According to the regulations, the land use right can be renewed after it expires, but at present, the country has not yet introduced the specific implementation measures after the land expires.
Article 149 of the Property Law stipulates that residential construction land can be automatically renewed upon its expiration. Article 2 1 of the Urban Real Estate Management Law stipulates: "If the land use right transfer contract expires and the land user needs to continue to use it, he shall apply for renewal at the latest one year before the expiration, except for the need to recover the land according to public interests, which shall be approved. If it is renewed, it shall re-sign the land use right transfer contract and pay the land use right transfer fee in accordance with the regulations. "
After the house property right expires, the owner of the house can apply to the land management department where the house is located for renewal. After the application is approved, he will re-sign the paid land use contract and pay the land transfer fee according to the land price level at the time of signing the contract, so as to recover the land use right. This is also the default and effective solution to the expiration of property rights.
2. State compensation.
If the house fails to apply for renewal or the application for renewal is not approved after its expiration, the state may recover the land use right occupied by the house according to law, and the house on the land shall be compensated according to certain value and market value.
3. Compensation for demolition of dangerous buildings
If there are serious quality and safety problems after or before the expiration of property rights, or if they are defined as dangerous buildings, demolition procedures shall be taken according to procedures. The owner who is demolished will compensate the house and money according to the standard of demolition compensation.
From a legal point of view, the owner of the house can choose to apply for renewal after the property right expires. But judging from the current policy, your house does not belong to you forever. Therefore, before the expiration of the term of property rights, preparations should be made early, so as to avoid being caught off guard when the state demands to recover the land use right.
