A first-class security qualification unit can undertake top secret, confidential and secret scientific research and production tasks; The two-level security qualification unit can undertake the tasks of confidentiality and secret scientific research and production;
Units with three-level confidentiality qualifications can undertake secret-level scientific research and production tasks.
Second, the State Secrecy Bureau, together with the State Administration of Science, Technology and Industry for National Defense and the Equipment Development Department of the Central Military Commission, undertakes the application and written examination of the first-class confidentiality qualification in accordance with the principle of administration according to law and convenience for the administrative counterpart. The service window is located in the State Bureau of Science, Technology and Industry for National Defense, and undertakes the application acceptance and written examination. The secrecy administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall, jointly with the administrative departments of science, technology and industry for national defense at the same level, * * * undertake the acceptance and written examination of applications for second-and third-level secrecy qualifications. The service window for accepting applications and written examinations shall be set with reference to the first-class confidentiality qualification acceptance institutions, and those that have been set in the confidentiality administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall not be adjusted.
Three. Application process for confidentiality qualification certification: 1. According to the military security qualification standards, a standardized security system should be established in the company, including the training, education and management of security personnel, the establishment and transformation of security priorities, the configuration of security computers, and the collection of security work files. 2. After the safety system has been running for a period of time, when the company thinks that it meets the safety standards, it should fill in the Safety Qualification Application Form and related materials according to the requirements of the standards, and send them to relevant departments for written review. The first-level units directly apply to the State Security Bureau, and the second-and third-level units apply to the provinces, autonomous prefectures and municipalities directly under the Central Government.
Those who pass the written test will be tested on the spot. If the written test fails, the examination shall be terminated and a decision shall be made not to hire.
Four, for the units that have passed the written examination, the secrecy administrative department shall, in conjunction with the examination and approval department, form an on-site examination team to conduct on-site examination within 25 working days. The person in charge of the on-site evaluation team of the first-class confidential qualification applicants shall be determined by the State Secrecy Bureau in conjunction with the State Administration of Science, Technology and Industry for National Defense and the Equipment Development Department of the Central Military Commission; The person in charge of the on-site evaluation team of the applicants with Grade II and III confidentiality qualification shall be determined by the secrecy administrative department of the province, autonomous region and municipality directly under the Central Government in conjunction with the administrative department of science, technology and industry for national defense at the same level. The staff of the on-site evaluation team are randomly selected from the expert database of confidential qualification examination, and the number is 5 to 8.
V. The applicant will be notified in writing five working days in advance of the on-site review, and the on-site review procedures are as follows:
(a) to listen to the report of the applicant and the explanation of relevant matters;
(two) review the relevant written materials;
(three) talk with the main person in charge and the relevant person in charge and relevant personnel to understand the situation;
(4) Organizing secret-related personnel to conduct secret knowledge tests;
(five) on-site inspection, and make inspection records;
(six) to evaluate the on-site evaluation opinions, and to study or vote to form the evaluation opinions and scoring results. Fill in the "On-site Review Opinions on Confidentiality Qualification of Weapons and Equipment Research and Production Units" (hereinafter referred to as the review opinions);
(seven) the head of the on-site evaluation team informed the applicant of the evaluation opinions and conclusions, and put forward rectification requirements for the existing problems;
(eight) the head of the on-site review team and the legal representative or principal responsible person of the applicant shall sign the review opinions.
Six, the on-site evaluation results are divided into "pass", "fail" or "suspend". According to the confidentiality qualification standards and grading standards of the corresponding level, the full score is 500 points, reaching 450 points or above, passing in the on-site review, and reaching 450 points or below, failing in the on-site review. In the review, it is found that the applicant does not meet the basic requirements listed in the scoring standard, and the review shall be suspended. Units that have not passed the on-site review will not accept the re-application within 6 months. If the on-site review is suspended, the on-site review shall not be conducted again within 3 months.
Seven, approved by the first-class security qualification units, by the State Secrecy Bureau in conjunction with the State Bureau of defense science and technology industry, the Central Military Commission Equipment Development Department issued a certificate, and included in the record regularly published. Approved second-class and third-class secrecy qualification units shall be awarded certificates by the secrecy administrative departments of provinces, autonomous regions and municipalities directly under the Central Government in conjunction with the administrative departments of science, technology and industry for national defense at the same level, and the relevant examination materials shall be submitted to the State Secrecy Bureau, the State Bureau of Science, Technology and Industry for National Defense and the Equipment Development Department of the Central Military Commission for the record, included in the list and published regularly.
Eight,
The confidentiality qualification certificate of the scientific research and production unit of weapons and equipment includes the following contents:
(a) the name of the unit;
(2) Legal representative;
(3) Registered address;
(4) certificate number;
(5) Qualification grade;
(6) Issuing authority;
(7) Validity period and date of issuance.
The confidentiality qualification certificates of scientific research and production units of weapons and equipment are divided into originals and duplicates, which have the same legal effect. The style of the certificate shall be uniformly formulated by the State Secrecy Bureau in conjunction with the State Administration of Science, Technology and Industry for National Defense and the Equipment Development Department of the Central Military Commission. The confidentiality qualification certificate is valid for 5 years. Upon the expiration of the validity period, units that need to continue to undertake the scientific research and production tasks of classified weapons and equipment shall resubmit the application materials in the prescribed format 30 working days in advance.
Conditions to be met
(a) a legal person established in People's Republic of China (PRC) for more than 3 years according to law, with no criminal record;
(2) Undertaking or intending to undertake scientific research and production of weapons and equipment, and the products involve state secrets;
(3) Foreign investors and their concerted actions have no overseas (including Hong Kong, Macao and Taiwan) holding or direct investment, and the proportion of indirect investment ultimately does not exceed 20%;
(4) The legal representative, principal responsible person, actual controller, directors (supervisors), senior managers and personnel who undertake or intend to undertake the scientific research and production tasks of classified weapons and equipment have China nationality, have no permanent residence or long-term residence permit abroad, and have no marriage relationship with overseas personnel (including Hong Kong, Macao and Taiwan);
(5) Having a fixed place for scientific research, production and office, and having the ability to undertake scientific research and production tasks of classified weapons and equipment;
(six) the confidentiality system is sound, and there are specialized agencies or personnel responsible for the confidentiality work. The protection of places, facilities and equipment conforms to the national secrecy laws and standards;
(7) 1 year without leakage;
(eight) other conditions stipulated by laws, administrative regulations and the state secrecy administrative department.
