What is a labor contract?

Labor contract refers to the civil service contract provided to the society in the form of labor, which is an agreement reached by all parties on the basis of equal consultation on a certain service and labor results. Generally speaking, independent economic entities are produced among units, citizens and citizens.

A labor contract is not a labor contract. From the perspective of law application, the adjustment of civil laws such as contract law and general principles of civil law is applicable to labor contracts, and the adjustment of labor law and relevant administrative regulations is applicable to labor contracts.

People's Republic of China (PRC) labor contract law

Article 59 A labor dispatch unit shall conclude a labor dispatch agreement with the unit that accepts labor dispatch.

The labor dispatch agreement shall stipulate the number of dispatched posts and personnel, the dispatch period, the amount and payment method of labor remuneration and social insurance premiums, and the responsibility for violating the agreement.

The employing unit shall determine the dispatch period with the labor dispatch unit according to the actual needs of the post, and shall not divide the continuous employment period into several short-term labor dispatch agreements.

Article 2 The laws of People's Republic of China (PRC) and the state regulate the property relations and personal relations between citizens and legal persons and between citizens and legal persons as equal subjects.
