The Bonded Zone is located in Futian District, Shenzhen Special Economic Zone, starting from Huanggang Port in the east, reaching the east bank of Xinzhou River in the west, along the north bank of Shenzhen River in the south, and reaching Fuqiang Road in the north.
The scope of the living quarters in the bonded area (hereinafter referred to as the living quarters) shall be designated by the municipal government. Article 3 The bonded area mainly develops international trade, warehousing and high-tech industries, and correspondingly develops tertiary industries such as finance, business services, transportation, communication and information.
The bonded area may set up social intermediary service institutions according to law to provide services for enterprises in the bonded area. Article 4 Legal persons, other economic organizations and individuals in the bonded area must abide by the laws and regulations of People's Republic of China (PRC).
The legitimate rights and interests of investors in the bonded area are protected by law. Chapter II Management Organization and Duties Article 5 Shenzhen Futian Bonded Zone Management Bureau (hereinafter referred to as the Management Bureau) is an agency dispatched by the municipal government to manage the administrative affairs of the bonded zone on behalf of the municipal government. Article 6 The Administration shall exercise the following functions and powers:
(a) to formulate the development and construction planning and industrial policies of the bonded area, and organize their implementation after being approved by the municipal government;
(two) according to these regulations, formulate specific measures for the administration of the bonded area, which shall be promulgated and implemented after being approved by the municipal government;
(three) under the guidance of the municipal planning and land management department, responsible for the development of land planning, infrastructure and public utilities projects in bonded areas and living areas, and handling the relevant procedures for the assignment and transfer of land use rights;
(four) responsible for the management of public utilities such as water supply and power supply in the bonded area and living quarters;
(five) under the guidance of the municipal administrative department of construction, to manage the construction of bonded areas and living areas except special professional projects;
(six) to publish the investment-oriented catalogue of the bonded area and assist the municipal administrative department for industry and commerce in handling management matters such as enterprise registration;
(seven) responsible for the labor and personnel management of the bonded area, according to the need to draw up the annual recruitment plan of the bonded area, after the approval of the municipal personnel and labor administrative department, according to the plan for recruitment, approval and employment;
(eight) responsible for the management of municipal state-owned assets in the bonded area;
(nine) under the guidance of the municipal environmental protection administrative department, responsible for the environmental protection work in the bonded area and living area;
(ten) to handle the examination and approval procedures for Chinese personnel in the bonded area to go abroad for short-term business and go to Hong Kong, Macao and overseas for training;
(eleven) to coordinate the customs, border inspection, taxation, foreign exchange, public security, health and quarantine, animal and plant quarantine, commodity inspection and other administrative organs to carry out related business in the bonded area;
(twelve) other functions and powers granted by the municipal government. Article 7 The Administration shall be responsible to the municipal government and report its work. The municipal government may change or revoke inappropriate administrative decisions. Article 8 Major decisions made by administrative organs in exercising their functions and powers as stipulated in these Regulations shall be filed with the municipal government and relevant administrative departments. Article 9 With the approval of the municipal department in charge of organization establishment, the Administration Bureau may set up several working institutions according to the principle of streamlining and high efficiency.
The working organs of the Administration Bureau are responsible for the Administration Bureau and accept the business guidance of the relevant administrative departments of the municipal government. Article 10 Customs and frontier inspection organs shall set up representative offices in the bonded area to exercise their functions and powers according to law. Article 11 The health and quarantine, animal and plant quarantine and commodity inspection authorities may, with the consent of the Administration, set up offices or full-time personnel in the bonded area to inspect the areas outside the entry and exit passages according to law. Chapter III Establishment and Management of Enterprises Article 12 The municipal government encourages investors to set up high-tech and technologically advanced industrial enterprises in the bonded area and enjoy relevant preferential treatment. Article 13 Upon approval, investors may set up trading enterprises in the bonded area to engage in business activities. Article 14 An investor may set up a warehousing enterprise in the bonded area and conduct bonded warehousing business. Fifteenth domestic and foreign information institutions can set up branches or offices in the bonded area to carry out consulting business. Article 16 With the approval of the competent financial department, domestic and foreign financial and insurance institutions may set up business institutions or offices in the bonded area to carry out financial and insurance business and liaison and consulting services. Article 17 Investors may set up tertiary industry enterprises permitted by national laws and regulations such as transportation and communication in the bonded area. Article 18 An investor who establishes an enterprise or representative office in the bonded area shall go through the following procedures:
(1) The application of investors shall be approved and registered by the administrative department for industry and commerce according to the investment-oriented catalogue issued by the Administration Bureau;
(two) the establishment of enterprises engaged in specific businesses shall be registered with the administrative department for industry and commerce according to law after being approved by the Administration;
(3) After obtaining the business license, the investor shall go through the formalities of filing, registration and account opening with the customs, taxation, foreign exchange and other administrative organs. Article 19 The administrative department for industry and commerce shall, within 20 days from the date of receiving the application of investors to set up enterprises, make a decision on whether or not to approve the registration.
Where the approval of the Administration is required, the Administration shall make a decision on whether to approve it within ten days from the date of receiving the application from investors.
