The scope of Huanggang Dabie Mountain World Geopark (hereinafter referred to as Geopark) shall be subject to the plan approved and issued by Huanggang Municipal People's Government. The boundary of geological park is determined by the method of broken line delineation according to the change of actual terrain, and the specific scope is subject to the planning red line map. Article 3 The term "geological relics" as mentioned in these Measures refers to the precious and non-renewable geological natural heritage formed, developed and left behind by various internal and external dynamic geological processes in the long geological history of the earth's evolution.
The term "natural and cultural heritage" as mentioned in these Measures refers to the national key protected animals and plants, natural landscapes, cultural landscapes and intangible cultural heritage except geological relics in geological parks. Article 4 Geological relics, animals and plants under special state protection, and natural landscapes in geological parks belong to the state, and the state ownership of surface or underground geological relics does not change due to different land ownership or use rights.
No organization or individual may occupy or destroy geological relics, natural and cultural heritage. Article 5 People's governments at all levels shall follow the principles of scientific planning, unified management, strict protection, rational development and sustainable utilization, strengthen the management of geological parks and promote their protection.
Encourage the rational development and utilization of geological relics, natural and cultural heritage of geological parks according to law. Article 6 The people's governments at the city and county levels shall incorporate the management and protection of geological parks into the national economic and social development plan, and the required funds shall be included in the fiscal budget, which will increase year by year with the economic and social development and work needs.
The people's government at the county level shall extract a certain proportion of funds from the ticket income of scenic spots in the geological park for the protection of geological relics, the protection of natural and cultural heritage, the maintenance of identification system, geological research, popular science propaganda and other work funds.
People's governments at all levels and geological park management institutions can raise special funds for the protection of geological parks through government investment, donations from all walks of life and donations from international organizations. Seventh all units and individuals have the obligation to protect the geological relics, natural and cultural heritage of geological parks, and have the right to discourage and report violations of these measures. Chapter II Management of Geoparks Article 8 The departments in charge of natural resources and planning of the municipal and county people's governments are responsible for the protection, planning, utilization and management of geoparks.
The management office of Dabie Mountain National Geopark in Huanggang, Hubei Province, which belongs to the municipal administrative department of natural resources and planning, is the management institution of the Geopark, and performs the management duties of the Geopark in accordance with laws, regulations and rules.
The people's government at the county level where the geopark is located shall set up a geopark management institution to be responsible for the daily management of the park. Article 9 The protection and management of geological parks by geological park management institutions:
(a) to implement the laws, regulations and rules on the protection of geological parks and geological relics;
(two) the preparation of geological park development planning and geological relics protection planning, and the formulation of geological park publicity, protection, construction and development management measures;
(three) to organize the declaration of geological relics protection projects and carry out geological relics protection;
(four) the construction of geological tourist attractions, the establishment of geological heritage database, the development and utilization of geological heritage resources;
(five) to carry out scientific research, scientific investigation, scientific education and scientific and technological exchanges in the geological park, and to establish a geological popular science education base;
(six) to coordinate the working relationship between related parks and museums in geological parks and guide the protection, construction, development and utilization of the areas under their jurisdiction;
(seven) to coordinate and assist the relevant departments to do a good job in the management and protection of the natural and cultural heritage of geological parks, and to assist the relevant departments to carry out administrative law enforcement work on illegal acts such as destroying natural and cultural heritage resources.
(eight) other duties as prescribed by laws and regulations. Article 10 The departments of natural resources and planning, ecological environment, housing and urban and rural construction, forestry, culture and tourism, water conservancy and lakes, public security, transportation, agriculture and rural areas of the people's governments of cities and counties shall, in accordance with their statutory duties, strengthen the management and protection of geological relics and natural and cultural heritage in geological parks.
The Township People's Government and the village (neighborhood) committees where the geopark is located shall assist the competent departments, management institutions and relevant departments of the geopark to carry out the protection, utilization and management of the geopark within their respective jurisdictions.
The village (neighborhood) committee where the geopark is located shall educate, guide and urge the village (neighborhood) people to adopt green production and lifestyle, and help protect the natural ecological resources in the geopark. Article 11 Geopark management agencies organize inspections, popular science research, investigation and exchange activities. When relevant departments implement administrative law enforcement and administrative inspection in Geoparks and scenic spots, scenic spot management agencies and relevant administrative departments shall actively support and cooperate and accept supervision and inspection.
In areas where geological parks overlap with nature reserves, scenic spots, forest parks and wetland parks, laws and regulations shall be strictly enforced.
