The Measures for the Administration of Chinese Cultural Heritage Signs have been considered and adopted at the 2nd executive meeting of National Cultural Heritage Administration No.65438 on June 26th, 2006, and are hereby promulgated. Please follow them.
Measures for the Administration of Chinese Cultural Heritage Signs February 6, 2006
Article 1 These Measures are formulated for the purpose of regulating the protection and management of Chinese cultural heritage signs and safeguarding the rights and interests of owners of Chinese cultural heritage signs.
Article 2 The symbol of Chinese cultural heritage as mentioned in these Measures refers to the graphic symbol of chinese heritage determined and published by National Cultural Heritage Administration (see Annex 1).
Article 3 National Cultural Heritage Administration is the right holder of Chinese cultural heritage symbols. National Cultural Heritage Administration authorized China Cultural Relics Information Consulting Center to protect and manage Chinese cultural heritage signs and their use, and safeguard the rights and interests of owners of Chinese cultural heritage signs.
China Cultural Relics Information Consulting Center shall fulfill the legal procedures for the protection of Chinese cultural heritage signs and strengthen the management of the use of Chinese cultural heritage signs.
Article 4 Any unit, organization or individual shall abide by the provisions of these Measures when using the symbols of Chinese cultural heritage.
Article 5 The use of symbols of Chinese cultural heritage shall be enlarged or reduced according to the style specified in Annex 1 of these Measures, and the proportion and style of graphics shall not be changed.
Sixth Chinese cultural heritage signs can be used for public welfare activities and commercial activities.
Chinese cultural heritage symbol holders encourage the use of symbols in public welfare activities to protect cultural heritage. China Cultural Relics Information Consulting Center shall guide and supervise the use of Chinese cultural heritage signs in public welfare activities.
Users who use Chinese cultural heritage signs for commercial activities shall apply to China Cultural Relics Information Consulting Center in advance and obtain permission.
Article 7 The use of Chinese cultural heritage signs in commercial activities refers to the use of Chinese cultural heritage signs in the following ways for the purpose of making profits:
(a) the use of Chinese cultural heritage marks on commodities, commodity packages or containers, and commodity trading vouchers;
(two) the use of Chinese cultural heritage signs in service projects;
(three) the use of Chinese cultural heritage signs in advertisements, commercial exhibitions and commercial performances;
(four) the sale and export of goods with the symbol of Chinese cultural heritage;
(five) manufacturing or selling Chinese cultural heritage signs;
(six) other acts that may make people think that there is a sponsorship or other support relationship between the actor and the right holder of Chinese cultural heritage signs.
Article 8 Where Chinese cultural heritage signs are used for commercial activities, an Application for the Use of Chinese Cultural Heritage Signs (see Annex II) shall be provided to China Cultural Relics Information Consulting Center in duplicate, together with the original or photocopy of the applicant's business license or legal person qualification certificate. A copy of the applicant's legal person business license or legal person qualification certificate shall be stamped with the official seal of the applicant.
Upon examination and approval, the applicant shall sign the License Agreement for the Use of Chinese Cultural Heritage Signs with China Cultural Relics Information Consulting Center. Both parties to the agreement shall exercise their rights and assume their obligations in accordance with the specific agreement.
Article 9 The China Cultural Relics Information Consultation Center shall handle the related affairs of using Chinese cultural heritage symbols in commercial activities according to the requirements of laws, administrative regulations and obligees. All income should be used to protect cultural heritage.
Tenth China Cultural Relics Information Consulting Center shall regularly report the protection and management of Chinese cultural heritage signs to the owners of Chinese cultural heritage signs for the record.
Article 11 These Measures shall be implemented as of the date of promulgation.
Annex I:
1. Use simplified Chinese "Chinese Heritage" above the Chinese cultural heritage logo; In the following, the Chinese phonetic alphabet "China Culture Yi Chan" is used. Ethnic autonomous areas can use local minority languages, and foreign exchanges can use English "chinese heritage" or other languages.
2. The standard color of Chinese cultural heritage signs is gold, and other colors can be used according to different needs.
3. The core patterns of Chinese cultural heritage signs can be used as signs independently.
