluntary service, handle corresponding personal insurance for volunteers participating in voluntary service activities. Fifteenth volunteers should wear uniform volunteer service signs during their volunteer service. Measures for the administration of the use of volunteer service certificates and signs shall be uniformly stipulated by the Municipal Federation of Volunteer Workers. Chapter III Voluntary Service Organizations Article 16 The articles of association of a voluntary service organization shall include the registration of volunteers and group volunteers, the rights and obligations of volunteers, the emergence, organization and responsibility of voluntary service organizations, etc. Article 17 The duties of voluntary service organizations are: (1) to establish rules and regulations for voluntary service activities; (two) to establish and improve the archives system of volunteers and voluntary service activities; (3) Recruitment, training, guidance, management, supervision and commendation of volunteers; (4) Organizing voluntary service activities; (5) Publicity and exchange of voluntary service; (six) to provide the necessary protection for voluntary service. Eighteenth voluntary service organizations to carry out voluntary service activities, shall comply with the provisions of laws, regulations and articles of association of voluntary service organizations, and shall not engage in profit-making activities. Article 19 Voluntary service organizations may recruit volunteers by themselves or jointly. When recruiting, the volunteer service plan shall be announced in an appropriate way. Volunteer service organizations shall carry out volunteer service activities in accordance with the volunteer service plan. The volunteer service plan shall include the recruitment, training, use, assessment and service items of volunteers. Twentieth group volunteers to carry out volunteer service activities in the form of collective, it should be the volunteer service plan and volunteer service activities to the volunteer federation for the record. Twenty-first voluntary service organizations' funds include government support, social donations and subsidies, and other legitimate income, which are earmarked for special purposes. The collection, use and management of funds for voluntary service organizations shall comply with relevant regulations and accept the supervision of relevant government departments, donors, sponsors and volunteers. The raising and use of funds shall be announced to the public regularly. Chapter IV Voluntary Service Article 22 Individuals or units that need voluntary service may apply to voluntary service organizations. Article 23 To apply for voluntary service, the following materials shall be submitted: (1) A written application for voluntary service; (2) the identity certificate or unit certificate of the applicant; (three) the description of the service project and other relevant materials. If the applicant is a person without or with limited capacity for civil conduct, his guardian or legal representative shall apply for it on his behalf. Twenty-fourth voluntary service organizations, after accepting the application for service, can provide voluntary services within their capabilities according to the application and actual situation of the clients; Can not provide volunteer service, it shall reply to the applicant. When providing voluntary service, there should be more than two volunteers. Unless there are special requirements for service items. Twenty-fifth voluntary service organizations can sign a service agreement with the client, clarifying the rights and obligations of both parties and the methods to resolve disputes. In the process of service, voluntary service organizations and service objects shall fulfill the service agreement; If one party requests to change or terminate the agreement, it can be handled by both parties through consultation. Twenty-sixth service objects should be based on the service agreement, according to the service content and characteristics, to ensure that volunteers to carry out services in a safe environment. The entrusting party may, according to its own actual situation, provide necessary special training and corresponding material guarantee for volunteers participating in the service. Chapter V Commendation and Encouragement Article 27 Voluntary service organizations shall establish a volunteer assessment and commendation system. Voluntary service organizations can establish specific systems such as service time accumulation and performance evaluation as the basis for assessing and commending volunteers. Twenty-eighth voluntary service organizations shall issue honorary certificates to volunteers who meet the recognition conditions. Twenty-ninth encourage relevant units to give priority to recruiting and enrolling volunteers under the same conditions when recruiting and enrolling students. Specific incentives can be formulated separately by the relevant government departments or enrollment and enrollment units. Thirtieth news media should publicize voluntary service for free. After obtaining their consent, the news media can publicize volunteers or voluntary service organizations with outstanding service performance. Chapter VI Legal Liability Article 31 If a volunteer causes damage to the client or a third party in the course of service according to the arrangement of a voluntary service organization, the relevant voluntary service organization shall bear civil liability according to law. Unless otherwise agreed between the voluntary service organization and the service object. After assuming civil liability, voluntary service organizations have the right to recover part or all of the compensation fees from volunteers who have intentionally or grossly neglected. Thirty-second clients who cause damage to volunteers in the process of accepting volunteer service shall bear civil liability according to law. Voluntary service organizations shall support injured volunteers to recover losses from relevant clients and provide necessary help. Thirty-third voluntary service organizations use their names, logos and related materials to carry out illegal activities, and the voluntary service organizations have the right to ask the relevant authorities to investigate their corresponding legal responsibilities according to law. Thirty-fourth voluntary service organization staff in the work of favoritism, misappropriation of public funds and other illegal acts, should bear the corresponding legal responsibility according to law; If the case constitutes a crime, the judicial organ shall investigate its criminal responsibility according to law. Chapter VII Supplementary Provisions Article 35 These Regulations shall come into force as of July 6, 2005. Thirty-sixth with the consent of the Municipal Volunteers Federation, it shall be implemented with reference to the provisions of these regulations.
