When will the announcement of winning the bid be released?

First, a few days after the bid opening, the bid winning result will be announced.

1. After the winning bidder wins the bid, the tenderee shall issue a letter of acceptance to the winning bidder. For projects that must be subject to tender according to law, the tenderer shall submit a written report on the bidding situation to the relevant departments within 15 days from the date of determining the winning bidder.

2. The tenderer and the winning bidder shall sign the contract within 30 days after the bid-winning notice is issued, and conclude the contract according to the tender documents and the bid documents of the winning bidder.

3. Legal basis: Bidding Law of People's Republic of China (PRC).

Article 46 A tenderer and a winning bidder shall, within 30 days from the date of issuance of the bid-winning notice, conclude a written contract in accordance with the tender documents and the bid documents of the winning bidder. The tenderer and the winning bidder shall not conclude other agreements that deviate from the substantive contents of the contract.

If the tender documents require the winning bidder to submit the performance bond, the winning bidder shall submit it.

Forty-seventh projects that must be subject to tender according to law, the tenderer shall submit a written report on the bidding situation to the relevant administrative supervision departments within 15 days from the date of determining the winning bidder.

Second, after winning the bid for a construction project, can the winning bidder give up?

1, the winning bidder cannot abandon the bid.

2, in general, can be regarded as the winning bidder to give up the bid are:

1) Failing to sign a contract with the tenderer without justifiable reasons.

2) When signing the contract, maliciously put forward additional conditions to the tenderer.

3) When signing a contract, maliciously request to change the substantive content of the contract.

4) Refuse to submit the performance bond according to the requirements of the tender documents.

3. According to the relevant provisions of the Bidding Law and the Regulations for the Implementation of the Bidding Law, after winning the bid for a construction project, the winning bidder cannot abandon the bid, otherwise it will bear corresponding legal responsibilities.

At the same time, according to the relevant provisions of the above-mentioned laws, if the winning bidder abandons the bid, the tenderer may not return the bid bond. If the actual loss of the tenderer exceeds the bid bond, the tenderer may require the winning bidder to make up for it. If the bid bond is not paid, the winning bidder shall compensate the tenderer for the actual losses.

Although the law stipulates that the winning bidder cannot abandon the bid, it is not necessary for the winning bidder to sign a construction project contract with the tenderer in all cases after winning the bid. If the winning bidder abandons the bid for justified reasons or force majeure factors and cannot sign a contract with the tenderer, it does not need to bear legal responsibility. If the winning bidder abandons the bid due to major changes in national policies, natural disasters such as floods, social unrest, wars and other factors, the winning bidder may not be liable for compensation.
