Can the wages of the workers whose boss was caught get back when the factory closed down?

Case: Xiao Wang works in a factory. The factory was suspected of fraud, the boss was arrested, the factory was sealed up, and the labor contract signed between Xiao Wang and the factory was deemed invalid. At that time, Xiao Wang had been working in the factory for a year and a half, and the factory owed Xiao Wang nearly ten thousand yuan. Can I get my salary back for more than a year? According to Article 18 of the Labor Law, a labor contract that violates laws and administrative regulations is invalid. There are some lawless people in society who recruit workers to make fake products. Some workers know that the contents of the labor contract are illegal, while others don't. Laborers' right to receive remuneration is protected by law. The compensation of the boss and the closure of the factory cannot be the reason for not paying wages, and the contract cannot be invalid. No matter why the labor contract is deemed invalid, whether the contract is totally or partially invalid, and whether the laborer is at fault for the invalidity of the contract (unless it constitutes a crime), as long as the laborer provides labor for the employer, the employer shall unconditionally pay labor remuneration. If the labor remuneration clause in the labor contract is valid, the labor remuneration shall be paid according to the standard and amount agreed by both parties in the contract; If the provisions on labor remuneration are also deemed invalid, the labor remuneration shall be paid according to the wage standard of the same period, the same type of work and the same position of the unit. If the employer does not directly refer to the standard, it may also determine its labor remuneration by referring to the salary standard of similar posts in other units at the same period. In this regard, Article 14 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Laws in the Trial of Labor Dispute Cases clearly stipulates: "After the labor contract is confirmed invalid, the employer can generally pay labor remuneration according to the salary standard of the same period, the same type of work and the same position." Therefore, Xiao Wang's salary can not be given and can be taken back.
