Can the contracted management right of land be sublet?
Legally, the law allows land contractors to sublet (transfer) others. The main body of the transfer of land contractual management right is the contractor. The contractor has the right to independently decide whether and how to transfer the contracted management right of land according to law. However, it should be noted that rural land sublease is an agreement reached by both parties on the basis of voluntary equality, and it is necessary to ensure that there is no problem with the land lease contract. Legal basis: Article 9 of People's Republic of China (PRC) Rural Land Contract Law states that after contracting land, the contractor shall have the right to contract and operate the land, and may also retain the right to contract the land and transfer the right to operate the land contracted by others. Article 10 The State protects contractors from legally, voluntarily and with compensation transferring land management rights, and protects the legitimate rights and interests of land management rights holders, and no organization or individual may infringe upon them. Article 17 A contractor shall enjoy the following rights: (1) The right to use and profit from the contracted land according to law, and the right to independently organize the production, management and disposal of products; (2) Exchanging and transferring the contracted management right of land according to law; (three) the transfer of land management rights according to law; (4) If the contracted land is expropriated, requisitioned or occupied according to law, it shall have the right to obtain corresponding compensation according to law; (5) Other rights stipulated by laws and administrative regulations. It is not allowed to withdraw from the contracted management right of land as a condition for farmers to settle in cities. During the contract period, contracted farmers who settle in the city shall be guided and supported to transfer the contracted land management right within the collective economic organization or return the contracted land to the employer, and may also be encouraged to transfer the land management right. During the contract period, when the contractor returns the contracted land or the employer takes back the contracted land according to law, the contractor has the right to obtain corresponding compensation for its investment in the contracted land to improve the land production capacity.
