The term "enterprise" as mentioned in these Measures refers to a legal person or non-legal person for-profit economic organization registered by the administrative department for industry and commerce according to law. Article 3 This Municipality shall establish a credit reporting institution system with enterprise credit information centers and market-oriented evaluation institutions established by the government as the main bodies, collect enterprise credit information, conduct enterprise credit information inquiry for the society, and the evaluation institutions shall carry out service activities such as enterprise credit evaluation. Article 4 The collection and disclosure of enterprise credit information shall safeguard the interests of the state and society, and shall not collect and disclose information that hinders public safety and social order.
The collection and disclosure of enterprise credit information shall safeguard the legitimate rights of enterprises and shall not damage their business secrets, competitive position and other legitimate interests. Article 5 Enterprises' credit investigation and information disclosure activities shall follow the principles of objectivity and fairness. Credit institutions shall not collect or disclose false information, and information providers shall not provide false information.
Enterprise credit evaluation activities should follow the laws of market economy and carry out activities in accordance with the principles of independence, impartiality and prudence. Article 6 Credit institutions, information providers, users of enterprise credit information and their staff members shall keep confidential the enterprise credit information obtained in the process of collecting and using enterprise credit information, and shall not use the obtained enterprise credit information beyond the scope of use and job responsibilities stipulated in these Measures, except for information that can be disclosed according to law. Article 7 The government encourages enterprises to establish internal credit management system, strengthen internal credit management, and guard against their own risks and customer credit risks. Article 8 The relevant departments of the municipal government shall, together with credit reporting agencies and enterprises, form an enterprise credit reporting and evaluation supervision committee, which shall be responsible for the supervision and management of enterprise credit reporting and evaluation business.
The composition, responsibilities and rules of procedure of the enterprise credit investigation and evaluation supervision committee shall be formulated separately by the municipal government.
The government encourages evaluation agencies to set up trade organizations to conduct self-regulatory supervision. Chapter II Credit Information Agency Article 9 The municipal government shall set up the Shenzhen Enterprise Credit Information Center (hereinafter referred to as the Credit Center) to collect enterprise credit information in accordance with the provisions of these Measures and provide inquiry services to the society. Article 10 The establishment of an appraisal institution shall take the form of a limited liability company or a joint-stock limited liability company, and shall be approved and registered by the administrative department for industry and commerce according to law.
The establishment of an evaluation institution shall meet the following conditions:
(1) It meets the general requirements of a company as a legal person;
(two) professionals with the ability of file management, data processing and quantitative analysis that are suitable for the credit evaluation business;
(3) Having a strict information file management system, confidentiality measures and safety precautions. Eleventh evaluation institutions established according to law can engage in the following business:
(a) take the initiative or accept the entrustment to carry out enterprise credit investigation activities;
(2) Providing credit evaluation services for enterprises according to the collected enterprise credit information;
(3) Providing inquiry service for the collected enterprise credit information;
(four) to provide credit management consulting services for enterprises;
(five) other enterprises credit evaluation consulting services. Article 12 Credit information centers shall provide relevant credit information services to the society on the principle of compensation, but no fees shall be charged for inquiring publicly disclosed credit information through the Internet.
The specific charging scope of the credit center shall be stipulated separately by the municipal government, and the charging standard shall be reported to the competent price department for approval according to the regulations.
The fees charged by the assessment agencies shall be determined by the assessment agencies according to market principles. Chapter III Information Collection Article 13 The Credit Information Center collects the following credit information of enterprises in this Municipality:
(1) Enterprise credit information held by municipal government organs, judicial organs and institutions with administrative functions;
(2) Enterprise credit information obtained by financial institutions in this Municipality in financial activities;
(three) the enterprise credit information obtained by industry organizations, public utilities and intermediary organizations in this Municipality in carrying out service activities;
(4) Credit information of other enterprises authorized by the municipal government. Fourteenth assessment agencies can collect enterprise credit information in the following ways:
(1) Collecting enterprise credit information from the credit information center;
(2) Collecting enterprise credit information directly from the enterprise under credit investigation or the transaction object of the enterprise under credit investigation;
(3) Collecting enterprise credit information from relevant reports in the public media;
(4) Other ways permitted by laws and regulations.
The evaluation institution shall obtain the consent of the enterprise that does not disclose credit information according to law. Fifteenth government agencies and judicial organs have the obligation to provide enterprise credit information as stipulated in these Measures to the credit center, except for information involving state secrets. The specific information directory shall be formulated separately by the municipal government.
Financial institutions can provide enterprise credit information to the credit center, but they must provide information related to enterprises evading bank debts.
Information of other units or individuals obtained by any unit or individual in their own business activities shall not be provided to any third party without the consent of the parties concerned, except as otherwise provided by laws, regulations and these Measures.
