Public credit information refers to the data and materials generated or obtained by state organs, organizations and mass organizations authorized by laws and regulations to manage public affairs (hereinafter referred to as public credit information providers) in the process of performing their duties and providing services according to law, which can be used to identify the credit status of credit subjects.
Market credit information refers to the data and materials generated or obtained by credit service institutions, trade associations, other enterprises, institutions and organizations in the process of production, operation and service provision, which can be used to identify the credit status of credit subjects.
Credit service institutions refer to intermediary service institutions established according to law and engaged in credit rating, credit management consulting, credit risk control and other related business activities. Article 4 The management of social credit information shall meet the needs of the construction, reform and development of the social credit system, follow the principles of legality, safety, timeliness and accuracy, and shall not endanger national security, divulge state secrets, or infringe on commercial secrets and personal privacy. Article 5 The people's governments at or above the county level shall set up a leading group for the construction of social credit system, incorporate the construction of social credit system into the national economic and social development plan, formulate the construction plan or implementation plan of social credit system, define the working institutions and specialized personnel, ensure the working funds, and incorporate the management of social credit information into the target responsibility system assessment system.
The development and reform departments of the people's governments at or above the county level shall be responsible for the comprehensive coordination, supervision and management of social credit information within their respective administrative areas.
The member units of the leading group for the construction of social credit system and other relevant departments and organizations shall, according to their respective responsibilities, do a good job in the collection, disclosure, application and management of social credit information in related fields.
In accordance with the provisions of laws and administrative regulations, the supervision and management institutions of credit reporting industry shall do a good job in the supervision and management of financial credit information and credit reporting institutions. Article 6 The provincial people's government shall establish a unified social credit information service platform in the whole province, and realize the cross-departmental, cross-disciplinary and cross-regional use of social credit information through the interconnection between the credit information system and the credit information service system established by relevant departments, organizations and localities.
The credit center established by the provincial people's government (hereinafter referred to as the provincial credit center) is responsible for the construction, operation and maintenance of the provincial social credit information service platform, collecting and managing social credit information, and providing information disclosure, inquiry, * * enjoyment, application and other related services.
The member units of the provincial social credit system construction leading group and other relevant departments and organizations are responsible for the construction, operation and maintenance of the credit information service system of this system, and do a good job in data exchange and information sharing with the provincial social credit information service platform. Seventh state organs and their staff should perform their duties according to law, improve the awareness and level of law-abiding performance, and play an exemplary role in the construction of social credit system.
Credit service institutions, trade associations, other enterprises, institutions and organizations shall abide by trade credit regulations and professional ethics, strengthen their own credit management and improve their credit level.
Encourage the public to be trustworthy and self-disciplined, raise the awareness of honesty, participate in honesty education and credit supervision activities, and promote the construction of social credit system. Eighth radio, television, newspapers, Internet and other media should publicize and popularize social credit knowledge through news reports, special columns, public service advertisements and other forms, carry forward the culture of honesty, and create an honest public opinion environment and social atmosphere. Chapter II Information Collection Article 9 The collection of public credit information shall be subject to catalog management, and the contents, providers, data formats, access rights, collection procedures, collection paths, collection time limits and disclosure methods of public credit information shall be stipulated by the catalog of public credit information.
The catalogue of public credit information shall be compiled by the development and reform department of the provincial people's government in conjunction with relevant departments, and adjusted in a timely manner according to relevant state regulations and standards. After soliciting the opinions of the members of the provincial social credit system construction leading group, it shall be submitted to the provincial people's government for approval and announced to the public.
If the contents of the project included in the catalogue management may damage the rights of the credit subject or increase the obligations of the credit subject, and the social impact is great, experts shall be organized to evaluate and solicit opinions from the public. Article 10 The following credit subject information shall be included in the public credit information directory:
(1) Registration information reflecting the basic situation of credit subjects in public management and services;
(2) Information reflecting the credit status of credit subjects in administrative acts such as administrative licensing, administrative punishment, administrative compulsion, administrative confirmation, administrative inspection, administrative collection, administrative reward and administrative payment;
(3) Refusing to perform effective legal documents;
(four) the credit subjects generated or mastered by the group organizations in the process of performing their duties are commended and rewarded, and they participate in social welfare and voluntary services;
(five) other information that should be included in the catalogue management according to law.
