Anyone who engages in commercial Internet cultural activities within the territory of People's Republic of China (PRC) shall apply for the establishment of commercial Internet cultural units.
The establishment of an operating Internet cultural unit shall conform to the relevant provisions of the Measures for the Administration of Internet Information Services and meet the following conditions:
1, unit name, domicile, organization and articles of association;
2. Have a clear scope of Internet cultural activities;
3. It has a legitimate source of Internet cultural products or the production capacity of Internet cultural products;

6. According to "Several Opinions on Introducing Foreign Capital in Cultural Field" (Huifa [2005]19), the application of foreign-invested Internet information service providers to engage in Internet cultural activities is not accepted, and service providers from Hong Kong and Macao are allowed to set up operating Internet cultural units controlled by the mainland;
7. Other conditions stipulated by laws and regulations.

To apply for the establishment of a commercial Internet cultural unit, an application shall be submitted to the cultural administrative department of the local people's government of the province, autonomous region or municipality directly under the Central Government, which shall submit it to the Ministry of Culture for approval after preliminary examination.

(2) An operating Internet cultural unit shall indicate the license number of network culture business issued by the administrative department of culture in a prominent position on the homepage of its website, and indicate the license number or record number issued by the competent department of information industry in the State Council or the telecommunications regulatory agencies of provinces, autonomous regions and municipalities directly under the Central Government.
(3) Operating Internet cultural units shall carry out Internet cultural activities within 180 days from the date of obtaining the business license for network culture and handling enterprise registration according to law. If the Internet cultural activities are not carried out within the time limit, the Ministry of Culture or the cultural administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government shall request the Ministry of Culture to cancel the network cultural business license, and at the same time, notify the telecommunications regulatory agency of the relevant province, autonomous region or municipality directly under the Central Government or the competent information industry department of the State Council.
