Measures of Binzhou Municipality on the Administration of Green Building Signs
Chapter I General Provisions
Article 1 In order to standardize the management of green building signs in our city and promote the high-quality development of green buildings, these measures are formulated in accordance with the spirit of documents such as "Measures for Promoting Green Buildings in Shandong Province" and "Measures for the Management of Green Building Signs in Shandong Province", combined with the actual situation of our city.
Article 2 The term "green building signs" as mentioned in these Measures refers to information signs indicating the star rating of green buildings and including performance indicators, including certificates and signs. Green building signs should follow the unified style formulated by the Ministry of Housing and Urban-Rural Development, and the licensing department should make certificates, and the reporting unit should make signs according to different application scenarios and production guidelines.
The applicant shall hang, post or place green building signs (certificates and signs) in a prominent position in buildings or community public spaces.
Article 3 The scope of granting green building signs is civil buildings and industrial buildings that meet the star-rated standards of green buildings.
Fourth green building signs are divided into three levels: one-star, two-star and three-star.
Fifth city housing and urban construction department is responsible for the guidance and supervision of the city's green building identification management, specifically responsible for the city's one-star green building identification and identification incentives. The housing and urban-rural construction departments of counties (cities, districts) are responsible for the publicity, cultivation and organization of green buildings within their respective administrative areas, and are responsible for the formal review of projects that declare one-star green buildings.
Star identification and green building identification shall be granted in accordance with the application for government services, and no fees shall be charged to the reporting unit.
Article 6 The identification of one-star signs shall adopt the evaluation standard of green buildings in Shandong Province; Used in green hospital buildings, green campus buildings, green office buildings, etc. There is no evaluation standard in this province, and the national standard is adopted.
Article 7 The municipal competent department of housing and urban-rural construction is responsible for establishing a municipal green building expert database (including planning, architecture, structure, building materials, heating and ventilation, water supply and drainage, electricity, building physics, testing and other related majors), and undertaking the examination and training of one-star green building identification experts.
Article 8 Experts in the green building expert database shall have good professional ethics, be familiar with green building standards, have been engaged in green building-related work for more than 5 years, and understand and master relevant technical requirements such as project planning, design, construction, testing, consultation and operation management. , and has deputy senior and above technical titles.
Chapter II Declaration and Examination Procedures
Article 9 The declaration of green building signs follows the principle of voluntariness. Large public buildings such as government-invested or government-invested (including state-owned funds) public buildings shall be built in accordance with two-star and above green building standards, and corresponding green building signs shall be obtained.
Tenth green building evaluation should be carried out after the completion of the construction project.
The project applying for green building identification shall be pre-evaluated according to the requirements of the green building evaluation standard DB37/T 5097-202 1 Article 3. 1.2. Pre-evaluation should be started after the construction drawing has passed the examination and completed before the project starts. After the pre-evaluation is completed, if there are any changes that have a significant impact on the evaluation of green buildings, it needs to be re-evaluated.
Eleventh reporting units can entrust a third-party organization with corresponding technical capabilities to pre-evaluate the star rating of green buildings, and the pre-evaluation will not grant signs.
The unit that implements the pre-evaluation shall analyze the feasibility of applying for green building signs for this project according to the feasibility study report, construction drawing review certificate, construction drawing review report, construction drawing that has passed the review, calculation book, test report and other materials submitted by the applicant, issue a pre-evaluation report, make technical disclosure on the pre-evaluation results, and put forward suggestions to the applicant in view of the existing problems.
In the process of green building project construction, the unit that carries out pre-evaluation shall provide technical consulting services for the reporting unit in the whole process.
The applicant shall sign a service contract with the pre-evaluation unit to stipulate the technical responsibilities and rights and obligations.
Twelfth city housing and urban and rural construction departments responsible for the establishment of the city's green building project incubator. All the pre-evaluated projects are included in the incubator, and the competent department of housing and urban and rural construction where the project is located provides technical guidance services for the warehousing projects.
