On the afternoon of May 1, the reporter contacted Ms. Zhao, a staff member of the public relations department of a company. After coordinating with the company's technical department and product department, Ms. Zhao answered the reporter's questions about the live broadcast platform.
Reporter: A large number of third-party strangers appeared in the live screen. They don't know that they are broadcasting live, and live broadcasting is not allowed. Is this suspected of infringing on the privacy of others?
Zhao Nvshi: As early as 2065438+June 2006, we published relevant specifications to users. When users are required to share and play their own surveillance images, they should abide by the relevant national laws and regulations and the announcement of relevant live broadcast specifications.
Reporter: It is up to these users who install cameras to decide whether to go to the monitoring screen, not to the photographer. Is this model inappropriate?
Zhao Nvshi: As a security product, it is obviously unrealistic and inappropriate for users to monitor the scenes, such as the most frequently used scenes in the family, the nanny behavior at home and the theft at home. We call on users in smart cameras to abide by relevant national laws and regulations, conventions on good manners and customs, and user agreements on live broadcast of the platform when sharing monitoring images, so as to maintain the civilization and order of the platform.
Reporter: Why are there live pictures of hotels, underwear shops, massage shops and other relatively private places? Will the live screen be re-examined in the live background?
Zhao Nvshi: Images of hotels, underwear shops and massage shops appearing on the platform are all shared on the Internet platform by hotel managers, underwear shop owners, massage shop owners and other users after purchasing smart cameras. According to the feedback we received, the main purpose of the owner's live broadcast is to prevent voyeurism and provide customers with the service level of employees. We have also been reviewing the monitoring pictures, pictures and comments shared by users according to the existing laws and regulations in China and the requirements of government departments. For violations of current national laws and regulations and other acts involving pornography, violence, violation of public order and good customs or other infringements, once found, the platform will delete relevant content, and conduct operations such as banning words, kicking out, hacking and permanently hacking against users who violate the rules to ensure a civilized and orderly platform environment.
Judging from the answer of the live broadcast platform, it is completely official, and the responsibility is unloaded on the grounds of' users decide for themselves'. In fact, in the eyes of professional lawyers, the person who uploaded the video (that is, the installer who agreed to share the monitoring screen to the live webcast) uploaded the live content to the network without the permission of the live broadcaster, which was suspected of infringing on the privacy rights of others; The live broadcast platform has the obligation to review the content played by users. If the live broadcast content infringes on the privacy rights of others, the live broadcast platform should also bear corresponding joint and several liabilities.
