Regulations of Hebei Province on the Administration of Economic Information Market

Chapter I General Provisions Article 1 In order to meet the needs of the socialist market economy, promote the development and perfection of the information market, realize the commercialization and socialization of economic information, fully develop and utilize information resources, and protect the legitimate rights and interests of all parties involved in the trading of economic information commodities, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and in light of the actual situation of this province. Article 2 Economic information provided by written materials, tapes, disks, films, compact discs, samples and other tangible media are collectively referred to as economic information products.

Where service personnel directly provide economic information to users with or without information technology facilities, or provide information technology conditions for users to obtain economic information by themselves, they are collectively referred to as economic information services.

Economic information products and services entering the economic information market are collectively referred to as economic information commodities. Article 3 The term "economic information" as mentioned in these Regulations refers to information used for sale or provided for economic activities. Economic information market refers to the sum of the exchange relations and exchange places of economic information commodities. Article 4 The business scope of the economic information market includes: commodity information, economic cooperation information, technical information, new product information, natural resources information, financial information, labor information, talent information, real estate information and information permitted by the state to serve economic activities, as well as information consultation and information system, user software development and after-sales service. Article 5 The state practices the principles of active support, correct guidance, convenient operation and management according to law in the economic information market. Encourage units and individuals that meet the prescribed conditions to engage in economic information commodity trading and its intermediary activities. Article 6 These Regulations shall apply to units and individuals engaged in economic information commodity trading and intermediary activities within the administrative region of this province. Chapter II Management Departments and Responsibilities Article 7 The economic information management department of the provincial people's government is in charge of the economic information management of the whole province.

The economic information management department of the people's governments at or above the county level shall be in charge of the management of the economic information market within their respective administrative areas. Eighth people's governments at all levels of economic information management departments of market management responsibilities:

(a) in accordance with the relevant laws, regulations and rules, the implementation of macro guidance and organization and coordination of the economic information market;

(2) Formulating rules, regulations and measures for the management of the economic information market according to laws, regulations and national policies;

(three) to be responsible for the business qualification examination of units and individuals engaged in economic information commodity trading and intermediary activities;

(four) responsible for the supervision and inspection of economic information commodity trading and its intermediary activities;

(five) responsible for the statistical analysis of the economic information market;

(6) Training managers and employees in the economic information market;

(seven) to investigate and deal with violations of relevant laws and regulations. Ninth industrial and commercial administrative departments at all levels are responsible for the registration of units and individuals engaged in economic information commodity trading and intermediary activities; Investigate and deal with violations of laws and regulations on industrial and commercial administration in economic information commodity trading and its intermediary activities. Tenth levels of finance, taxation, safety and industry management departments, in accordance with relevant laws and regulations, within the scope of their duties, the implementation of supervision and inspection of economic information commodity trading and intermediary activities. Chapter III Property Rights of Economic Information Products Article 11 The intellectual property rights of economic information products whose contents are all or part of intellectual property rights shall be handled in accordance with the provisions of relevant laws and regulations. Article 12 The ownership, use right and transfer right of economic information products developed by higher authorities or government departments at the same level shall be stipulated in the project task book or contract. If it is not specified, its ownership, use right and transfer right shall belong to the R&D unit. Thirteenth economic information products entrusted to others for research and development, the parties shall clearly stipulate their ownership, use right and transfer right in the contract; If there is no provision in the contract, all parties have the right to use and transfer it. Article 14 Unless otherwise agreed, the ownership of economic information products jointly researched and developed by two or more units and individuals shall be shared by all parties to the cooperative development. Article 15 The economic information products researched and developed by the staff of a unit during their tenure are the results of performing official duties or mainly utilizing the material and technical conditions of the unit, and their ownership belongs to the unit; If it is not the result of official duties, does not occupy working hours, and does not use the material and technical conditions of the unit, the ownership of economic information products belongs to the developer himself. Chapter IV Trading of Economic Information Commodities Article 16 Trading of economic information commodities shall follow the principles of diversified business, good faith and fair competition. Seventeenth economic information commodity transactions can be carried out through the economic information market, direct negotiations between the supply and demand sides, brokers and other forms. Eighteenth units and individuals engaged in economic information commodities must meet the following conditions:

(1) Having a clear business scope;

(2) Having reliable information sources;

(3) Having funds, information processing equipment and business service places suitable for its business scope;

(4) Having the ability to identify the authenticity and feasibility of information;

(5) Having sound rules and regulations or codes of conduct. Nineteenth units and individuals in accordance with the provisions of article eighteenth, by the economic information management departments at or above the county level for business qualification audit. After passing the examination and issuing a qualification certificate, the administrative department for industry and commerce at the same level shall register and issue a business license before conducting business activities.
