Regulations of Huzhou Municipality on the Administration of City Appearance and Environmental Sanitation

Article 1 In order to strengthen the management of city appearance and environmental sanitation and create a clean and beautiful city environment, these Regulations are formulated in accordance with the Regulations on the Administration of City Appearance and Environmental Sanitation, the Regulations on the Administration of City Appearance and Environmental Sanitation in Zhejiang Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the city appearance and environmental sanitation management of cities, built-up areas, economic development zones, tourist resorts, industrial parks and other areas designated and announced by the people's governments of cities and counties (districts) within the administrative area of this Municipality. Article 3 The people's governments of cities and counties (districts) shall strengthen their leadership over the work of city appearance and environmental sanitation.

The competent department of city appearance and environmental sanitation of the people's government of the city or county (District) shall be responsible for the management of city appearance and environmental sanitation, and the relevant competent departments shall do a good job in the management of city appearance and environmental sanitation according to their respective responsibilities.

The town people's government is responsible for the management of city appearance and environmental sanitation within its jurisdiction, and the street offices are responsible for the management of city appearance and environmental sanitation determined by the people's governments of cities and counties (districts) within its jurisdiction.

Economic development zones, tourist resorts, industrial parks and other areas where urbanization management is implemented, the management institutions determined by the people's governments of cities and counties (districts) shall be responsible for the city appearance and environmental sanitation management of this area.

The administrative punishment stipulated in these Regulations and the administrative coercion related to administrative punishment shall be implemented by the administrative law enforcement department of urban management according to law, unless otherwise stipulated in these Regulations; The comprehensive administrative law enforcement area shall be implemented by the comprehensive administrative law enforcement department according to law. Article 4 The funds required for city appearance and environmental sanitation shall be approved according to the actual tasks and included in the annual financial budget.

City and county (District) people's governments shall extend urban environmental sanitation services to rural areas and gradually realize the equalization of urban and rural environmental sanitation services. Fifth urban management administrative law enforcement, city appearance and environmental sanitation departments should strengthen the information construction of city appearance and environmental sanitation, and improve the management and service level of digital cities.

Urban management administrative law enforcement, city appearance and environmental sanitation, market supervision and management, transportation and other departments should strengthen information disclosure and service platform construction, and provide the public with service information of public facilities such as parking lots, farmers' markets, public transportation stations, public bicycle parking spots, public toilets, etc. Sixth city appearance and environmental sanitation shall implement the management system of the area of responsibility, and the city appearance and environmental sanitation work in the area of responsibility shall be undertaken by the responsible person determined according to law. The person in charge of the responsible area shall perform the following duties: (1) keep the environment clean and tidy, free of exposed garbage, feces, sewage, sputum and waste, and remove stagnant water, ice and snow; (two) to keep the city clean and orderly, and shall not set up stalls, set up, post, depict, park, pile up, hang and dry items without authorization; (three) maintenance of building exterior walls, shops, greening facilities, environmental sanitation facilities, etc. Clean and in good condition; (four) other duties determined by the competent department of city appearance and environmental sanitation or the town people's government.

The responsible person shall discourage and stop the acts that damage the city appearance and environmental sanitation in the responsible area; Those who do not listen to dissuasion shall report to the administrative law enforcement department of urban management or the competent department of city appearance and environmental sanitation in a timely manner, and the administrative law enforcement department of urban management and the competent department of city appearance and environmental sanitation shall deal with it in a timely manner after receiving the report. Seventh urban and rural planning departments shall, according to the design standards and norms of urban parking lots (garages), reasonably determine the configuration standards of building parking lots and the layout and scale of public parking lots.

According to the road traffic demand, under the condition of not affecting the passage of pedestrians and vehicles, the administrative law enforcement departments of traffic management and urban management of public security organs, together with the competent departments of housing and urban construction, can add temporary parking spaces on the roads around hospitals, schools, farmers' markets, stations and other crowded places and other public places.

Encourage units to transform idle sites into temporary parking lots after approval according to law, and encourage qualified units to open exclusive parking lots to the public at night, rest days and holidays. Temporary parking lots and unit-owned parking lots can reasonably charge parking fees, and disclose the charging standards according to regulations.

If the parking lot (garage) is stopped or its use is changed without authorization, it shall be ordered to make corrections within a time limit and may be fined between 5,000 yuan and 50,000 yuan. Eighth residential quarters and units with prominent contradiction between parking supply and demand can rebuild the public areas of the quarters and the exclusive areas of the units according to law for adding parking berths or three-dimensional mechanical parking facilities.

In the case of ensuring fire safety and smooth roads, the administrative law enforcement departments of traffic management and urban management of public security organs, together with the competent departments of housing and urban construction, can add free temporary parking spaces for a certain period of time on the roads around residential areas where the contradiction between parking supply and demand is prominent. Ninth residential planning for parking garage (space), should first meet the parking needs of owners. The ownership of the garage (parking space) shall be agreed by the parties through sale, gift and lease.

Two years after the completion and delivery of new residential quarters, if there are unsold and donated garages (spaces), the construction unit shall announce the vacancy of garages (spaces) to the owners of residential quarters. If the owners of residential quarters request to rent, the construction unit shall not refuse to rent on the grounds of selling (giving) only.

Within two years from the date of implementation of these regulations, if there are unsold and donated garages in the completed residential quarters, the provisions of the second paragraph shall apply.
