Provisions of Jiangsu Province on the Administration of Service Prices

Chapter I General Provisions Article 1 In order to regulate the service price behavior, protect fair competition, safeguard the legitimate rights and interests of consumers and operators, and promote the development of the tertiary industry, these Provisions are formulated in accordance with the Price Law of People's Republic of China (PRC), the Regulations on Price Management and Supervision of Jiangsu Province and other relevant laws and regulations, and in combination with the actual situation of this province. Article 2 These Provisions shall apply to the service price behavior within the administrative region of this province. Article 3 Operators mentioned in these Provisions refer to legal persons, other organizations and individuals that provide paid services.

The term "service price" as mentioned in these Provisions refers to the fees charged by operators for providing paid services by using places, tools, facilities, technology, information, knowledge and labor services. Article 4 The competent price departments of local people's governments at or above the county level shall be responsible for the management, supervision and necessary adjustment of service prices within their respective administrative areas according to law.

Industry authorities and planning, industry and commerce, technical supervision, taxation, finance, auditing and other departments shall, according to their respective responsibilities, cooperate with the price authorities to manage service prices. Article 5 Service prices shall be based on production and operation costs and market supply and demand. Most service prices are regulated by the market, and a few important service prices are guided or priced by the government. Article 6 For service industries or service items with great differences in service quality, such as service level and service environment, price level management can be implemented, and pricing can be graded according to quality.

The registration system shall be implemented for the service items managed by government-guided prices and government pricing. Chapter II Price Behavior of Operators Article 7 Operators shall independently set or negotiate service prices other than government-guided prices and government-set prices according to law. When conducting price activities, it enjoys the following rights:

(a) in accordance with the relevant pricing methods for service items subject to government-guided prices, determine the specific prices within the prescribed range, and independently determine and adjust the prices of service items subject to market-regulated prices;

(two) according to the evaluation of the service price level, the implementation of high quality and good price, and to develop a reasonable quality difference, seasonal difference;

(three) according to the service agreement to implement preferential prices;

(four) to put forward suggestions for the adjustment of the service prices that are subject to government guidance and government pricing;

(five) to report and accuse violations of their legitimate rights and interests;

(6) Other rights granted by laws and regulations. Article 8 Business operators shall abide by the price laws, regulations, rules and policies, implement the government-guided prices and government-set prices formulated according to law, and obey the price intervention measures and emergency measures implemented by the government according to law. Article 9 An operator shall accept the management and supervision of service prices implemented by the competent pricing department according to law, accept the inspection by the competent pricing department, and provide the costs, prices, account books, vouchers and other relevant materials required for the management, supervision and inspection of service prices. Article 10 When providing services, business operators shall clearly mark the price, indicating the project name, price level, quantity, quality or standard of the services provided; For projects priced on time, the service time should also be indicated.

The quantity clearly marked indicates that the legal unit of measurement should be used, and the unit price that is easy for consumers to understand should be used for a few items that cannot be specified. Units of quantity that are difficult for consumers to identify shall not be used for price marking.

The service prices announced to the public by business operators through advertisements or other means shall conform to the provisions in the first and second paragraphs of this article.

Operators are not allowed to provide services that exceed the marked price or ask consumers to accept extra services that are not marked, and they are not allowed to charge any fees that are not marked.

Business operators shall issue legal bills to consumers, provide multiple services or provide multiple services at the same time, and shall issue a list of services in accordance with the provisions, and indicate the detailed prices. Eleventh operators should be honest, legal and fair price competition, and shall not have the following acts:

(1) Providing services at a price lower than the cost, crowding out competitors and monopolizing the market;

(2) colluding with other business operators to manipulate market prices and harming the interests of other business operators or consumers;

(3) Deceiving consumers to accept services by false or misleading price means;

(four) change the quality and quantity of service supplies or reduce the quality of service, and increase the service price in disguise;

(five) profiteering in violation of laws and regulations;

(six) other price violations prohibited by laws and regulations. Twelfth operators and industry organizations shall cooperate with the competent price departments and relevant industry departments to evaluate and verify the service price level. Operators shall charge fees according to the assessed price level. Article 13 Trade organizations may, under the guidance of the competent pricing department of the government, standardize the price behaviors of operators in the industry, coordinate price disputes among industry members, and strengthen self-discipline of industry prices. However, there must be no monopoly price and price manipulation.

Trade organizations should resist dumping at low prices, and can be entrusted by the government price department and the industry department to determine the average price of the service industry and release relevant price information. Chapter III Government Pricing Behavior Article 14 The government applies government-guided pricing or government pricing to the prices of important public utilities and public welfare services.

The government-guided price includes the benchmark price, floating range and pricing method of the specified service price.

Government pricing includes formulating and adjusting service prices and stipulating the pricing method of service prices.
