Measures of Jiangsu Province on the Administration of Real Estate Intermediary Service Charges
Article 1 In order to further standardize the charging behavior of real estate intermediary services and promote the healthy development of real estate intermediary services in our province, these Measures are formulated in accordance with the relevant provisions of the Regulations on the Administration of Urban Real Estate Transactions in Jiangsu Province and the Measures for the Administration of Intermediary Services.
Article 2 Any real estate consulting, appraisal, brokerage and other intermediary service enterprises legally established within the territory of this province shall be entrusted to provide intermediary services related to real estate development, investment, management and consumption. For clients with compensation, these measures shall be observed.
Third real estate intermediary service charges belong to business service charges. According to the principle of unified policy and hierarchical management, government-guided prices and market-regulated prices are implemented respectively. The provincial price department in conjunction with the provincial construction administrative department is responsible for formulating the management principles, methods and guiding charging standards for important projects of the province's real estate intermediary service charges; The price departments of cities and counties are responsible for the supervision and management of local real estate intermediary service charges, and determine the specific charging standards of local government-guided charging items within the provincial-level guiding charging standards.
Article 4 The following real estate intermediary service items and standards shall be subject to government-guided prices.
(1) Agency fee for commercial housing sales: Intermediary service enterprises are entrusted by commercial housing development (construction) units to sell commercial housing, and charge the development (construction) units an agency fee of 0.4- 1.2% of the total transaction price. In the case of exclusive agency sales, the agency fee shall not exceed 2.5% of the total transaction price.
(2) Agency fees for the sale of stock houses (second-hand houses): different fees are charged according to the service content. Providing services for the whole process of house sale (replacement) (including providing information, exploration and evaluation, replacement and matching, accompanying house inspection, paying taxes and fees, collecting and paying house purchase money on behalf of others, handling house ownership certificate, land use certificate as an agent, and assisting real estate delivery, etc.). ) will be charged at 1.5-2% of the total transaction price; If only part of the service is provided, it shall be determined by both parties to the transaction through consultation under the above standards. The agency fee shall be borne by both parties to the transaction, 50% respectively, unless otherwise agreed in the contract.
(3) Warrant agency fee: if the intermediary service enterprise is entrusted to handle the house transaction transfer formalities and the house ownership certificate respectively, and handle the land use right change and land use certificate respectively, the agency service fee will be charged according to the fact that each household does not exceed 50 yuan; At the same time, the agency "two certificates", according to each household does not exceed 80 yuan to collect service fees; Commodity sales units with real estate intermediary qualifications shall, according to the voluntary entrustment of property buyers, handle the "two certificates" in batches, and collect them according to the fact that each household does not exceed 60 yuan.
(IV) Service fee for mortgage loan agency: If the intermediary service enterprise accepts the entrustment to handle the formalities related to mortgage loan for house purchase, the service fee will be charged for each household 100-300 yuan.
(5) Agency fee for house leasing: no matter the length of the lease, it will be charged according to the transaction rent standard from half a month to January. The rental agency fee shall be borne by both parties, 50% respectively, unless otherwise agreed in the contract.
(VI) Real estate price appraisal fee: The real estate price appraisal fee with real estate as the main content shall be charged by the appraisal institution qualified for real estate appraisal according to the total appraisal price (value) of real estate (see the attached table for specific charging standards). The assessment fee for real estate demolition shall be implemented with reference to the above standards. Under the premise of keeping the total fee level unchanged, the method of charging according to the assessment area may also be adopted. The specific measures shall be formulated by the competent price department of the provincial municipality.
Fifth real estate intermediary service charges that are not included in the scope of government guidance price shall be subject to market adjustment price, and the charging standard shall be determined by the entrusting party and the intermediary service enterprise through consultation in the entrustment contract.
Article 6 A real estate intermediary service enterprise shall follow the principles of openness, honesty and trustworthiness, voluntary entrustment and paid service, provide services that are consistent with quality and price, and collect intermediary service fees from the entrusting party in accordance with the provisions of these Measures. Intermediary enterprises accept voluntary entrustment, provide services, sign entrustment contracts (agreements) with clients, and stipulate entrustment matters, service contents, obligations and responsibilities of both parties, contract term, charging standards, charging methods, charging amount and payment time.
Seventh real estate intermediary service charges should be clearly marked. An intermediary service enterprise shall announce its charging items, service contents, charging methods, charging standards and other matters in a prominent position in its business service place or charging place.
Article 8 If a real estate intermediary service enterprise, in violation of these provisions, raises the charging standards without authorization, forces or forces the parties to accept the service charges in disguise, commits price fraud without informing the charging standards in advance, and fails to clearly mark the price according to the provisions, the competent price departments at all levels shall punish it according to law.
Ninth construction (real estate) departments at all levels should strengthen the industry management of real estate intermediary enterprises, strict market access system. Intermediary enterprises that seriously violate price policies and regulations, engage in price fraud and lack industry reputation should be disqualified and eliminated.
Tenth these Measures shall be implemented as of August 6, 2003. Prior to the relevant provisions are inconsistent with these measures, stop execution. Municipalities under the provincial jurisdiction may formulate detailed rules for implementation according to these measures.
