The business activities of social organizations are guided by the relevant competent departments. Chapter II Jurisdiction Article 7 The establishment of social organizations across provinces, cities and counties shall apply to the provincial civil affairs administrative department for registration; Establish a city or county social organization and apply for registration with the local civil affairs administrative department of the city or county. Article 8 The relevant competent business departments and registration administration organs shall be responsible for the daily management of social organizations that have been approved and registered.
If the registration administration organ and the office of the social organization approved for registration are not in the same administrative region, it may entrust the registration administration organ where the office of the social organization is located to take charge of daily management. Chapter III Registration Article 9 The preparatory activities of social organizations shall be approved by the competent business department or the civil administration department at or above the city or county level. Article 10 To apply for the establishment of a social organization, an application for registration shall be submitted to the registration authority after examination and approval by the relevant competent department.
The competent department of social organizations refers to the functional departments of the government and the working departments of the party. When it is not convenient for the competent departments of some social organizations to be undertaken by the functional departments of the government or the working departments of the party, they can also entrust other competent units to conduct qualification examination and business guidance after consultation with the competent administrative departments of civil affairs and relevant competent departments. Eleventh to apply for the establishment of a social organization, the following materials shall be submitted to the registration authority:
(1) An application for registration signed by the person in charge;
(2) Review documents of relevant competent departments;
(3) Articles of association of social organizations;
(four) the office address or contact address;
(five) the name, age, address, occupation and resume of the person in charge;
(6) Number of members. Article 12 The articles of association of a social organization shall specify the following items:
(1) name;
(2) purpose;
(3) Sources of funds;
(4) organizational structure;
(five) the procedures and terms of reference of the person in charge;
(6) Procedures for amending the Articles of Association;
(7) Procedures for the termination of social organizations;
(8) Other necessary matters. Thirteenth the establishment of a foundation shall be handled in accordance with the provisions of the Measures for the Administration of Foundations promulgated by the state. Article 14 The establishment of social organizations must adhere to the principles of being conducive to the reunification of the motherland and national unity, to political and economic stability and to the prosperity of science, culture and education.
Except for a few social organizations with a long history and a certain international reputation, no other social organizations should be established.
The establishment of social organizations such as alumni associations due to social needs should be examined and approved by provincial education, foreign affairs, United front and other business departments according to different nature, and the local civil affairs administrative department can go through the examination and approval registration procedures.
Religious social organizations based on surnames or surnames, and mass organizations based on certain regional concepts should not be approved. Article 15 The name of a social organization shall be consistent with its business scope, membership distribution and activity area.
The names of non-provincial social organizations shall not be preceded by the words "Hainan", "Qiongzhou" and "the whole province".
The same or similar social organizations shall not be established repeatedly in the same administrative area.
Provincial social organizations can set up offices, but they cannot set up independent social organizations such as secondary societies, associations and research associations. Sixteenth national and inter-provincial (autonomous regions and municipalities directly under the central government) social organizations, due to special needs, set up offices (liaison offices) in this province, which need to be approved by the Ministry of Civil Affairs. The provincial civil affairs administrative department may put on record according to the approval documents it holds.
The office (liaison office) is an agency of social organizations, which does not have legal personality, and can only carry out business activities in the name of its affiliated organization, and accept the daily supervision and management of the provincial civil affairs administrative department.
