Regulations of Hunan Province on the Administration of Economic Information Market

Chapter I General Provisions Article 1 In order to cultivate and develop the economic information market, safeguard the legitimate rights and interests of economic information business units, individual operators and customers, and maintain the order of the economic information market, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and in light of the actual situation of this province. Article 2 The operation and management of economic information within their respective administrative areas shall abide by these Regulations. Where laws and regulations provide otherwise, such provisions shall prevail. Article 3 The term "economic information" as mentioned in these Regulations refers to the information about economic activities generated in the process of economic operation, collected and processed by economic information business units or individual operators, entered the market in the form of commodities, and provided to customers with compensation.

The term "economic information market" as mentioned in these Regulations refers to economic information business premises and economic information business activities. Article 4 People's governments at or above the county level shall attach importance to the development of information industry, strengthen the infrastructure construction of economic information market and the development and utilization of economic information resources, and incorporate the development plan of economic information industry into the national economic and social development plan of their respective administrative regions.

Encourage enterprises, institutions and individuals to engage in economic information business activities and establish various forms of economic information business entities. Article 5 The economic information market shall follow the principles of active support, correct guidance, coordinated development and management according to law.

Engaged in economic information business activities, we should adhere to the principles of voluntariness, equality, honesty and credit, legal operation and fair competition, and consciously safeguard the public interests of the state and society. Chapter II Administrative Departments and Their Duties Article 6 The planning administrative department of the people's government at or above the county level is the comprehensive administrative department of the economic information market and is responsible for the management of the economic information market within its administrative area. Its duties are:

(a) the implementation of national laws and regulations on the economic information market;

(two) to formulate the macro development plan of the economic information market within their respective administrative areas;

(three) according to laws, regulations and national policies, the implementation of macro guidance and organization and coordination of the economic information market, formulate rules and measures for the management of the economic information market;

(four) responsible for the comprehensive analysis of market economy information;

(five) review the business qualifications of economic information business units and individual operators, and issue qualification certificates;

(six) to organize and guide the business training of managers and employees in the economic information market;

(seven) to supervise and inspect the quality of economic information, and investigate or cooperate with relevant departments to investigate and deal with illegal acts in economic information business activities. Seventh professional economic information market management departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the management of economic information market, and accept the unified coordination and macro management of the comprehensive management department of economic information market. Chapter III Economic Information Management Article 8 To engage in economic information management activities, the following conditions must be met:

(1) Having a clear business scope and reliable sources of economic information;

(2) Having employees with professional knowledge of economic information;

(3) Having funds, facilities and places suitable for its business scope;

(4) Having a sound management system;

(5) Other conditions stipulated by laws and regulations. Article 9 An entity applying for engaging in economic information business must obtain the consent of the competent department of the people's government at or above the county level, and the comprehensive management department of the economic information market at the same level shall conduct qualification examination. Upon examination, those who meet the conditions stipulated in Article 8 of these regulations shall be issued with qualification certificates.

Units and individual operators without administrative departments shall be qualified by the comprehensive management department of the local economic information market. Those who pass the examination will be issued with qualification certificates. Article 10 Units and individual operators who have obtained the qualification for economic information business shall apply to the administrative department for industry and commerce of the people's government at or above the county level for registration, obtain a business license, and go through the tax registration with the tax authorities before engaging in economic information business activities. Article 11 Units and individual operators engaged in economic information business shall go through the relevant procedures at the original license-issuing department when they stop business, change their business scope and name, split up or merge. Twelfth economic information business units and individual operators should strengthen the management of employees, carry out business training and professional ethics education, and improve the management level and service quality. Thirteenth economic information business units and individual operators shall be responsible for the legality and authenticity of the economic information provided to the service object. Article 14 It is forbidden to operate the following economic information:

(a) involving state secrets, endangering national security and interests;

(two) damage the public interest or the legitimate rights and interests of others;

(3) The content is false or invalid;

(four) other economic information that the state is not allowed to operate. Fifteenth economic information management can take the following forms:

(a) to provide economic information products in the form of written materials, tapes, disks, films, CDs, etc. As a carrier;

(2) Providing economic information consultation and intermediary services;

(3) Providing economic information network services;

(4) Holding economic information conferences and trade fairs;

(5) Other business forms permitted by the state. Sixteenth economic information business units or individual operators in the economic information business activities need to conclude a contract with the client, it shall conclude a written contract according to law, except for immediate settlement. The terms of the contract mainly include:

(a) the name, content and method of providing economic information;

(2) period of validity;

(3) the price or remuneration and the date and method of payment;

(4) Liability for breach of contract;

(five) other provisions stipulated by law or determined by the parties through consultation.
