The real estate inheritance law of 2022 stipulates the order of heirs.

According to the provisions of Articles 10 and 12 of the Inheritance Law, the scope of legal heirs in China is: spouse, children, parents, brothers and sisters, grandparents, widowed daughter-in-law and widowed son-in-law who fulfill their main obligations to support their in-laws. In addition, according to the provisions of Article 1 1 of the Inheritance Law, the lineal blood relatives of the children who died before the decedent can be regarded as heirs. It can be seen that husband and wife, parents and children are the legal heirs of the other party in the first order.

It should be reminded that children include children born in wedlock, children born out of wedlock, adopted children and stepchildren with dependency. Parents include biological parents, adoptive parents and step-parents who have a foster relationship; Brothers and sisters include brothers and sisters of the same parents, half-brothers, brothers and sisters brought up, and stepbrothers and sisters with dependent relationships.

According to Article 10 of China's Inheritance Law, China's legal inheritance is divided into two orders: the first order is spouse, children and parents; The second order is brothers and sisters, grandparents and grandparents. At the same time, Article 12 of the Inheritance Law stipulates that the widowed daughter-in-law and the widowed son-in-law who have the main obligation to support their parents-in-law are the legal heirs in the first order. After the inheritance begins, the successor in the first order inherits, but the successor in the second order cannot inherit. If there is no heir in the first order, or if all the heirs in the first order give up or are deprived of the right of inheritance, the heirs in the second order can inherit the date and prepare the property.
