Provisions of Dalian Municipality on the Administration of Talent Market (revised in 2003)

Article 1 In order to meet the needs of the development of the socialist market economy, strengthen the management of the talent market, protect the legitimate rights and interests of talents and employers, realize the orderly flow of talents according to law and the rational allocation of talent resources, and give full play to the role of all kinds of talents, these Provisions are formulated in accordance with the Regulations of Liaoning Province on the Management of Talent Market and relevant laws and regulations. Article 2 Units and individuals engaged in talent recruitment and intermediary services within the administrative area of Dalian must abide by these Provisions. Article 3 The term "talents" as mentioned in these Provisions refers to those who have technical secondary school education or have obtained professional and technical post qualifications above junior level; Intermediary service refers to the employment introduction, evaluation, planning, training, information consultation and other activities provided by approved talent service institutions for employers and talents. Fourth talent market service activities should follow the principles of openness, equality, competition and merit. Respect the autonomy of talents in choosing jobs and the autonomy of employers. Fifth city and county (city), district personnel bureau is the administrative department in charge of the talent market within their respective administrative areas, and the talent service (exchange) center established by them is specifically responsible for the management of the talent market.

Institutions at all levels, industrial and commercial administration, finance, price and other departments shall, in accordance with their respective responsibilities, assist the competent administrative department of talent market to do a good job in talent market management. Sixth organs, organizations, enterprises and institutions, other economic organizations and individuals that meet the prescribed conditions may set up talent service institutions upon approval. Article 7 To apply for the establishment of a talent service institution, the applicant shall meet the conditions stipulated in the Regulations of Liaoning Province on the Administration of Talent Market. Article 8 Units and individuals applying for the establishment of talent service institutions shall apply to the county (city) and district personnel administrative department with a written application and the supporting materials specified in Article 7; County (city) and district personnel administrative departments shall complete the audit within 15 days from the date of receiving the application and report to the Municipal Personnel Bureau; The Municipal Personnel Bureau shall give a written reply within 15 days from the date of receiving the audit materials. Those who pass the examination will be issued with a Talent Service License (hereinafter referred to as the License). Article 9 All units and individuals that have obtained a license shall apply to the administrative department for industry and commerce for obtaining a business license, except that the application for starting a business must be submitted to the administrative department for organization establishment for examination and approval. Tenth talent service institutions established before the implementation of these Provisions shall, within 4 months from the date of implementation of these Provisions, go through the formalities in accordance with these Provisions. Eleventh talent service institutions shall engage in intermediary services in accordance with the approved business scope, and collect service fees in accordance with the items and standards stipulated by the financial and price departments. Article 12 An employing unit may openly recruit talents to the public in the following ways:

(1) Entrusting a talent service agency for recruitment;

(2) Self-recruitment at the talent exchange meeting held by talent service institutions;

(three) the use of online talent market recruitment;

(four) through the news media broadcast recruitment notice. Thirteenth personnel service center affiliated to the personnel administrative department shall hold a talent exchange meeting with the approval of the local personnel administrative department; Other talent service institutions hold talent exchange meetings and report them to the local personnel administrative department for approval according to their affiliation.

The talent service organization that holds the talent exchange meeting shall examine the qualifications of the recruiting units participating in the exchange meeting and supervise the activities in the recruitment. Fourteenth individuals applying for jobs through the talent market should provide their identity cards, academic certificates and other valid documents as required. Fifteenth personnel files of floating personnel are managed by the talent service institutions approved by the municipal personnel administrative department. Sixteenth professional and technical personnel and management personnel in any of the following circumstances, shall not flow:

(a) engaged in work involving state secrets and within the prescribed confidentiality period;

(two) the case is under review by the statutory department and has not yet been closed;

(three) without the consent of the unit, the main professional and technical or management personnel who are undertaking key projects, key scientific research projects and key imported projects at or above the county level. Seventeenth talent flow disputes, according to the "Dalian personnel dispute handling Interim Provisions" implementation. Eighteenth in violation of the provisions of this management, the personnel administrative department shall be punished according to the following provisions:

(a) those who set up talent service institutions and engage in talent service activities without obtaining the License shall be ordered to stop their activities and their illegal income shall be confiscated;

(two) forge, alter, lend, lease or sell the license, confiscate the illegal income, and impose a fine of 5000 yuan to 654.38 yuan;

(3) If an established talent service institution continues to engage in talent service activities without applying for permission within the prescribed time limit, it shall be ordered to stop its activities and its illegal income shall be confiscated;

(four) without the approval of the talent exchange meeting, shall be ordered to stop activities, confiscate the illegal income;

(five) talent service institutions engaged in talent service activities beyond the prescribed business scope, given a warning, ordered to make corrections within a time limit, and confiscated illegal income. If no change is made within the time limit, the license may be revoked;

(six) the talent service agencies provide false information, give a warning and impose a fine of more than 2000 yuan 1000 yuan. If the circumstances are particularly serious, the license may be revoked;

(7) If the employer recruits talents by deception, it may be fined more than 2000 yuan 1000 yuan;

(8) If the employing unit or relevant organization keeps the personnel files of floating personnel on its behalf, it will be fined 1000 yuan;

(9) If the employer collects fees from the applicant, it shall be ordered to return them to the applicant, and a fine of 1 to 2 times the illegal income shall be imposed.
