Vocational guidance measures

Article 1 These Measures are formulated in accordance with the relevant provisions of the Labor Law of People's Republic of China (PRC) in order to promote the employment of laborers, standardize and promote the job introduction. Article 2 The main task of vocational guidance is to provide consultation and services for workers and employers, and to promote their two-way choice. Article 3 Vocational guidance must be conducted in accordance with the law and follow the principles of fairness and voluntariness. Article 4 Vocational guidance can take various forms such as interview, collective discussion, report meeting and teaching exchange. Article 5 An employment agency shall carry out vocational guidance and provide full-time (part-time) vocational guidance personnel to provide guidance, consultation and services for workers and employers.

Employment training institutions should set up vocational guidance courses, equipped with full-time (part-time) teachers, and provide vocational guidance to workers who participate in employment and retraining. Article 6 Vocational guidance shall include the following contents:

(a) to investigate and analyze the changing trend of social occupation and the supply and demand situation of the labor market;

(two) to carry out a survey on the personal quality and characteristics of workers and evaluate their professional ability;

(three) to help workers understand the occupation situation, master the job-seeking methods, determine the job-seeking direction, and enhance the ability to choose a job;

(four) to put forward training suggestions to workers, and to be responsible for recommending them to employment training institutions;

(five) to provide special vocational guidance services for special groups such as women, the disabled, ethnic minorities and soldiers discharged from active service;

(six) to guide the employer to choose the recruitment method and determine the employment conditions and standards;

(seven) to provide consulting services for the opening, production and operation of individual workers and private enterprises;

(eight) to provide guidance on the training direction, training scale and professional setting of employment training institutions;

(nine) to provide advice and services for students' employment guidance. Article 7 Vocational guidance personnel shall meet the following conditions:

(a) a strong sense of professionalism, responsibility, love of career guidance;

(two) familiar with the relevant laws and policies of labor and employment, grasp the supply and demand information of the labor market, and understand the occupational classification and occupational characteristics;

(3) Having knowledge of psychology, pedagogy, sociology and other disciplines related to vocational guidance;

(four) working in the labor department for more than two years, with a college education or above;

(five) through the corresponding business qualification training and examination, holding the "occupation guidance qualification certificate" issued by the labor department. Article 8 Responsibilities of vocational guidance personnel:

(a) to publicize the laws, regulations and policies of the state on employment;

(two) to provide consulting services for workers and employers, and to coordinate the relationship between supply and demand of labor;

(three) to guide workers to determine labor relations according to law and safeguard their legitimate rights and interests;

(4) Organizing employers to carry out various forms of communication with job-seeking workers;

(five) responsible for contact with the job introduction and employment training. Article 9 Labor and employment service institutions at all levels shall provide corresponding facilities and conditions for vocational guidance, promote the development of vocational guidance and strengthen the publicity of vocational guidance. Article 10 These Measures shall apply to the employment service institutions affiliated to the Ministry of Labor. Employment service agencies in non-labor departments shall carry out vocational guidance with reference to these measures. Article 11 The labor departments of all provinces, autonomous regions and municipalities directly under the Central Government may formulate detailed rules for implementation according to these Measures and report them to the Ministry of Labor for the record.
