Your provincial labor dispute arbitration committee's request for instructions on whether the articles in the articles of association are in conflict with the national laws, regulations and policies of the Party (Liao Lao Cai Zi [1993] No.4) has been received, and we hereby reply as follows:
Agreed. Enterprises should formulate rules within the scope of national laws and regulations. Enterprises shall not take punitive measures such as dismissing their families in their own units because employees leave without authorization. The stipulation that enterprises implicate the families of employees who leave their jobs without authorization does not conform to the national labor management policy and cannot be used as the basis for labor arbitration. This practice of enterprises should be stopped and corrected.
However, considering that some employees leave their jobs without the consent of the enterprise, which causes losses to the enterprise, depending on the size of the losses caused to the enterprise, they are ordered to give certain economic compensation to the enterprise.
