Pacific Debit Card Charter of Bank of Communications

Article 1 In order to meet the consumption and payment needs of residents and units, better provide financial services to all sectors of society, and standardize the rights and obligations of all card issuers and cardholders of Bank of Communications, these Articles of Association are formulated in accordance with the Measures for the Administration of Bank Card Business and relevant regulations.

Article 2 Pacific Debit Card (hereinafter referred to as Pacific Card) is a financial payment tool (including co-branded card/ID card and photo card) issued by Bank of Communications with the logo of "UnionPay" and settled in RMB. It can be used in self-service devices such as card issuers' business outlets, telephone banking, online banking and multimedia terminals, as well as special merchants and automatic teller machines (ATMs) with the logo of China UnionPay. The card has the functions of consumption, cash deposit and withdrawal, transfer (including card-to-card, card-to-deposit, card-to-agent transfer and various transfer payments, the same below) and settlement.

Article 3 Pacific cards are divided into corporate (business) cards and personal cards according to the issuing objects, among which personal cards are divided into main cards and supplementary cards.

Article 4 An individual with capacity for civil conduct and legitimate income may apply for a personal master card from the card issuing agency with his valid identity documents (including ID card, passport, military officer's card, soldier's card, police officer's card, pass, etc.). ) approved by the public security department. Personal master card applicants can apply for no more than three supplementary cards for spouses and immediate family members with civil capacity; All the funds used by the secondary card are transferred to the main card account, and the main card holder is responsible for repaying all the payables of the secondary card.

Article 5 Any enterprise legal person, organ, institution or social group legal person registered in China may apply for the unit (business) card to the card issuer with the information such as the account opening permit issued by the People's Bank of China and the valid identity certificate of the designated applicant. Applicants can apply for multiple business cards for their designated cardholders, and are responsible for repaying all the payables of the business cards.

Article 6 Units and individuals applying for Pacific Card must fill in the application form truthfully and agree to abide by the Articles of Association of Bank of Communications Pacific Debit Card (hereinafter referred to as the Articles of Association), the Bank of Communications Pacific Unit (Business) Debit Card Acquisition Contract or the Bank of Communications Pacific Personal Debit Card Acquisition Contract (hereinafter referred to as the Bill Acquisition Contract). The card issuer has the right to decide whether to approve the applicant's card application. The card issuer is responsible for keeping the personal data of the applicant confidential (unless otherwise stipulated by law).

Article 7 The Pacific Card shall be used only by the cardholder, and shall not be used on behalf of others, and shall not be rented or lent, otherwise the risks and losses arising therefrom shall be borne by the legitimate cardholder.

Article 8 The funds in a personal card account shall be deposited in the form of cash held by individuals, or transferred out in the form of personal salary, personal legal labor remuneration, investment return and other income. It is strictly forbidden to deposit the unit's money into the personal card account; The funds in the unit (business) card account shall be transferred from basic deposit account to deposit, and cash shall not be accessed or the sales proceeds shall be deposited in the unit (business) card account.

Article 9 Units and individuals applying for Pacific Card must open a reserve account with the card issuing institution. The initial deposit amount is unlimited and can be renewed at any time. The card issuer shall calculate and pay interest according to the deposit interest rate stipulated by the People's Bank of China, and withhold interest tax according to law. Pacific card account is not allowed to be overdrawn.

Article 10 The daily accumulative withdrawal amount of a personal card from an ATM shall not exceed 5,000 yuan; The unit (enterprise) card shall not be cashed out.

Article 11 Pacific cardholders shall pay an annual fee. ID photo cards and personalized photo cards need to be charged for business card printing. If the account is cancelled in advance, the annual fee will not be refunded.

Article 12 Cardholders shall abide by the relevant regulations of card issuers, China UnionPay and acquiring banks when spending, depositing and withdrawing cash and transferring money at home and abroad.

