The employment agreement must be signed once a year.
After the public welfare post personnel are employed, according to the actual needs of the post, the employer and the employed personnel shall sign a full-time employment or part-time employment agreement. The employment agreement for public welfare posts is signed once a year, and will be terminated naturally upon expiration. For those who are less than five years away from the statutory retirement age, they may be extended to the retirement age, and the employment period of the remaining personnel shall be determined by the localities themselves. The provisions of People's Republic of China (PRC) Labor Contract Law on non-fixed-term labor contracts and payment of economic compensation are not applicable to the employment agreement for public welfare posts.
Personnel social security subsidies are generally three years.
Since 2009, the unified development of public welfare posts in the province belongs to local unified management, and all localities and employers shall pay the labor remuneration of public welfare posts in full and on time. The labor remuneration of public welfare posts is generally not lower than the local minimum wage standard (part-time public welfare posts are calculated according to the hourly minimum wage standard).
The employing unit shall apply for post subsidies and social insurance subsidies in accordance with relevant regulations. The term of social insurance subsidies shall not exceed three years in principle except for those who are less than five years away from the statutory retirement age. After the public welfare post personnel have an industrial accident, the relevant expenses incurred in enjoying the treatment shall be borne by the local finance of the employer.
Implement "full" and "difference" subsidies.
According to the number of public welfare jobs developed by the original province and the local minimum wage in 2007, the provincial finance arranges subsidy funds for all localities every year, and takes this as the subsidy base. Since 2009, the labor remuneration of public welfare posts has been paid in the form of full payment and proportional post subsidies.
