Measures of Henan Province on Implementing the Law of People's Republic of China (PRC) on Promoting Small and Medium-sized Enterprises

Article 1 These Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Promotion of Small and Medium-sized Enterprises and combined with the actual situation of this province. Article 2 The people's governments at or above the county level shall incorporate the promotion of the development of small and medium-sized enterprises into the national economic and social development plan, determine the key industries and fields to be supported, and formulate corresponding policies and measures to create a good environment for promoting the development of small and medium-sized enterprises. Article 3 The work departments of small and medium-sized enterprises of the people's governments at or above the county level shall comprehensively coordinate, guide and serve the work of small and medium-sized enterprises within their respective administrative areas. Other relevant departments shall provide guidance and services for small and medium-sized enterprises within their respective functions and duties. Article 4 The Provincial Department of Small and Medium-sized Enterprises shall, jointly with the provincial statistical department, establish and improve the statistical index system of small and medium-sized enterprises, formulate the statistical system of small and medium-sized enterprises, accurately reflect the development and operation of small and medium-sized enterprises, and make it known to the public regularly. Article 5 People's governments at all levels shall incorporate the development of small and medium-sized enterprises into the target management of government work, establish a scientific evaluation system and assessment methods, and promote the sound and rapid development of small and medium-sized enterprises. Article 6 People's governments at all levels and their relevant departments shall support the establishment of small and medium-sized enterprises. The enterprise registration authority shall go through the registration procedures for the establishment of small and medium-sized enterprises in accordance with legal conditions and procedures, improve work efficiency and facilitate registration, and shall not set preconditions for enterprise registration other than laws and administrative regulations. Seventh people's governments at all levels and their relevant departments should strengthen the monitoring and analysis of the development trend of small and medium-sized enterprises, timely release relevant industrial policies, development plans and other information to the society, and provide entrepreneurial policy guidance and services. Article 8 The people's governments at or above the county level shall, according to the needs, arrange land for the construction of small and medium-sized enterprises in urban and rural construction planning, make use of the existing stock of construction land and idle factories, guide small and medium-sized enterprises to enter industrial parks, and provide production and business places for small and medium-sized enterprises.

Support and guide all kinds of social capital to invest in the construction of standard factories, lease or transfer them to small and medium-sized enterprises for use. Ninth people's governments at or above the county level and their relevant departments shall provide policy advice and services in industry and commerce, taxation, financing, personnel files, household registration management, children's enrollment, social security and other aspects. For small and medium-sized enterprise entrepreneurs, for small and medium-sized enterprise managers and employees to carry out vocational skills assessment and appraisal.

College graduates who go to small and medium-sized enterprises for employment and meet the requirements of professional title evaluation shall be directly accepted by the local personnel department or entrusted by a personnel agency. Article 10 The people's governments at or above the county level shall arrange special funds to support the development of small and medium-sized enterprises in the fiscal budget at the corresponding level, which will be used to promote the construction of service systems such as credit guarantee for small and medium-sized enterprises, subsidize interest for small and medium-sized enterprises and support key enterprises to set up research and development institutions. Eleventh financial institutions should adjust the credit structure, innovate credit methods, improve the credit system and increase the proportion of loans to small and medium-sized enterprises according to the national credit policy.

Support small and medium-sized enterprises to raise funds by issuing bonds, listing at home and abroad, equity financing, project financing and other ways permitted by laws and regulations.

Investment companies, property rights trading centers, financial leasing companies, auction houses and pawn shops should support the development of small and medium-sized enterprises and broaden their financing channels. Twelfth people's governments at or above the county level shall promote the construction of credit system for small and medium-sized enterprises, establish a database of credit files for small and medium-sized enterprises, and relevant departments shall provide basic credit information for small and medium-sized enterprises to the database. Thirteenth small and medium-sized enterprises work department of the people's government at or above the county level shall, jointly with relevant departments, promote and organize the establishment of a credit guarantee system for small and medium-sized enterprises, improve the credit evaluation and risk control system, and strengthen the supervision of credit guarantee institutions. Measures for supervision shall be formulated by the provincial people's government.

Encourage private capital and overseas capital investment to establish various forms of credit guarantee institutions for small and medium-sized enterprises. Fourteenth small and medium-sized enterprise credit guarantee institutions to carry out guarantee business, involving land, real estate, means of transport, equipment and other collateral registration and other movable property, equity, trademark exclusive right, patent pledge registration, the registration authority shall handle the relevant registration procedures according to law. Fifteenth credit guarantee institutions for small and medium-sized enterprises shall, within thirty days after registration, go to the work department of small and medium-sized enterprises at the same level for the record, and credit guarantee institutions established by government investment or equity participation shall also go to the financial department at the same level for the record. Article 16 The people's governments at or above the county level and their development and reform, science and technology, education and other departments shall promote the construction of public science and technology basic platforms, industry professional innovation platforms and regional innovation platforms, provide basic conditions and public services for scientific research and development and transformation of scientific and technological achievements, and enhance the independent innovation capability of small and medium-sized enterprises.

Encourage and support high-tech industrial development zones, economic and technological development zones, etc. Establish technological innovation bases for small and medium-sized enterprises and incubation bases for scientific and technological enterprises, support small and medium-sized enterprises to declare national patents, promote the transformation of scientific and technological achievements, and upgrade the technology and product grades of small and medium-sized enterprises. Seventeenth to encourage and support qualified small and medium-sized enterprises and universities, research institutes to establish or jointly establish technology centers, R&D centers and other enterprise R&D institutions, to improve the independent innovation ability of enterprises. Eighteenth people's governments at or above the county level and their relevant departments should strengthen the construction of public services such as information and logistics, guide small and medium-sized enterprises to cooperate with large enterprises at home and abroad, and promote the products of small and medium-sized enterprises to enter the industrial chain or procurement system of large enterprises at home and abroad.
