The administrative department of culture shall be responsible for the examination and approval of the establishment of business units of Internet service sites, and shall be responsible for the supervision and management of the business activities of business units of Internet service sites established according to law; The public security organ shall be responsible for the supervision and management of the information network security, public security and fire safety of the business units of the Internet service business premises; The administrative department for industry and commerce is responsible for the registration and business license management of the business units in the business premises of Internet access services; Other relevant departments shall, within the scope of their respective functions and duties, supervise and manage the business units of Internet service sites respectively. Article 4 Citizens, legal persons and other organizations are encouraged to supervise the business activities of business units in Internet service sites and reward those who have made outstanding contributions. Chapter II Establishment Article 5 The licensing system shall be implemented in accordance with the provisions in the business activities of business units of Internet service sites. Without permission, no organization or individual may set up an Internet service business place or engage in Internet service business activities. Article 6 A business unit that establishes an Internet service business place shall adopt the form of enterprise organization and meet the following conditions:
(1) The name, domicile, organization and articles of association of the enterprise;
(2) Having funds suitable for its business activities;
(3) Having a business place suitable for its business activities and meeting the fire safety conditions stipulated by the state;
(four) the decoration project of the business premises meets the environmental quality and engineering quality inspection standards;
(5) Having a sound information network security management system and security technical measures;
(six) have a fixed network address, and should access the Internet in the form of a dedicated line; Direct chain stores in Yunyan District, Nanming District and xiaohe district Internet service sites, each with a business area of not less than 400 square meters, the number of computers is not less than 150, and each computer covers an area of not less than 2 square meters (excluding public areas such as channels); In Wudang District, Baiyun District and Huaxi District, the business area of the chain enterprises' direct stores with Internet service places is not less than 300 square meters, the number of computers is not less than 100, and the area of each computer is not less than 2 square meters (excluding public areas such as channels); In other counties (cities), the business area of the direct-operated chain stores with Internet access service sites is not less than 300 square meters, the number of computers is not less than 100, and each computer covers an area of not less than 2 square meters (excluding the public areas such as channels);
(seven) there are safety management personnel, management personnel and professional and technical personnel who are suitable for their business activities and have obtained professional qualifications;
(eight) other conditions stipulated by laws and regulations. Seventh secondary schools, primary schools and residential buildings (hospitals) within 200 meters, shall not set up Internet service business premises. Article 8 To establish a business unit of Internet service business premises, an application shall be submitted to the cultural administrative department of the local people's government at or above the county level, and the following documents shall be submitted:
(a) the name pre-approval notice and articles of association;
(2) Resume and identification materials of the legal representative or principal responsible person;
(3) Credit certificate of funds;
(4) Certificate of property right of the business premises or letter of intent for lease;
(5) Other documents required to be submitted according to law. Ninth district (county, city) administrative department of culture shall make a decision within 05 working days from the date of receiving the application for establishment; Upon examination, if it meets the requirements of total control and layout, it shall be reported to the municipal cultural administration department for examination and approval. The municipal administrative department of culture shall make a decision within 5 working days from the date of receiving the examination materials. In line with the requirements, the district (county, city) cultural administrative department shall issue an approval document for the preparation.
After the completion of the preparation, the applicant shall apply to the public security organ at the same level for information network security and fire safety audit with the approval document of the preparation. The public security organ shall make a decision within 20 working days from the date of accepting the application; After on-the-spot investigation and review, approval documents will be issued.
The applicant holds the approval document of the public security organ and applies to the district (county, city) cultural administrative department. After the preliminary examination, the municipal administrative department of culture shall conduct the final examination. The district (county, city) cultural administrative department shall make a preliminary decision within 5 working days from the date of receiving the application and report it to the municipal cultural administrative department for examination; The municipal administrative department of culture shall, within 10 working days from the date of receipt of the audit materials, issue the Network Culture Business License to the district (county, city) administrative department of culture in accordance with the provisions of Article 6 of these Measures.
If the applicant's application fails to meet the requirements after examination by the administrative department of culture, or if the public security organ fails to pass the examination, it shall separately explain the reasons in writing to the applicant.
The applicant shall apply to the administrative department for industry and commerce for registration with the network culture business license, and may start business only after obtaining the business license according to law.
