Regulations of Nanjing Municipality on the Administration of Urban Road Facilities (revised 20 10)

Chapter I General Provisions Article 1 In order to strengthen the management of urban road facilities, give full play to their functions and promote economic and social development, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to urban road facilities within the administrative area of this Municipality. Except the public green space within the scope of urban road facilities.

The term "urban road facilities" as mentioned in these Regulations refers to carriageways, sidewalks, isolation belts, squares, bridges, tunnels, elevated roads, footbridges, underground passages and other affiliated municipal facilities within the red line of urban road planning. Article 3 The administrative department of Nanjing Municipality is the administrative department of urban road facilities in this Municipality, and is responsible for the management, maintenance and supervision of urban road facilities in this Municipality.

District and county administrative departments of urban road facilities shall be responsible for the management and maintenance of urban road facilities in accordance with the prescribed scope and division of labor.

Construction, planning, public security, industry and commerce administration, gardens, land, city appearance and other departments shall, within the scope of their respective duties, cooperate with the competent authorities to do a good job in the management of urban road facilities. Article 4 The construction, renovation and maintenance of urban road facilities shall be rationally laid out and implemented according to the overall urban planning. New construction, renovation and expansion of urban road facilities should strictly implement the construction procedures and quality standards, adhere to the principle of underground first and then on the ground, make unified planning and overall construction.

Within three months after the completion of the urban road facilities project, the construction unit shall, in accordance with the provisions, declare the acceptance and handover to the administrative department of urban road facilities.

Special roads connected with urban roads, which meet the standards of urban roads, can be handed over to the administrative departments of urban road facilities for management and maintenance. Article 5 All units and individuals have the obligation to protect urban road facilities, and have the right to report and accuse violations of these Regulations.

Units and individuals that have made remarkable achievements in the protection of urban road facilities shall be commended or rewarded by the administrative department of urban road facilities. Chapter II Occupation Management Article 6 No unit or individual may occupy urban road facilities without authorization. If temporary occupation is really necessary, it shall apply to the administrative department of urban road facilities, go through the examination and approval procedures for the occupation of urban road facilities, pay the occupation fee, and obtain the urban road occupation permit; If traffic safety is affected, the consent of the public security traffic management department shall also be obtained.

Temporary occupation of urban road facilities in important sections and designated areas designated by the municipal administrative department of urban road facilities shall be reported to the municipal administrative department of urban road facilities for approval, and temporary occupation of urban road facilities in other sections shall be reported to the district administrative department of urban road facilities for approval. Seventh the following areas are strictly prohibited:

(a) the bridge deck and lots that hinder traffic safety;

(2) bus stops;

(three) the use and scope of operation of gate valves, inspection wells, rainwater wells and inspection wells of underground pipelines. Article 8 Where the following construction projects need to temporarily occupy urban road facilities due to construction, the construction units and individuals shall apply to the administrative department of urban road facilities for temporary occupation of urban road facilities with the construction project planning permit:

(a) new construction, renovation and expansion of municipal engineering;

(2) Building, rebuilding and expanding houses along the street;

(three) beyond the approved scope of excavation. Ninth strictly control the occupation of urban road facilities and set up various markets. If it is really necessary to set up, it must be approved by the administrative department of urban road facilities and the public security traffic management department, and reported to the Municipal People's government for approval.

Occupation of urban road facilities to set up commercial stalls, advertisements, signs and kiosks shall go through the formalities for temporary occupation of urban road facilities before going through other formalities. Tenth strictly control the occupation of urban road facilities and set up various parking lots. If it is really necessary to use urban road facilities to set up parking lots, the measures for examination and approval and management shall be formulated separately by the Municipal People's Government. Eleventh strictly control the temporary occupation of sidewalks. Approved temporary occupation of sidewalks shall generally not exceed half the width of sidewalks. If it is really necessary to occupy more sidewalks, sidewalks with a width of not less than one meter shall be reserved to ensure pedestrian safety.

Urban road facilities maintenance and repair units to repair road projects, the occupation scope shall not exceed the road between the designated safety islands and the road outside the kerb 1.5 meters wide. Twelfth units and individuals that temporarily occupy urban road facilities shall occupy them according to the approved scope and time, and shall not arbitrarily change the nature of occupation, expand the occupation scope and extend the occupation time, and shall not lease or transfer them.

During the occupation period, due to the needs of urban construction, the occupying units and individuals shall promptly dismantle all kinds of buildings and facilities on the occupied urban road facilities. Thirteenth occupation units and individuals shall not damage urban road facilities. Damage to urban road facilities, occupation units and individuals shall be responsible for compensation.

The occupied site must be fenced or partitioned and kept clean and tidy.

Do not prefabricate cement products, mix mortar and wash sand and gravel in the occupied area. Article 14 When the temporary occupation of urban road facilities expires, the occupying units and individuals shall clean up the site during the occupation period, report it to the administrative department of urban road facilities and the public security traffic management department for acceptance, and hand in the urban road occupation permit. Article 15 the road occupation fee shall be uniformly collected by the municipal urban road facilities management department in accordance with the standards approved by the provincial finance department and the provincial price department, and deposited in the financial special account for the maintenance, conservation and management of urban road facilities.
