Measures for the administration of wireless communication network construction in Yunnan Province

Article 1 In order to strengthen the management of wireless communication network construction, ensure the safe and smooth communication, and safeguard the legitimate rights and interests of relevant stakeholders, these Measures are formulated in accordance with the Regulations of People's Republic of China (PRC) on Radio Management, the Regulations of People's Republic of China (PRC) Telecom and other laws and regulations, combined with the actual situation of this province. ? Article 2 These Measures shall apply to the planning and construction of wireless communication networks, the setting of base stations and their supervision and management activities within the administrative area of this province.

The term "wireless communication network" as mentioned in these Measures refers to the wireless network of public mobile communication, wireless trunking communication and wireless access. ? Article 3 People's governments at or above the county level shall incorporate wireless communication network infrastructure into urban and rural planning, land use planning and forest land use protection planning, and give necessary policy support. ?

The administrative department of industry and information technology is responsible for the comprehensive coordination and guidance of the construction and management of wireless communication networks. Radio management agencies are specifically responsible for the management of related frequency use, planning review, and base station setting. ?

Provincial communication management agencies are responsible for the supervision and management of the construction of public mobile communication networks. ?

Other relevant departments shall do a good job in the construction and management of wireless communication networks in accordance with their duties. ? Article 4 The urban and rural planning organized by the competent department of urban and rural planning shall set up a chapter on the construction of wireless communication networks. ?

The relevant units shall prepare construction plans for development zones, industrial parks, urban renewal areas, tourist attractions and transportation hubs, highways and railways, and shall also prepare sub-plans for the construction of wireless communication networks. ?

Wireless communication network construction projects should be included in the detailed planning of urban control, and put forward the requirements of setting up base stations, computer rooms, antennas, pipelines and so on. It should be clarified. Fifth provincial telecom operators should listen to the opinions of provincial radio management institutions before preparing the construction plan of public mobile communication network. ?

State (city) level telecommunications business operators shall, according to the radio station site planning, prepare the annual construction plan of the base station, and report it to the state (city) radio management agency for review. The results of the review shall be announced to the public by the state (city) radio management institution and copied to the competent department of urban and rural planning. ?

The construction unit shall solicit the opinions of the provincial radio management institution when preparing the construction plan or draft plan of the wireless trunking communication system. Sixth airports, railways, highways, rail transit and other construction activities. , the project construction unit shall design, construct and check the base station computer room, power supply system, transmission pipeline and other facilities simultaneously with the construction project. ?

Housing and urban-rural construction departments should also review the preliminary design of wireless communication network construction when reviewing the preliminary design of construction projects. ? Article 7 Buildings and structures in signal blind areas or weak areas, large public places and other areas shall be equipped with indoor radio signal coverage systems, which shall conform to the relevant national and provincial standards and norms. ?

The design of indoor radio signal coverage system should meet the requirements of multiple public mobile communication systems. ? Article 8 When occupying a site or facility, a telecommunication business operator shall sign relevant agreements with the obligee and pay the lease fee for the site or facility. No agreement shall be signed to exclude other telecom operators from enjoying relevant infrastructure resources. ? Article 9 Power supply enterprises shall provide convenient conditions for power access of base station facilities, handle relevant examination and approval procedures in time, and collect fees according to regulations. When transferring power to telecom operators, power users shall accept the entrustment of power supply enterprises and sign agreements. The electricity fee shall be paid by the telecom operator to the power supply enterprise. ? Tenth base station site selection should give priority to non-residential buildings and structures of state organs, institutions and state-owned enterprises or other non-residential buildings and structures invested by the government. ?

Property management units shall provide conditions for the establishment of base stations according to the requirements of base station construction. Article 11 Where a base station is set up in the following places, its management unit shall provide conditions such as computer room, antenna position, pipeline and power supply access.

(1) Buildings and structures invested by the government; ?

(2) Parks, squares, ecological control areas, urban roads, expressway, rail transit facilities and residential quarters; ?

(3) Other facilities invested by the government. ? Twelfth outdoor base station location, installation and use shall comply with the following provisions:

(a) in the residential area, the consent of the relevant owners and property service units must be obtained; ?

(4) Where a base station is set up on a building or structure, it shall obtain the consent of the property owner, adopt a miniaturization and concealment scheme, and the direction and layout of the antenna feed shall be coordinated with the building and the surrounding environment; ?

(5) If a base station is installed on a civil or commercial building or structure, the owner or user shall be informed at least 15 days before the construction. ? Article 13 If the distance of base station location between telecom operators is close or overlapping, the radio management institution shall coordinate the use of the same site resources. ?

The construction scheme of indoor radio signal coverage system should follow the principle of multi-network integration and resource sharing. Telecom operators have not reached an agreement on the construction of * * * *, which shall be coordinated by the radio regulatory agency. ?