Article 13 Pacific cards are valid for a long time. If the cardholder stops using the Pacific Card midway, he must return the Pacific Card to the card issuer in time and go through the cancellation procedures. The cardholder shall go to the card issuer for account cancellation within 7 days after submitting a written application to the card issuer. When the account is cancelled, the funds in the unit (business) card account shall be transferred to its basic deposit account, and no cash shall be withdrawn.

Article 14 When receiving the Pacific Card, the cardholder shall immediately sign the same name as the application form in the signature column on the back of the Pacific Card, and use this signature when using the card. Where there is a password (including transaction password and inquiry password, the same below), the card issuer is regarded as the cardholder himself. All electronic information records generated by various transactions based on electronic information such as passwords are valid vouchers for transactions; If there is no password transaction, the transaction voucher signed and registered by the cardholder shall be the valid voucher for the transaction, and the card issuer has the right to record the income and expenses of the cardholder using the Pacific Card into its account.

Fifteenth card issuers should provide cardholders with inquiry, reconciliation, loss reporting, consultation, complaints and other services. Cardholders should check the contents of the account under the Pacific Card through telephone banking, online banking or multimedia inquiry machine in time every month. If there is any objection to the contents of the account, the cardholder shall ask for inquiry and correction within 60 days from the bookkeeping date of the transaction bank, and the card issuer will give a reply within 30 days. If the cardholder fails to raise any objection within 60 days from the bookkeeping date of the transaction bank, it shall be deemed that the cardholder has approved all transactions.

Article 16 The cardholder shall properly keep the Pacific Card and password, and all losses caused by improper storage and password disclosure shall be borne by the cardholder. Card issuers should set up a 24-hour loss reporting service telephone. If the cardholder loses his Pacific Card, he shall report it in writing or by telephone in time. After receiving the application for loss reporting, the card issuer shall handle the loss reporting procedures in time, which will take effect immediately after the completion of the loss reporting procedures. The cardholder shall bear the economic losses before the card issuer completes the loss reporting procedures.

The cardholder must pay the loss reporting fee when reporting the loss. If you need to reissue a new card after reporting the loss, you can go through the formalities of reissue the card with your valid identity certificate, and you need to pay the card fee for reissue the new card.

If the cardholder forgets or loses his password, he should submit a written application for password change to the card issuer with the Pacific Card and his valid ID card, and pay the handling fee for reprinting the password envelope.

Article 17 If the information such as mailing address, contact telephone number and mailing address filled in the application form of Pacific Card holder is changed, it shall immediately notify the card issuer in writing, otherwise the cardholder shall bear the delay or loss caused thereby.

Article 18 Pacific cardholders shall not refuse to pay the arrears on the grounds of disputes with merchants. The losses caused by the cardholder's transaction failure due to objective reasons such as communication network failure, and the risks and losses caused by the cardholder's online use of Pacific Card shall be borne by the cardholder himself, and the card issuer shall not bear any responsibility except the responsibility of the card issuer.

Article 19 Where a Pacific card is forged or altered, a forged or invalid Pacific card is used, or another Pacific card is used to defraud property, the card issuing institution shall promptly deal with it and transfer it to the judicial organ if necessary; If the cardholder violates the relevant provisions of the Articles of Association and causes losses to the card issuer, the card issuer has the right to apply for legal protection and investigate the legal responsibilities of the cardholder or related parties according to law.

Article 20 Cardholders shall abide by the Articles of Association and the collection contract. If the cardholder violates the articles of association and the relevant provisions of the card collection contract, the card issuer has the right to cancel the cardholder's qualification for using the card, and may authorize its subordinate institutions and special merchants to withdraw its Pacific card.

Article 21 The interest rate involved in the Articles of Association shall be adjusted according to the interest rate of the People's Bank of China. The formulation and adjustment of charging items and charging standards shall be implemented by the card issuer in accordance with the relevant provisions of the Interim Measures for the Administration of Service Prices of Commercial Banks, and published on the business outlets and websites of the card issuer 30 days before implementation, and shall take effect for all cardholders from the date of formal implementation.

Article 22 The Articles of Association shall be formulated and interpreted by Bank of Communications and implemented after being approved by China Banking Regulatory Commission.
