Article 1 In order to guide and help urban and rural laborers to develop individual economy, the supervision and management of individual industrial and commercial households should be strengthened to protect their legitimate rights and interests. According to the provisions of national laws, these regulations are formulated.
Unemployed people in Nijo Castle Town, rural villagers and other personnel allowed by national policies, who have the ability to operate, can apply for engaging in individual industrial and commercial operations and become individual industrial and commercial households after being approved and registered according to law.
Article 3 Individual industrial and commercial households may engage in industries such as industry, handicrafts, construction, transportation, commerce, catering, service and repair within the scope permitted by national laws and policies.
Article 4 Individual industrial and commercial households may operate individually or at home. Personal business, with all personal property to bear civil liability; Family business, with all family property to bear civil liability.
Individual industrial and commercial households can hire one or two helpers according to their business conditions; Skilled individual industrial and commercial households can take three or five apprentices.
Article 5 The legitimate rights and interests of individual industrial and commercial households are protected by state laws, and no unit or individual may infringe upon them.
Article 6 The State Administration for Industry and Commerce and local administrations for industry and commerce at all levels shall perform the following administrative duties for individual industrial and commercial households:
(1) Examining and registering applications for engaging in individual industrial and commercial operations, and issuing business licenses;
(2) To manage and supervise the business activities of individual industrial and commercial households, protect legitimate business operations, investigate and deal with illegal business activities, and maintain urban and rural market order in accordance with the provisions of laws and these Regulations;
(three) to give guidance to the work of the association of individual workers;
(four) other management authority granted by the state.
The relevant industry authorities shall, in accordance with the provisions of the state, conduct business management, guidance and assistance to individual industrial and commercial households.
Article 7 An individual or family applying to engage in individual industrial and commercial operations shall apply to the local administrative department for industry and commerce for registration with the local household registration certificate and other relevant certificates, and may start business only after being approved by the county-level administrative department for industry and commerce and obtaining a business license.
Where the state stipulates that operators need to meet certain conditions or obtain approval from the competent department of industry, they shall submit relevant approval documents when applying for registration.
Applications for hotel business, lettering business, trust consignment business and printing business shall be examined and approved by the local public security organs.
Article 8 The main items registered for individual industrial and commercial households are: shop name, name and domicile of the operator, number of employees, amount of funds, organizational form, business scope, mode of operation and business premises.
Ninth individual industrial and commercial households to change the name, business domicile, organizational form, business scope, mode of operation, business premises, etc. If an individual industrial and commercial household changes its name to a family operator, it shall register the change with the original administrative department for industry and commerce. Without approval, it shall not be changed without authorization.
Self-employed individual industrial and commercial households shall re-apply for registration when changing their operators.
Article 10 Individual industrial and commercial households shall go through the inspection formalities at the local administrative department for industry and commerce at the specified time every year. If it fails to make corrections within the time limit without justifiable reasons, the administrative department for industry and commerce has the right to confiscate its business license.
Article 11 When individual industrial and commercial households close down, they shall go through the formalities of closing down and hand in their business licenses. If the business is suspended for more than six months, the business license shall be confiscated by the original registered administrative department for industry and commerce.
Article 12 Individual industrial and commercial households shall pay off their debts to creditors when their business licenses are cancelled, confiscated or revoked.
Thirteenth individual industrial and commercial households shall pay registration fees and management fees in accordance with the provisions. The charging standards and management measures for registration fees and management fees shall be jointly formulated by the State Administration for Industry and Commerce and the Ministry of Finance.
Fourteenth individual industrial and commercial households need production and business premises, the local people's government should be included in the urban and rural construction planning, overall arrangement. No unit or individual may occupy the approved business premises without authorization.
Fifteenth raw materials, fuels and materials needed by individual industrial and commercial households need to be supplied by state-owned wholesale units, and the supply units shall make reasonable arrangements without discrimination.
Article 16 Individual industrial and commercial households may, with their business licenses, open accounts in banks or other financial institutions in accordance with regulations and apply for payment of goods.
Article 17 The business license of individual industrial and commercial households is a legal document issued by the administrative department for industry and commerce authorized by the state. Except that the administrative department for industry and commerce can withhold or revoke it according to legal procedures, no unit or individual may withhold or revoke it.
Eighteenth except as otherwise provided by laws, regulations and the provincial people's government, no unit or individual may charge fees to individual industrial and commercial households.
Individual industrial and commercial households have the right to refuse to pay fees without authorization, and the administrative departments for industry and commerce at all levels have the right to stop them.
Nineteenth individual industrial and commercial households shall abide by the provisions of national laws and policies, consciously maintain market order, abide by professional ethics, engage in legitimate business, and shall not engage in the following activities:
(1) speculative fraud, smuggling and bootlegging;
(two) dominate the market, drive up prices, buy and sell;
(three) Jerry-building, shoddy, short scale, adulteration;
(four) the sale of food that does not meet the hygiene standards and is harmful to human health;
(five) the production or sale of drugs, fakes and fake and shoddy goods;
(6) selling reactionary, absurd and obscene audio-visual products;
(seven) other production and business activities that are not allowed by laws and policies.
Article 20 Individual industrial and commercial households shall handle tax registration, establish account books and file tax returns in accordance with the provisions of the tax authorities, and shall not evade taxes or refuse to pay taxes.
Twenty-first individual industrial and commercial households should sign written contracts to hire helpers and apprentices according to regulations, stipulate the rights and obligations of both parties, and stipulate labor remuneration, labor protection, welfare treatment, contract term and other matters. The signed contract is protected by national laws and shall not be violated at will.
Individual industrial and commercial households engaged in industries related to personal health and life safety must insure their helpers and apprentices with China People's Insurance Company.