Thirteenth green building identification should be scientific, open, fair and just. The identification work includes declaration, recommendation, evaluation, publicity and publication, in which the evaluation includes formal evaluation and expert evaluation.
Fourteenth green building logo declaration should be put forward by the project construction unit, operation unit or owner unit, and encourage design, construction, consulting and other related units to participate in the declaration. The project to declare green building signs shall meet the following conditions:
(a) design, construction, operation and transformation in accordance with the current national standards or local standards in Shandong Province;
(two) has passed the completion acceptance of the construction project and completed the record.
Fifteenth reporting units should provide the following application materials, and be responsible for the authenticity, accuracy and completeness of the materials.
(a) green building identification declaration, self-assessment report and pre-assessment report;
(two) the project approval documents, construction land planning permit, construction project planning permit, land use permit, construction drawing examination certificate, construction permit, completion acceptance and other related documents;
(3) the applicant's profile, qualification certificate, unified social credit code certificate, etc. ;
(four) drawings, feasibility study reports, test reports, calculations, pictures, videos and other technical documents related to identification;
(five) the application materials, data authenticity and annual report of the main green performance indicators of the commitment.
Sixteenth to declare the green building signs of the project, in the organization of recommendation and identification, the competent department of housing and urban construction shall conduct a formal review, mainly to review the following contents:
(a) whether the reporting unit and project have the conditions for reporting;
(2) Whether the application materials are complete, complete and effective.
During the formal examination, the applicant may be required to supplement the materials at one time. Projects that have not passed the formal review shall not be recommended for declaration, and expert review shall not be organized.
Article 17. After formal review, the municipal housing and urban-rural construction department shall organize expert review on the project that declares the one-star green building logo, review the performance of green buildings according to the evaluation criteria of green buildings, check the application materials on the spot, and form expert review opinions.
The accreditation of green buildings shall be conducted according to the star-rated standards declared by the project. Projects that have not passed the expert review shall not be declared again within half a year.
Eighteenth after the expert review, one-star green building projects in the city housing and urban construction portal publicity. The publicity content includes the project location, type, name, reporting unit, green building star rating and key technical indicators. The publicity period is 7 working days. Chapter III Identity Management
Twenty-second housing and urban construction departments should strengthen the operation mechanism of green building identification management, strengthen the supervision of identification projects after the event, scientifically design the workflow and supervision methods, clarify management responsibilities and supervision measures, and effectively prevent and control the risks of clean government.
Twenty-third units that have obtained the green building certification project shall strengthen the operation management of green buildings, strengthen the comparison between the operation indicators and the star-rated indicators of green buildings, and report the main indicators of annual operation to the green building certification management information system every year.
Twenty-fourth housing and urban construction departments found that there are the following problems in the green building identification project, it should be in accordance with the identification management authority to propose a deadline for rectification, the rectification period is not more than two years:
(a) the project is lower than the recognized star level of green buildings;
(two) the main performance index of the project is lower than the certificate of green building;
(three) the use of green building signs for false propaganda;
(four) for more than two consecutive years (including) did not truthfully report the main index data;
(five) refusing to cooperate with the supervision and inspection without justifiable reasons;
(6) Failing to hang signs as required.
Twenty-fifth housing and urban-rural construction departments found that enterprises that have obtained green building signs have one of the following problems, they should revoke the green building signs in accordance with the sign management authority, and recover the certificates and signs:
(a) the rectification has not been completed within the rectification period;
(two) forged information and data to obtain green building signs;
(3) Major quality and safety accidents occur.
Twenty-sixth green building accreditation experts should consciously accept the supervision and management of the competent department of housing and urban construction, fair and impartial accreditation review, and consciously avoid the assessment of the declared projects related to their own interests. Chapter IV Supplementary Provisions
Twenty-seventh matters not covered in these Measures shall be implemented in accordance with the relevant provisions of the Measures for the Administration of Green Building Signs in Shandong Province.
