In order to promote the construction of public legal services in the city, Party A, Party B and Party C, through equal, voluntary and friendly negotiation, reached the following agreement in accordance with the requirements of the Work Plan for Developing a Legal Adviser in a Community (Village) issued by the Provincial Department of Justice and the Provincial Lawyers Association, and in accordance with the People's Republic of China (PRC) Lawyers Law, the People's Republic of China (PRC) Contract Law and other relevant laws and regulations.
I. Employment of legal counsel
Party B employs a lawyer appointed by Party A and designated by Party C as a community (village) legal adviser for a period of:

The community (village) legal adviser shall perform his duties in accordance with this contract.
Second, the scope and mode of service
(1) service scope
The service scope of community (village) legal adviser is as follows:
1. Develop a legal service plan, including:
(1) Understand the legal requirements of Party B;
(2) Formulate specific legal service plans.
2. Assist Party B in community (village) autonomous management, including:
(1) Assist Party B to draft, review and modify the articles of association of community (village) autonomous organizations, village rules and regulations;
(2) Providing legal advice and assistance to Party B or the general election of industry committees and neighborhood committees within the jurisdiction of Party B;
(3) Providing legal advice for Party B's major economic, people's livelihood and social management decisions;
(4) At the request of Party B, assist Party B in drafting, reviewing and amending civil and commercial economic contracts, and accept the entrustment to participate in non-litigation activities and litigation activities such as project negotiation (Party C may give preferential treatment to the legal service fees after negotiation).
(5) Assist Party B in handling cases of letters and visits related to law, guide the parties to express their demands rationally according to law, and solve contradictions and disputes according to law;
(6) Assist Party B to handle major sensitive and mass cases (incidents) within its jurisdiction in a timely and safe manner;
3. Provide legal aid to people within the jurisdiction of Party B, including:
(1) Answer people's legal advice;
(2) Help people review civil and commercial economic contracts, and accept entrustment to participate in non-litigation activities and litigation activities (this service needs to collect legal service fees through negotiation and handle entrusted agency procedures according to law, and Party C will give preferential fees as appropriate);
(3) Assist the needy people to apply for legal aid, and be appointed by the legal aid agency where Party B is located to provide legal aid to eligible people within the jurisdiction of Party B;
(4) Provide necessary legal assistance to released prisoners and community corrections personnel within the jurisdiction of Party B. ..
4. Publicity, including:
(1) Hold lectures on law popularization, popularize daily legal knowledge and enhance legal awareness to grassroots cadres and masses through "telling cases" and "telling things around the masses";
(2) To publicize the legal knowledge related to land requisition and demolition, land ownership, marriage and family, schooling and medical care, social security, environmental protection, etc. to the people within the jurisdiction of Party B;
(3) To provide legal publicity services for enterprises in need within the jurisdiction of Party B, and promote employment and entrepreneurship according to law (this service shall be entrusted separately according to law, and legal service fees shall be charged through negotiation, and Party C may give preferential fees as appropriate).
5. Participate in people's mediation, including:
(1) Actively cooperate with Party B's people's mediation organization, participate in conflict investigation and mediation, help resolve major and complex contradictions and disputes, and guide the parties to solve problems within the legal framework;
(2) Assist Party B to do professional and industrial mediation work, and improve the quality and efficiency of mediation;
(3) Assist Party B to strengthen the construction of people's mediation organizations, provide legal professional knowledge training for Party B's people's mediators, and improve their working level and legal literacy;
(2) Service methods and requirements
Community (village) legal advisers provide services in the following ways and requirements:
1. Provide warm, civilized and standardized legal consulting services to Party B on site regularly or irregularly by written, oral, telephone, email and WeChat.
2. Provide no less than 8 hours of legal consulting services to Party B's site every quarter. The specific service mode, service time and service place shall be announced by both parties through consultation. ..
3. Provide Party B with at least 2 lectures on law popularization training every year. The lecture should have an outline of the lecture notes and be reported to the county (city) District Bureau of Justice for the record. Lecture time is not included in the 8-hour on-site service.
4. For matters that may affect social stability or involve the vital interests of Party B and the people in the area under Party B's jurisdiction, legal opinions shall be presented in time or by telephone, and reported to the county (city) District Bureau of Justice.
5. Fill in the work log and work account as required.
Three, the community (village) legal adviser subsidies
Actively strive to implement the government's policy of purchasing legal services and give subsidies to community (village) legal consultants.
Four. Rights and obligations of all parties
(I) Rights and obligations of Party A
1. Organize and promote the work of "one community (village) and one legal adviser" in this region;
2. Select the person who serves as the alternative legal adviser;
3 organizations to carry out community (village) legal adviser work inspection, supervision and evaluation.
(II) Rights and obligations of Party B
1. Party B shall actively create conditions for Party C and community (village) legal counsel, help enterprises and residents in the community (village) to know and understand Party C and community (village) legal counsel, and be familiar with the contents and methods of legal services provided by Party C;
2. Party B shall provide offices, tables and chairs and other office equipment and other work facilities for the activities of Party C and community (village) legal advisers;
3 to assist the community (village) legal adviser to carry out information disclosure work;
4. Actively cooperate with and assist community (village) legal advisers to collect information on legal issues and the legal service needs of the masses;
5. Assist community (village) legal advisers to participate in people's mediation and carry out legal publicity;
6. Designate a special person to contact Party C and the community (village) legal adviser.
(III) Rights and obligations of Party C
1. Party C and its lawyers employed as community (village) legal advisers shall abide by laws, professional ethics, practice discipline and industry norms;
2. Party C and its lawyers employed as community (village) legal advisers shall be diligent and conscientious, and provide services to Party B within the scope agreed in this contract;
3. Party C shall supervise and guide the lawyers hired by the firm to serve as community (village) legal advisers, and carry out legal consultation, legal publicity, people's mediation and legal aid;
4. Party C shall provide work support and guarantee for the lawyers hired by the firm as community (village) legal advisers;
5. If the lawyer appointed by Party C as the community (village) legal adviser fails to provide legal consulting services for Party B as agreed in this contract, he shall promptly negotiate with Party B to appoint another lawyer and report to the county (city) District Bureau of Justice for the record;
6. Party C and the lawyers employed as community (village) legal advisers will keep the information, documents and information provided by Party B and the masses, as well as relevant drawings, conversation record, recordings, etc. strictly confidential, and shall not disclose them unless required by law or agreed by Party B and the masses.
Verb (abbreviation for verb) disclosure and advance notice
In order to enable lawyers as legal advisers to effectively provide legal services, Party B shall make a detailed and true introduction to Party C or the community (village) legal advisers designated by Party C, and provide copies or photocopies of relevant documents and materials. When it is necessary for legal counsel to attend relevant meetings, study contracts or participate in negotiations, the employer shall, in addition to submitting necessary materials, notify legal counsel one week in advance so as to make overall arrangements for work and necessary preparation time.
Settlement of intransitive verb disputes
Disputes arising from the performance of this contract shall be submitted to the county (city) District Bureau of Justice for mediation and settlement.
Seven. Validity of contract and others
1. This contract shall come into effect as of the date when the legal representatives (responsible persons) of Party A, Party B and Party C or their authorized representatives sign and affix their official seals.
2. The original of this contract is in quadruplicate, one for Party A, Party B and Party C respectively, and one for filing by the Municipal Bureau of Justice, all of which have the same legal effect.
